CESQG hereby certifies that it is a conditianally-exempt small quanti#y generator und�r the
laws of the United States a�d the State of i�xas, and that under normai operating
conditions its business gsnerates less than 22D pounds (26.� gallons) of hazardous
waste(s) and less than 2.� pvunds {Q.265 gallons} of �cutely ha�ardous waste(s) in one
calendar month.
2. T�I�M - The ferm of this AGREEMENT shall rurr frqm the date the last party signs this
AGREEM�NT until Decem�er 31, 2Q�2. ,

A. CITY shall accept and arrange for the disposa� the fvllowing waste(s)s from C�S4G:
antifreeze; cleaning solu�ions; corrosives; flammables; oil (motnr oll, spen# oil); oxidizers;
latex and oi!-based paints; pesticides & herbicides; solven#s & thinners; fertilizers; mator
grease and food grease; al c�afine batteries, button batteries, lead a�id batteries, lithium
batteries NiCd batteries; aerosol cans; non-PC� ballasts; fluorescent bulbs and oil
filters. CIiY wil! not accept any ather waste(s).
B. CITY will go #o CESQG'S �lace of business ta review C�SQG's stored waste(s) � and #o
provide a writ�en estimate of the weightivalume of suc� waste(s} and the costs GITY will
charge CESQG to accept such waste(s) at the Environmenta� Colleciion Center (ECC�
located at 6400 Bridge Street, Fort Worth, Texas. C�SQ(� acfcnowfedges that written
estimates shall not 6e binding on the CIiY.
C. C1TY will accept waste(sj from CESQG an an Af'POlNTM�NT-ONLY BASIS at the ECC.
D, For vuaste that CITY accepts from the CESQG at the �CC, C1TY wiil provide for a waste
disposallrecycling firm or firms to collect, transport, store, disp'ose af, treat, recover,

E. CiTY will, if requested in writing by CESQG, pra�ide C�SQG with copies af waste
manifests for shipments of CESQG'S waste(s) from the ECC. CESQG understan�s that
its waste(s} will be cansolidat�d at the ECC with the waste{sj of other conditionally-exempt
� small quantity generators and household hazardous waste(s).
F. CITY wil! act und�r this Agreement in accordance with all applicable state and federal
laws.
G. CITY reserves th� rigt�t to reject any and all waste(s},
4. C�SQC'S O��ICATION� AND ��SPONSIBILI f1�5 �
A. CESQG agr��s tE�at it shall safely transport to the ECC its waste{s) for disposal under
this AGREEMENT following all state and federa! laws. CESQG understands that
regulations under Title 49 of the Unifed States Code of Fedaral R�gulations apply for
tfi�e transport of hazardous materials in cflmmerce.
B, CESQG agrees Yhat it sha11 bring only the type(s} of waste(s} that is acceptable pursuant
ta Sectian 3 A ab.ove.
C. CESQG agrees that it shall bring waste(s) to the ECC only after first ge�ing a written
cost estimate fram GITY and scheduling an appo�ntment. CESQG agrees that it shall
bring wasfe{s) only at its scheduEsd appaintment dates and times.
D. CESQG agrees that the waste(s) it brings to the ECC shall be represented and
identified to CITY to the best of C�SQG'S abiliiy. CESGQ agrees that it shall not bring
unknown wasie(s) to the ECC.
E. The physicai address(es) of CESQG'S facifities that are ,cavered under this

The obligations of the Contractar under this Sec�ion shall survive the expiration of this
contract and the discharge of all ather obligations owed by the parties to each other.
8. �N�IR�TY - This AGREEMENT and afl d�livery documents sign�d under this AGREEMENT
contair� all commitments and agreements of the parkies hereto, a�d no other oral or written
commitments shall have any force or effect if not contained herein.
9. SEVERA�ILIiY - In the �ve�t ar�y one or more of the provisions contained in this
AGREEMENT shall for any reas�n be heid to be invaCid, illegal, or unenforceable in any
respect, such invalidi#y, illsgality, of unenforceability sha11 not affect any ot�er provisian thereof
and this AGREEMENT shall be consirued as if such invalid, illegal, or �nenforceable
prauisions had never been contained herein.
10, V�NU� - Should any action, real or asserted, at law or in equity, arise aui of t�e terms and
conditions of this AGREEMENT, venue for said action shall be in Tarrant County, Texas.

RECOMMENDATI�N:
It is recommended that the City Council:
1. Authprize the apprava{ of pragram changes far the Small Business Hazardous Waste Program at
the En�ironmental Collection Center; and
2. Authorize extension af the pragram to inclu�e a11 small businesses within Tarrant Caunty; and
3. Authorize a rate increase to cover program costs.
DISCUSSION:
On August 22, 2000 (M&C G-12992), the City Council appro�ed tF�e Small Business Hazardous Waste
pilot program at the Environmen#al Collection Center {ECC). Over the past year, the ECC has disposed
of approximately 17,000 pounds of waste during the pilat program, for an average of 1,QOQ pounds per
business served.
On Octo�er 1, 2000, in an efFort to better serve smal� businesses and housing contractors, the ECC
instituted a pilo# program for businesses classifed as Conditiona[ly Exempt Smaq Quantity Gener�tors
(CESQGs}. Par� of the pilo# program was to allow only businesses from Fort Worth to utilize the
services at the ECC.
Over the fast year, the ECC has turned away over 20 small businesses from outside of Fort Warth
(Arlingtan, White Settlement, Haltom City, etc.) who wanted to dispose pf hazardous waste properly.
Staff is recommer�ding the CESQG program be expanded to include businesses from all of Tarrant
County. The Texas Natural Resources Conservation CommEssion also has endorsed the expansian of
the CESQG p�ogram to include a!I of Tarrant County.
The proposed rate schedule increases the flat fee for handling the waste fram $55A0 to $130.0� as
economies of scale are nat yet at optimal levels. Rate increases are the result of price increases for
disposal s�rviees and t� recoup averhead costs. Rafes will apply to all small businesses served.
