WHEREAS, the City of Fort Worth (City) and DeOtte, Inc. ,
(Engineer) made and entered into City Secretary Contract No. 30449,
executed on the 3d day of September, (the Contract) which was
authorized by M&C No. C-20164 on the 27th of July, 2004;
WHEREAS, the Contract involves engineering services for the
following project:
Citywide Roadway Flooding Hazard Assessment
Project No. P228-531200-201280012431
WHEREAS, it has become necessary to execute Amendment No. 2 to
said Contract to include an increased scope of work and revised
maximum fee;
NOW THEREFORE, City and Engineer, acting herein by and through
their duly authorized representatives, enter into the following
agreement which amends the Contract:
1.
Article I of the Contract is amended to include the additional
scope of engineering services specified in Attachment A, a copy of
which is attached hereto and incorporated herein. The cost to City
for the additional services to be performed by Engineer total
$25,850.
2.
Article II of the Contract is amended to provide for an increase
in the maximum fee to be paid to Engineer for all work and services
performed under the Contract, as amended, so that the total fee paid
by the City for all work and services shall not exceed the sum of
$338,350.

All other provisions of the Contract which are not expressly

Signal (HWWS) Plan Preparation

Dear Mr. McElroy:
This letter serves as our request for additional funds related to the
referenced project to provide additional services requested by the City of Fort
Worth. These additional services include the preparation of plans for City of Fort
Worth review.
The original Agreement approved by city council on July 27, 2004 (M&C
C-20164) anticipated a limited amount of drafting and design. It is now apparent
that a full set Engineering Design plans are required for the project.
This amendment is for services related to plan preparation for the location
of signs and equipment to be installed as part of the City of Fort Worth High
Water Warning System program.
Part of the funding for the High Water Warning System is being provided
by the federal government which is being managed through TxDOT. As a result,
previous sketched provided give an indication of the locations of the signage. A
set of plans is required to be prepared for TxDOT review as part of the funding.
Following an assessment of the contract and the additional services
required, the scope must be changed to eliminate the as-built surveys and add a
complete set of plans including sign locations, construction details including
equipment details, traffic control plans, appropriate cover sheet and notations.
This amendment includes the preparation of plans for City of Fort Worth
review and revisions as a result of review that are minor in number and nature.

This amendment provides for up to a total of 54 sheets in the total set of
plans. This includes a cover sheet, a sheet for general notes, an overall location
index sheet, 36 sheets for 31 sites (some sites will require more than one sheet)
and between six and 15 standard TxDOT detail sheets.
We anticipated that the services and scope changes for this amendment
can be provided for an additional fee of$25,850.

With the authorization of this amendment, the original agreement will be
increased to $338,350.
The Contract Amendment will include the change of scope for our M/WBE
but will not change our contract amount with them so we see no M/WBE impact
as far as this change is concerned. Please note that half of the work remaining
after the amendment is issued will be completed by one of our M/WBE sub-
contractors.

sub-contractor. No changes are proposed to the M/WBE commitments at this
time.
