DEVELOPMENT AGREEMENT WITH ROBISON HOME BUILDERS FOFI HIGHCREST
ADDITION INFILL LOTS
TH15 AGREEMENT is between Cliff Robison, awner of Robison Home Builders
�"Develope�") and the City of Fort Wo�th ("City") for the enhancement of new home construciion
within the Highcrest Addition, an Adc{ition to the City of Fort Worth.
That for and in consideration of the mutual covenants, promises and agreements
contained herein, and other good and �aluable consideration the receipt and sufficiency o# which
ara hereby acknowledged, the Ciry of Fort Worth, acting by and through Reid Rector, its duly
authorized Assistant City Manager, and Robison Home Builders, acting herein by and through
Cliff Rabison, its owner ("Developer"), do hereby co�enant and agree as follows;
1. Developer agrees to build homes in the Highcrest Addition, For� Worth, Texas on the
lots shown on �xhibit "A" ("Lots") and all lots acquired by Developer in the Highcrest
Addltian that meet all of the designlde�elopment guideGines contained in Paragraph 3
("Guidelines"}. Developer also agrees that � a maximum of twa (2j
modular/industrialized homes shall be bui{t on the Lots.
2. �ot each home Deueloper builds on a lot contained in Exhibit "A" that complies with
Guidelines, the City agrees to reimburse City of Fort Warkh imposed building permit
fees, and water and sewer tap fees paid by Developer, however in no event shall City
reimburse impact fees. Developer shall receiWe such reimbursement after City
determines that the home complies with the Guidelines and after passing City of Fort
Worth final inspection.
3. DesignlDevelopment Guidelines ("Guidelines"}
A. Guidelines #or non-modular or non-industrialized homes
1. Minimum Sauare Footaae. Home must have 3 bedrooms and 2 baths and a
minimum of 1,200 sq ft. living space. The garage shall not he included in
square foot minim�m requirement;
2. Minimum Width of the Home, The Hame must have a minimum width of 35
feet. May be wai�ed by the Housing Dtrector depending on design.
3. Garaae. Home shall ha�e a minimum of 1 car garage {min 1 B' wide) or 2 car
garage {min 2Q' wide). ihe garage shall be detached and if attached sha{I
be 15' behind the front of the house;
4. Garaae poors. Garage doors must be sectional raised panel wood or
aluminum. Glass inser#s in top panels of garage doors is aptional;
5. Foundation and Framina. House and garage must be site built an a concrete
slab foundation with wood or steel framing;
6. Roof. House and garage shall ha�e a minimum 6/12 roof pitch and the
roofing material shall be made up of composition roof materials or higher
quality;
7. Exterior Facade. Fifty percent of ti�e front elevation shali be brick and half
brick calumns on the porch, howe�er this requirement can be waived by the
Housing Director de�ending on design;
8. Sidin . li siding is used on the hame, all siding shall be hardiplank/Cem
plank sic�ing products or praduct o� similar or better quality on the exierior
surfaces;
9. Sidewalk. Lot shail have a four-foot wide city standard sidewalk across the
front of property. The sidewalk shall be canstructed to provide a four faot
green space between the aurbfstreet and the sidewalk;
10. Dri�eway. House shall ha�e a concrete driveways -- single or double width --
Solid or Hollywood (split drive) style with ground caver or grass, with 2'- B"

radius approach or use existir�g driveway appraach. �riveway cannat be
more than 1 car width �rom front af house fa�ade to curb/street;
11. Porch. Hame shall have a roof covered front porch and must contain a
minimum of 80 sq ft. with wood rail pickets of 2"x 2" with a 2"x 6" capped
hand rail. Floor. Height of home floor abo�e grade maximum 1'-6";
12. Shutters. All front facing windows on hause and garage shall have window
length shutters;
13. WEndows. Windovus shall have a 2"x 4" minimum wood or comparable
cement product trim; and
14. Vent. Home shall have a square ar circular vent at gable face with 514 trim
detail.
B. DesigN De�elapment Guidelines for Modular/lntfustrfalized Homes
The de�ign guidelines for the modular/industrializad houses shall include al1 0#
the guidelines in Paragraph 3A, except the foAowit�g modification to 3A(5):
Foundatian. The Modular/lndustrialized Houses shal! be on engineered
concrete piers raised from adjacent grade 1'-8" with concrete andlor
brick ski�ting aro�nd entire foundation. No cement bfocks ar cement
bricks allowed;
4. De�eloper agrees that Homes and Lots will not be sold under any type of eontract for
deed agreement.
5, pe�efoper understands and agrees that if Developer builds more than 2
modularlindustrialized homes on the Lots or on any other Iot owned by Developer in the
Highcrest Addition, this Agreement shall immediately termf�ate and City shall not
reimburse any building permit fees or water and sewer tap fees.
6. Developer agrees to onfy use the design plans in Exhibit "B" ior the homes to be built on
the lots on �xhibit "A", howe�er in the event that Developer desires to use another
design plan that is not included in this Agreement and desires reimbursement of
development fees as pro�vided in Paragraph 2, additional plans may be included in this
Agreement once the design plans are re�iewed by the Housing Director. Developer
unclerstands and acknawledges that the Housing Directar's review of the design plans is
anly to ensure that the minimum square foot requirement and specific room requirements
are included in the design and for no other reason. Developer acknowledges and agrees
that the City does not warrant the design or make any representations regarding the
saieabrlity of the design.
7. Qevelo'par understands and acknowledges that by buiEding the homes accvrding to the
Guidelines, ti�at the City is oniy agreeing to reimburse City af Fart Warth Building permit
fees and water and sewer tap fees and is in no way guaranteeing a specific profit o� tF�e
homes to be built. Developer understands and acknawledges that the costs of adhe�ing
to the Guidelines may exceed fees that are reimburseci by City. Developer also
understands and acknawledges that Developer may nok be able to recoup the actual
costs of complying with the Guidelines when selling the home and Developer hereby
assumes the risk af not being able to recaup afl af the costs af complying with the
Guideli�es when selling the homes. Developer acaepts sole responsibility of canstructing
the homss according ta the Guidelines in order io receive reimbursement oi developmen#
fees from City.
8. Except as provided in Paragraph 5, this Agreemen# shall be in effect from ihe date the
last party executes this Agreement and shall continue for thirty-six (36} mont�s, hawe�er,
this Agreement can be extended with the written agresment by the parkies.
9. So lang as this agreement has not been termEnated under Paragrap#� 5, either party may
terminate this agreement with 3D days written notice to the other party, however if
DeveEo�er is constructing a home or homes when notice to terminate is given to either
party anci so long as Developer has not built more than 2 modularlindusirialized homes
on the Lots, City shall reimburse building permit fiees and water and sewer tap fees far
the horne(s) that is (are) being constructed when notice to terminate is gi�en if such
home complies with the GuEdelines and passes City of Fort Worth final inspection.
