INFORMAL DEVELOPER AGREEMENT
TO BE EXECUTED BY
DEVELOPERS WISHING TO LET THEIR OWN CONTRACTS
FOR CONSTRUCTION OF PAVING AND STORM DRAIN IMPROVEMENTS

The undersigned DEVELOPER has familiarized himself with the City of Fort Worth's"Policy for
the |nnto||aUnn of Community Foci|itiea"governing street paving, storm drain, ntneAt|ightsi and
street name signs facility installations and fully understands all the provioionn, terms and
conditions of that po|icy, and vviohae to exercise the option contained in that policy permitting o
DEVELOPER to let his own contracts for construction of such street paving, storm drain, street
lights, and street name signs.
In addition to all other requirements of the City's Policy for the Installation of Community Facilities,
the DEVELOPER specifically agrees to follow the procedures set forth below:
1. To employ a construction contractor who is approved by the Director Transportation and
Public Works Department and who is licensed and bonded to do work in public streets.
2. To require the Contractor tnfurnish the City of Fort Worth dual obligee performance and
payment bonds in the name of the DEVELOPER and the City, and, if required, a maintenance
bond in the name of the City on forms provided by the City, for 10096 of the contract price of the
facility, said pedormonoe, payment, and maintenance bonds to be furnished to the City before
work incommenced.
3. DEVELOPER shall pay to the City in cash for the construction inspection a fee equal to two
percent(2%)of the DEVELOPER's share of the construction cost of related street, storm drain,
streetlight and/or street sign facilities as stated in the construction contract.
4. To require the Contractor to give 48 hours notice to Director of the Department of
Engineering prior to commencing construction of the facility or facilities so that inspection
personnel will be available.
5. To make this agreement, as well as the Standard Specifications for Street and Storm Drain
Construction an integral part of any contract with a contractor to construct any or all of the
facilities involved.
G. To require the Contractor to allow the construction to be subject to inspection ot any and all
times by City inspection forces.
7. To require the Contractor to have such laboratory tests made as the City may require.
8. To secure approval by the Director of the Engineering Department of any and all partial and
final payments to the Contractor, such approval to pertain only to satisfactory completion of the
work for which payment is made and not to constitute approval of the quantities on which
payment isbased.
9. To furnish simultaneously with the execution of the construction contract let by the
DEVELOPER developer's bond in the name of the City ofone hundred percent (10096)of the
estimated contract cost of the related community facilities, as stated in the construction contract,

10. to guarantee timely payments to the Contractor for completed work and/or to guarantee
satisfactory performance of this agreement and substantial completion of the community facilities
to be installed. In lieu of the developer's bond, the Developer may deposit cash one hundred
twenty-five percent(125%)of the estimated DEVELOPER's share of the cost of the community
facilities.
11. DEVELOPER agrees to complete all the improvements covered by this agreement within 90
calendar days after having been instructed to do so, in writing, by the Director of Transportation
and Public works. It is understood that the DEVELOPER will initiate the construction of all
improvements to conform to his own schedule, except for those improvements which the
Transportation and Public Works Director deems necessary for the proper and orderly
development of the area. In the event DEVELOPER fails to carry out any such instructions within
the 90-day period, the DEVELOPER gives the City the right to design and award a contract, and
inspect the improvements in question, and agrees to pay to the City prior to the award of the
contract, the amount of the low bid.
12. The DEVELOPER further covenants and agrees to, and by these presents does hereby,fully
indemnify, hold harmless and defend the City, its officers, agents and employees from all suits,
actions or claims of any character,whether real or asserted, brought for or on account of any
injuries or damages sustained by any persons (including death)or to any property, resulting from
or in connection with the construction, design, performance or completion of any work to be
performed by said DEVELOPER, his contractors, subcontractors, officers, agents or employees,
or in consequence of any failure to properly safeguard the work, or on account of any act,
intentional or otherwise, neglect or misconduct of said DEVELOPER, his contractors, sub-
contractors, officers, agents or employees,whether or not such injuries, death or dama_pes
are caused,in whole or in part, by the alleged nepli_gence of the City of Fort Worth, its
officers, servants, or employees
13. It is expressly understood and agreed by the parties hereto that execution of this agreement
does not bind the City of Fort Worth to participate in or contribute to the cost of any of the
improvements described herein; nor shall the City of Fort Worth be responsible or liable for any
portion of the costs incurred by the DEVELOPER, its officers, agents, employees, contractors or
sub-contractors for the design and construction of the improvements described herein, unless
and until the parties hereto execute a Formal Community Facilities Agreement, duly authorized by
the City Council at a regular meeting, signed by the City Manager, and providing for the City's
participation in the costs of said improvements.

2 . STREET LIGHTS WORK DESCRIPTION:
1 . The Developer shall provide for the installation of streetlights at
the approximate locations shown in Exhibit "C" , immediately after
final acceptance of the street construction, in accordance with
engineering plans and specifications approved by the Transportation
and Public Works Department.
2 . Streetlights on residential and /or collector streets can be
installed using overhead or underground conductors with the approval
of the Director of Transportation and Public Works.
3 . The Developer's shall pay the amount shown below to the City of Fort
Worth at the time after execution of the Communities Facilities
Agreement.
4 . Streetlights on arterial streets shall be installed with underground
conduit and conductors .
S . The Developer agrees to dedicate all easements required for the
installation and maintenance of the street lights and to provide for
the installation of any electrical transformers required for the
proper operation of the street lights
6. A 3-inch schedule 80 PVC conduit is required when crossing streets
at a depth not less than 30 inches, unless indicated otherwise on
the plans concrete pull boxes shall be provided at the crossing
points .
7 . The developer or their contractor shall contact City' s street light
division 48 hours prior to starting any installation of conduit
.and/or streetlights at (817) 871-8100 to insure proper inspection of
work.

STREET NAME SIGNS
1 . The Developer will install the *street name signs upon final
approval of the street construction. The street name signs will
remain the property of, and will be maintained by, the City.
2 . The Developer will pay for the street name sign installations
required for this development to the extent of $100 .00 per
intersection. This unit cost will be revised annually by the
Department of Transportation and Public Works to reflect
prevailing costs of materials and labor.
3 . This -development creates the following two (2) intersections at a
cost to the Developer of $200.00 :
