WHEREAS, the City of Fort Worth (City) and Lockwood, Andrews &
Newnam, Inc. , (Engineer) made and entered into City Secretary
Contract No. 28790, (the Contract) which was authorized by the City
Council by M&C C-19585 on the 13th day of May 2003; and
WHEREAS, the Contract involves engineering services for the
following project:
Sanitary Sewer Rehabilitation Contract IXVII (67)
WHEREAS, it has become necessary to execute Amendment No. 1 to
said Contract to include an increased scope of work and revised
maximum fee;
NOW THEREFORE, City and Engineer, acting herein by and through
their duly authorized representatives, enter into the following
agreement which amends the Contract:
1.
Article I of the Contract is amended to include the additional
engineering services specified in a proposal letter dated June 15,
2004, a copy of which is attached hereto and incorporated herein.
The cost to City for the additional design services to be performed
by Engineer total $22,350.00.
2.
Article II of the Contract is amended to provide for an
increase in the maximum fee to be paid to Engineer for all work and
services performed under the Contract, as amended, so that the
total fee paid by the City for all work and services shall not
exceed the sum of $283,056.00,

All other provisions of the Contract which are not expressly amended
herein shall remain in full force and effect.

Dear Mr. Conlon:
Following a number of meetings with you and City of Fort Worth staff, and coordination with
other project teams, we have developed this Amendment No. I with respect to the above
referenced project. The amendment corresponds to the additional survey and engineering
services that Lockwood, Andrews & Newriam, Inc. (LAN) has performed in order to adjust the
project to meet new requirements and field conditions that were not apparent at the time the
initial project scope was developed. The original contract for this project was executed on May
13, 2003 and formal notice to proceed was issued on July 7, 2003. At the time of contract
authorization, the project entailed two separate phases described as follows:
Phase I - Design of a 12-inch sewer main from a connection point on the existing M-272B trunk

main in Trinity Park, to the northwest to serve the redevelopment of the Montgomery Ward
property and the proposed South of 7'h residential development. Smaller lines were to be
extended across West 7th Street to the north of Trinity Park terminating at the intersection of 5'h
and Greenleaf Streets.
Phase 2 — Design of a 24-inch sewer main from a connection point on the existing M-545 trunk
main in the proximity of the White Settlement Road / Jacksboro Highway intersection, to the
west on White Settlement Road and South on Wimberley Street to a termination point at the
Wingate Street intersection. Smaller lines were to be extended south on Adolph Street to serve
the north portion of the Montgomery Ward property, and west on White Settlement Road to
University Drive. The alignment south on Wimberley Street was initially selected by the City in
order to replace the section of sewer main M-1312 in this area that had experienced chronic
maintenance requirements. Downstream portions of the existing M-132 main in White
Settlement Road were also to be replaced with service transfer to the new parallel sewer main.
Other portions of the existing M-132 main not located in White Settlement Road were to remain
in sen7ice.
Following notice to proceed, LAN prepared a Conceptual Design Summary Report based upon
the original scope. The report was submitted on September 4, 2003 and delip'-e-qti�d--the-same

alignments as proposed in the original scope. These alignments were considered to be practical
and were subsequently approved by the City (specifically Mr. Peter Fu, P.E. and Mr. Chris
Harder, P.E.) at a meeting with LAN on September 12, 2003 (see conference memorandum
9116103). LAN then proceeded with topographic surveying and development of preliminary
engineering plans.
Since the initiation of the construction plan development, LAN has been directed to make several
changes in the design scope associated with each phase. These are summarized as follows:
Phase I Scope Changes:
1. Increase of sewer main size from 12-inches to 30-inches in order to accommodate
future connection of re-routed M-134-R (M-1-C-C4-B) sewer main under design by
Dunaway and Associates. Direction to increase the main size for this future
connection was issued at the project meeting on September 12, 2003 (see conference
memorandum 9116103). Associated flow rates from the M-134-R main to be
accommodated by the future connection were provided by Mr. Chris Harder, P.E. of
the City on October 7, 2003. However, LAN was required to perform an independent
analysis of the additional flows generated from the Montgomery Ward re-
development and adjacent service areas north of West 7`i' Street (see E-mail
correspondence dated 1116103). LAN also performed additional coordination with
Dunaway and assisted them with utility location work in support of the M-134-R re-
route design program. Along with the line size increase, the revision required that
LAN design a special junction box for connection with the existing M-272-B trunk
main in Trinity Park.
2 Re-route of sewer main off of West 7"' and Carroll Streets and into the Montgomery
Ward property following negotiation by LAN for easements from the developer.
Provision of the easements eliminated approximately 1,300 linear feet of street repair
and traffic control requirements from the project. The re-route was approved by Mr.
Peter Fu, P.E. of the City(see conference memorandum 12129103)
Phase 2 Scope Changes
L Re-route of new sewer main from Wimberley Street to Currie Street due to grade
conflicts with existing storm and raw water supply mains in Wimberley Street. The
original alignment on Wimberley Street to Wingate Street (see Exhibit A) was
considered to be unsuitable due to these conflicts. An alternative alignment on 'Currie
Street (Yee Exhibit �) offered fewer conflicts with utilities and provided better flow
line grades to serve upstrearn customers. Wimberley Street mains will still be
replaced but with smaller lines and routings that will avoid the pnimary area of
conflict at the intersection with Weisenberger Street, This revision was approved by
Mr. Liam Conlon of the City following review of data obtained by LAN from their
topographic survey and utility location work in support of the design program. The
grade conflict was not apparent at the time of preparation of the Conceptual Design

construction risk associated with the new sewer utility (see conference memorandum
11119103).
2. Provision of special siphon boxes to affect connection with new 2 1-inch sewer main
in the south portion of Wimberlcy Street being designed by Graham and Associates
and designated as DOE #2217. LAN worked directly with Graham to coordinate the
two projects with corresponding meetings with the City Field Operations Division to
verify existing conditions and improvement recommendations. Extension of the new
M-132 main south on Currie Street offered the advantage of a direct connection with
the Graham project and improved its associated depth and grades. The change
offered an initial starting point from which to improve sewage collection flows
throughout the Linwood Addition of Fort Worth. This advantage was initially
recognized by Mr. Liam Conlon of the Water Department and subsequently by Mr.
Fred Ehia, P.E. of the Engineering Department. Mr. Ehia is the City project manager
for the DOE #2217 project being performed by Graham. He subsequently instructed
Graham to revise their design to fit with the connection point to be provided by the
LAN project (see conference memorandum 11119103).
The activities and changes as outlined above have resulted in the need for additional meetings,
surveying, and engineering design work in order to incorporate the additional project scope
requirements. Hourly charges for personnel and lump sum costs associated with this work are
summarized on Exhibit I attached. Based upon these scope changes, Amendment No. I has been
developed in the amount of$22,350. This increase would adjust the engineering contract fee
from $260,706 to $283,056.
