Zt is understoad by all parYies that payment obligations created by this contract are conditioned upon tha availability of Stat� or Federal funds �.gprapriated or allocated for the payment of such abligations. The term of this contract shall co�mence on December 1, 2002, and shall end an August 31, 2003, unless ex�ended ar termivated as otherwise provided :for zn. this cantract. 2. The GRANT�� AGENCY is responsible fox clasely monitoring the Servic� Provider and the exercise of reasonable care to enforce all terms and conditions of the grant. Service Provider agrees to fu11y cooperate in the monitoring process. 3 Requirements of the Ur�iform Grant Managefnent Standar�� {UGM�) prornulgated pursuant to �ection 783, of the Government Code are adopted by reference as part of this contract, including the contract provision as in Sectian 36, Comman Rule of OMB, of the above standards. Recards shall be retained fbr a least THREE (3} YEARS, fvllowing the closure of the most recent audit report and until any outstanding Iitigatian, audit or claim has been resolved. Records are subject to inspection by C1D, or any state ar federal agency authorized to inspect the same. Q The �ervic� Provider wi11 fiirnish the following: � Provide eme�rgency shelter to waman and children who fear they are in danger of domestic abuse. � Provide programs which meei the immediate physical and emotional needs of clients. � Provide programs for clienis which will help curtail the cycle of abuse. � Pravide programs to increase pLtblic awareness of domestic abuse and to address issues relating to its prevention. • Encourage and coordznate cooperation with other organizations to effect and fu1fi11 tk�.e puz-pases of Women's Haven of Tarrant County, Inc. � One Victirn Specialist with a salary and fringe benefits of $21,10a.00. � �� i � � � i �� Payment for the above (not to exceed $21,100.0� of the total amount o�the gx-a�t) wi11 be made as follows: a monthly reimbuzseznent request with an ifemized sfatement of exp�nses. � Billing for the above will be provided in the saine manner as it would be provided ta insritutional purchasers in the absence of a grant and sha11 coz�sist ofa brie�statement o�the service or other itern provided and the basis for the billing rate. 7. In the event of a default af the Service Provrder, the GRANI'�� AG�NCY may cancel or suspend the contract and the SERv][CE PRovmER shall be entitled to recover for a11 s�rvices provided or matenial� delivered prior io the cancellatian date (or unused �aterials may be returned) or shall repay any funds ad�anced far services not yet rendered. Q All licenses, Iegal certifieations, ar inspections raquired for the services, facilities, equipme�.t, or materials, and all applicable state and federal laws a�nd laca� ardinances musk be complied with by the SERVICE PROVIDBR. Failure to comply with this requir�ment sha11 be treated as a default. � This contract shall automatically ternunate on the grant expiratioz� da#e or any e�tensian date thereof granted by CJI3 or upon terminatian of the unde�lying gza�t by CJD. All services billed hereunder musi be rendered within the gxaxxi period. 10. The provisions of thi� agreement are severable at�d i� for a.ny reasqn a clause, s�ntence, paragraph or other part of this agreement shall be determined to be invalid by a court ar federal or state agency, board ar commisszon having j�risdiction over the subj ect matter thereof, such invalidity shall not affect o�t�.er pxovisions wl�ich can be given effect without the invalid provision, 11. TY�e failure of City or District to insist upon the perfarmance of any terrn or provisian of this agreeznent ar ta exercise any right herein conf�r�ed sha11 noi be construed as a waiver or relinquishment to any extent of City's ar District's right to assert or rely upon any such tez�nn oz right on any future occasion. -2- 12. Should any action, whether real or as�erted, at law or in equity, arise out of the axecu�ion, perform�nce, attempted performance or non-performance of this contract and agreement, venue for said action shall lie in Tarrant County, Texas. 13. R�COMMENDATION: It is recommended that the City Council: � of 2 �. Autharize the City Manager to execute a contract wi#F� Women's Haven of Tarrant County a# a cost not to exceed $21,10a to assist in the car�tinuation af tha Domestic Assault Response Team (DART) pragram; and , 2. Authorize ti�e agreemenf to begin Decem�er 1, 2002, and expire Augus# 3� , 2Q03. DISCUSSION: The DART program w�il continue to aperate teams consisting of a family violence detecti�e and a trained crisis intervention volu�teer, in the East FEeld Operations Di�isior� and the North Field Op�ratians D�vision. DART activities include crisis ir�tervention, informakion and referral, and facili#ating admission to the emergency shelter when indicated. � Victim sei-vices will be pro�ided thro�gh the human sefvices administrator, administrative secretary, the victim services specialist, and DART volu�teers. During the 2000-2001 grant p�riQd, the DART program traine� 30 volunis�rs, and served 568 primary and 6v� secondary victEms. ' The City Council previo�sly appraved the submission and aeceptance of the �ART grant on January 29, 2a02 (M&C G-13�a4). The DART gra�t application was submitted as a 9�-month program per direction from the funding agency, the Office of the Govemar, Crimina[ Justice ❑ivision (CJ�}. A 6-montF� grant (June 1, 2002, ihrough November 3�, 2002) was awarded and City Secretary Contract No. 2789 6 was executed with Women's Ha��n for $14,034 to cover the �salary and fringe ben�fits af the vic�imlvolunteer speciaiist provid�d by them. � fn Novem��r 20D2,: CJD awarded a 9-ma�t� grant (December 'E, 2Da2, thro�gh August 31, 2003) and a new con�ract will be ex�cuted to continue the salary and firinge benefits ($21,10Q} ofi the victimlvolunteer specialist �rovided by Women's Haven.
