HomeMy WebLinkAboutOrdinance 17294-11-2006ORDINANCE NO. 17294-11-2006 AN ORDINANCE ADJUSTING THE TOTAL NUMBER OF AUTHORIZED CIVIL SERVICE POSITIONS AT EACH CLASSIFICATION (RANK} IN THE FIRE DEPARTMENT FOR FISCAL YEAR 2006-2007; PROVIDING FOR THE GREATION OF ONE ADDITIONAL CAPTAIN POSITION; TWO ADDITIONAL LIEUTENANT POSITIONS; THREE ADDITIONAL ENGINEER POSITIONS; TEN ADDITIONAL FIREFIGHTER; PROVIDING A STATEMENT OF PURPOSE AND INTENT; PROVIDING THAT THIS ORDINANCE SHALL BE CUMULATIVE, PROVIDING A SEVERABILITY CLAUSE; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, the City's Ordinance No. 17142-09-2006, the most recent ordinance concerning the authorized and budgeted positions for the Fire Department, adjusted the Department's civil service staffing as follows: Deputy Chiefs 3 Battalion Chiefs 24 Captains 80 Lieutenants 115 Engineers 188 Firefighters 411 TOTAL 821 WHEREAS, the Fire Chief now requests that the Council readjust the total authorized number of Fire Department civil service positions at the classifications (ranks) listed below for the remainder of the 2006-2007 Fiscal Year, in conformity with the changes set forth below; and WHEREAS, pursuant to Chapter 143.021(a}, Texas Local Government Code, the City Council may prescribe and/or adjust the authorized number of positions in each classification (rank} by ordinance; NOW, THEREFORE,. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That, effective immediately upon the adoption of this ordinance, the following positions shall be the only civil service positions in each classification {rank) authorized in the City of Fort. Worth Fire Department for the remainder of the Fiscal Year 2005-2006, or until modified by subsequent ordinance: Deputy Chiefs 3 Battalion Chiefs 24 Captains 81 Lieutenants 117 Engineers 191 Firefighters 421 TOTAL 837 SECTION 2. Bt is hereby declared to be the intention of the City Council that the phrases, clauses, sentences, paragraphs, or sections of this ordinance are severable, and if any phrase, clause, sentence, paragraph, or section of this ordinance shall be declared unconstitutional by the valid judgment or decree of any court of competent jurisdiction„ such unconstitutionality shalt not affect any of the remaining phrases, clauses, sentences, paragraphs, and sections of this ordinance, since the same would have been enacted by the City Council without the incorporation in this ordinance of any such unconstitutional phrase, clause, sentence„ paragraph, or section. SECTION 3. This ordinance shall take effect upon adoption. DISCUSSION: Adoption of the attached ordinance will provide staffing for Fire Station 38, 13280 Park Vista Boulevard, which will become operational in December 2006. The ordinance also authorizes two firefighter positions for Fire Safety Education as provided for in the FY 2006-07 adopted budget. The ordinance will go into effect on the day of its approval by City Councif The addition of these positions would result in the following changes to the authorized staffing of the Fire Department: Rank Current Proposed Deputy Chief 3 3 Battalion Chief 24 24 Captain 80 81 Lieutenant 115 117 Engineer 188 191 Firefighter 411 421 Total 821 821 AMENDMENT: The total amount in the "Proposed" column has been amended from 821 to 837.
