AN ORDINANCE DISCONTINUING TERRITORY FROM WITHIN
THE CORPORATE LIMITS OF THE CITY OF FORT WORTH,
TEXAS; RELEASING TERRITORY FROM THE EXTRA-
TERRITORIAL JURISDICTION OF THE CITY OF FORT
WORTH; CONSENTING TO THE ANNEXATION OF SAID TER-
RITORY BY THE CITY OF EVERMAN, TEXAS; PROVIDING
THAT THIS ORDINANCE SHALL AMEND EVERY PRIOR OR-
DINANCE IN DIRECT CONFLICT; PROVIDING THAT THIS
ORDINANCE SHALL BE CUMULATIVE; PROVIDING FOR
SEVERABILITY AND NAMING AN EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH,
TEXAS:
SECTION 1.
That the hereinafter described territory within the
corporate limits of the City of Fort Worth be and the same
is hereby discontinued as a part of the City of Fort Worth;
said territory being:
A portion of Block 9 of the Shelby County School
Land Survey, Abstract No. 1375, situated in Tarrant
County, Texas, about 9 miles Southeasterly from the
Tarrant County Courthouse, and being more particularly
described by metes and bounds as follows:
BEGINNING at a point for corner in the Northerly
line of Mallick Parkway, same being in the Everman
and Fort Worth common boundary line, at its inter-
section with the West line of the Everman City
Park tract produced North.
THENCE South, to and along with the West line of
the Everman City Park tract 1, 300 feet, more or
less to a point for the Southwest corner of the
said Everman City Park tract.
THENCE East, along and with the South line of the
Everman City Park tract, 661 feet to a point for
corner in the West right-of-way line of Dan Meyer
Drive.
THENCE South, along and with the West right-of-way
line of Dan Meyer Drive, to a point for corner in
the North right-of-way line of Oak Grove-Shelby Road
(County Road No. 1098) .
THENCE East, along and with the North right-of-way
line of Oak Grove - Shelby Road (County Road No. 1098)
to a point for corner in the East right-of-way line
of Race Street, or Celeste, (County Road No. 1004) .
THENCE North, along and with the East right-of-way
line of Race Street, or Celeste, (County Road No.
1004) to a point for corner at its intersection with
the present Everman and Fort Worth common boundary
line.
THENCE Westerly, along and with the present Everman
and Fort Worth common boundary line, to the PLACE
OF BEGINNING, and embracing approximately 90 acres
of land.
SECTION 2.
That the City of Fort Worth hereby relinquishes to the
City of Everman all extraterritorial jurisdictional rights over
the hereinabove described territory, under the provisions of
the Texas Municipal Annexation Act (Article 970a, Revised Civil
Statutes of Texas, as amended) .
SECTION 3.
That the City of Fort Worth hereby consents to the
annexation of the hereinabove described territory by the
City of Everman.
SECTION 4.
That this ordinance shall and does amend every prior
ordinance in conflict herewith, but as to all other ordinances
or sections of ordinances not in direct conflict, this ordinance
shall be, and the same is hereby made cumulative.

SECTION 5.
THAT it is hereby declared to be the intent of the City
Council that the sections, paragraphs, sentences, clauses and
phrases of this ordinance are severable, and if any phrase,
clause, sentence, paragraph or section of this ordinance shall
be declared unconstitutional by the valid judgment or decree
of any court of competent jurisdiction, such unconstitutionality
shall not affect any of the remaining phrases, clauses, sentences,
paragraphs and sections of this ordinance, since the same would
have been enacted by the City Council without the incorporation
in this ordinance of any such unconstitutional phrase, clause,
sentence, paragraph or section.
SECTION 6.
That this ordinance shall take effect and be in full force
and effect from and after its passage, and it is so ordained.

As previously reported to the City Council during regent consideration
of a deanne. ,atl.,en request, the City of Everma,n has requested that h
Fort trrtlr and .Ever an commonboundary line be adjusted and that approxi-
mately a",tel 90 acres of land be deannexed from Fort Worth and be made available
for annexation by ver ran, as shown on the attached map.
AREA INVOLVED!
The area involved Includes the Everts. ISD Administration Building
Tact 9E) and Senior High drool (Tract 9Cw) , the EEver man Methodist
Church (Tract 9D) , the Everman City Para site (Tract 9 and 17 acre
tract In prrivate, ownership, pl.raa the adjacent right-of-way of Mallick
Parkway and other dedicated streets. The area is generally hounded on
the east by the east right-of-way lime of Rare Street or Gayfield
Road) , on the ,south b. Clad, Grove-Shelby Road (Country Road No. 1098), on
the west; by the west right-of-way line of Dan Meyer Drive and the Everman
City Park tract line and on the north, by the north right-of-way lime of
ll ick Parkway, as shown on the attached map. 'there are as residences
within the area at this time, nor is there any present plan for residential
development of the only undeveloped, privat.'ely owned tract of land which
the City of Evetrran bopes to acquire for expansion of their existing
park.
TAXES:
e tt,bear the Ever man Independent, School District ct dministruat ion Building,
Senior Higb School, Everman Methodist Churth, nor the Ev`erman, City Park
represents any tax yield to Fort Worth. The 17 acre tract in private
ownerslrlp is assessed on the 1976 Fort Wirth roll at an assessed valuation
of $17,140 for an annual tars yield to the City of $28947.
UTILITIES:
Fort Worth has an 8" sanitary sewer line in Race Street, running nrwrtlr
into the Everman sani"tar"y* server system, a:nd serving only the Eve n.
Senior High School, "There is an existing 18" sanitary sewer main in the
section of kallick-Parkway, proposed for deannexat"Ion, hi„rlr discharges
into the 'Ever man s steur, Tbeure are no other Fort Worth water and sanitary
sewer facilities in the area ;involved. Attached is a ropy of a letter
from the Mayor of Eve an that includes their agreement to participate
in paving and, drainage costs of all border streets to assure event; 1,
full development of the area to atceptable standards..
