AN ORDINANCE INCREASING THE NUMBER OF AUTHORIZED
CIVIL SERVICE POSITIONS IN THE FIRE DEPARTMENT BY A
TOTAL OF FORTY-SEVEN EFFECTIVE OCTOBER 1, 2023, BY
ADDING THREE POSITIONS IN THE CLASSIFICATION OF
BATTALION, TWO POSITIONS IN THE CLASSIFICATION OF
CAPTAIN, ELEVEN POSITIONS IN THE CLASSIFICATION OF
LIEUTENANT, ELEVEN POSITIONS IN THE CLASSIFICATION OF
ENGINEER, AND TWENTY POSITIONS IN THE CLASSIFICATION OF
FIREFIGHTER; PROVIDING A STATEMENT OF PURPOSE AND
INTENT; PROVIDING THAT THIS ORDINANCE SHALL BE
CUMULATIVE OF ALL PRIOR ORDINANCES AND REPEAL
CONFLICTING ORDINANCES; PROVIDING A SEVERABILITY
CLAUSE; AND PROVIDING AN EFFECTIVE DATE.
WHEREAS, Section 143,021(a), Texas Local Government Code provides that a
municipality's governing body shall by ordinance (i) establish the classifications of fire
fighters and (ii)prescribe the number of positions in each classification; and
WHEREAS, on December 13, 2022, the City Council adopted Ordinance 25913-12-
2022, which established the Fire Department's sworn personnel staffing levels effective
November 19,2022, as follows:

TOTAL 1,002; and
WHEREAS, twenty-three of those firefighter positions were intended to only be
temporary additions to authorized strength to accommodate recent academy graduates; and
WHEREAS, in connection with the adoption of the Fiscal Year 2024 annual budget,the
Fort Worth City Council approved increasing the Fire Department's "permanent" authorized
strength by seventy,which included"converting"the twenty-three temporary positions and
adding forty-seven new positions; and

WHEREAS, to reflect the Civil Service staffing included in the Fiscal Year 2024
Budget, the Fire Chief has requested that the City Council increase the total number of
authorized positions in the Fire Department by forty-seven (47), effective October 1, 2023,
consisting of three (3) additional positions in the existing classification of Battalion Chief, two
(2) additional positions in the existing classification of Captain, eleven (1 1) additional positions
in the existing classification of Lieutenant, eleven (11) additional positions in the existing
classification of Engineer, and twenty (20) additional positions in the existing classification of
Firefighter, and thereafter prescribe the number of authorized positions in the Fire Department to
conform with the proposed changes as set forth below in order to effect efficient economy of the
operations of the Fire Department.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF FORT WORTH,TEXAS THAT:
SECTION 1.
Following the formal adoption of this ordinance, the following positions shall be the
only civil service positions in each classification (rank) authorized in the City of Fort Worth
Fire Department effective October 1, 2023 until modified by subsequent ordinance:
Assistant Chiefs 3
Deputy Chiefs 6
Battalion Chiefs 30
Captain 92
Lieutenant 143
Engineer 228
Firefighter 547
TOTAL 1,049
SECTION 2.
The "Mayor and Council Communication" memorandum, which is presented
contemporaneously with this ordinance, is hereby expressly incorporated herein by reference
for further clarification and explanation of the purpose and intent of the City Council in its
adoption of this ordinance as well as the Department in its implementation.
SECTION 3.
This ordinance shall be cumulative of all provisions of previous ordinances and of the
Ordinance No.26455-09-2023 Page 2 of 3
Code of the City of Fort Worth, Texas (2015), as amended, except where the provisions of
this ordinance are in direct conflict with the provisions of prior fire staffing ordinances
for the Fire Department and such Code, in which event conflicting provisions of such
ordinances and such code provisions are hereby repealed and this ordinance shall be
controlling.
SECTION 4.
It is hereby declared to be the intention of the City Council that the sections,paragraphs,
sentences, clauses and phrases of these ordinances are severable, and if any phrase,
clause, sentence, paragraph or section of this ordinance shall be declared unconstitutional by
the valid judgment or decree of any court of competent jurisdiction, such unconstitutionality
shall not affect any of the remaining phrases, clauses, sentences, paragraphs and sections of
this ordinance, since the same would have been enacted by the City Council without the
incorporation in this ordinance of any such unconstitutional phrase, clause, sentence,paragraph
or section.
SECTION 5.
The classifications and numbers prescribed by this ordinance shall take effect and be in full force
and effect as of October 1,2023,and it is so ordained.

SUBJECT
(ALL)Adopt Ordinance Amending Fire Department Staffing Effective October 1,2023,to Reflect Increases in the Number of Authorized Civil
Service Positions in the Specified Classifications and Adopt Ordinance Prescribing Salaries for the Fire Department
RECOMMENDATION:
It is recommended that the City Council:
1. Adopt the attached ordinance to reflect Civil Service staffing in the Fire Department effective October 1,2023;and
2. Adopt the attached ordinance prescribing the salaries for all Civil Service personnel in the Fire Department effective October 1,2023.
DISCUSSION:
The purpose of this Mayor and Council Communication(M&C)and the attached ordinances is to take actions associated with the adopted Fiscal
Year(FY)2024 Budget for the Fire Department.
Adoption of the first ordinance will revise Civil Service staffing in the Fire Department to reflect staffing changes included in the FY2024 budget.
The number of permanent authorized positions will be increased by 70,which includes"converting"23 firefighter positions that had previously been
added on a"temporary"basis to accommodate new recruits and adding forty-seven new positions.
Temporary Overage Background
In connection with the adoption of the Fiscal Year 2023 budget,the City Council adopted a staffing ordinance on September 27,2022(Ordinance
25734-09-2022,M&C 22-0725)to increase Fire's total authorized positions to 980,which included a single position that was only intended to be
temporary to accommodate a recent academy graduate,
Throughout the Fiscal Year,Fire added twenty-two(22)additional temporary positions to accommodate other recent recruit class graduates,
bringing the total authorized positions to 1,002(M&Cs 22-0931 &22-1074;Ordinances 25843-11-2022&25913-12-2022).
FY2024 Staffing Ordinance
The adopted fiscal year 2024 budget approved funding for seventy additional permanent positions in the Fire Department at all ranks from
firefighter through battalion chief. Adoption of the first ordinance reflects those increases,which include"converting"the 23 firefighter overages
into permanent positions and adding 47 new positions,bringing the Department's total authorized strength to 1,049.
The chart below reflects authorized strength levels from the adoption of the FY23 staffing ordinance(Ordinance 259 1 3-1 2-2022)through the
changes included in today's action.

FY2024 Salary Ordinance
A new four-year Collective Bargaining Agreement(CBA),CSC No.52862,between the City of Fort Worth and the Fort Worth Professional
Firefighters Association,IAFF Local 440 was approved on October 25,2022(M&C 22-0878)and expires on September 30,2026. That
agreement included salary schedules,with FY24's schedule attached to the proposed salary ordinance as Addendum A.
Adoption of the second attached ordinance would prescribe the salaries for each classification of personnel in the Fire Department in accordance
with state law and the adopted labor agreement.
A Form 1295 is not required because:This M&C does not request approval of a contract with a business entity.
FISCAL INFORMATION/CERTIFICATION:
The Director of Finance certifies that upon approval of the above recommendations and adoption of the Fiscal Year 2024 Budget by the City
Council,funds will be available in the Fiscal Year 2024 operating budget,as appropriated,in the General Fund. Prior to an expenditure being
incurred,the Fire Department has the responsibility to validate the availability of funds.
