HomeMy WebLinkAboutResolution 5823-10-2023 A Resolution NO. 5823-10-2023 A RESOLUTION AUTHORIZING AN ADVANCED FUNDING AGREEMENT WITH THE TEXAS DEPARTMENT OF TRANSPORTATION IN THE AMOUNT OF $842,143.00, OF WHICH FEDERAL PARTICIPATION IS $462,297.00, STATE PARTICIPATION IS $36,018.00 AND CITY OF FORT WORTH PARTICIPATION IS $343,828.00 PLUS ANY COST OVERRUNS FOR CONSTRUCTION OF INTERSECTION IMPROVEMENTS AT NORTH BEACH STREET AND WESTERN CENTER BOULEVARD. WHEREAS, federal law establishes federally funded programs for transportation improvements to implement its public purpose; and WHEREAS, the Texas Transportation Code, Section 201.103 establishes that the State shall design, construct and operate a system of highways and roads in cooperation with local governments, and Section 222.052 authorizes the Texas Department of Transportation Commission to accept contributions from political subdivisions for development and construction of public roads within political subdivisions; and WHEREAS, a Master Agreement between the City of Fort Worth ("Local Government") and the State of Texas acting through the Texas Department of Transportation ("State") has been adopted and states the general terms and conditions for transportation projects developed through this Advance Funding Agreement (AFA); and WHEREAS, federal and State laws require local governments to meet certain contract standards relating to the management and administration of State and federal funds, and WHEREAS, the Texas Transportation Commission has codified 43 TAC, Rules 15.50-15.56 that describe federal, State, and local responsibilities for cost participation in highway improvement and other transportation projects, and WHEREAS, the Texas Transportation Commission passed Minute Order Number 116073 and 116292 authorizing the State to undertake and complete a highway improvement or other transportation project generally described as intersection improvements at the intersection of Beach Street and Western Center Boulevard in Fort Worth, Texas NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, THAT: The City Manager or his designee is authorized to execute an Advance Funding Agreement with the Texas Department of Transportation in the total estimated amount of $842,143.00 with federal participation in the amount of $462,297.00, state participation in the amount of $36,018.00 and city participation in the estimated amount of $343,828.00 plus any cost overruns for construction of intersection improvements at North Beach Street and Western Center Boulevard. Adopt the attached resolution authorizing execution of an Advance Funding Agreement with Texas Department of Transportation(CSJ# 0902-90-214)in the amount of$842,143.00,with Federal participation in the amount of$462,297.00,State participation in the amount of $36,018.00,and Local participation in the amount of$343,828.00 plus any cost overruns for the Intersection Improvements at North Beach Street and Western Center Boulevard project(City Project No. 104038); 2. Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the Grants Cap Projects Federal Fund, subject to receipt of the grant, in the amount of$513,663.00,of which$462,297.00 is Federal funding and$51,366.00 is City funding, transferred from the 2022 Bond Program,for the purpose of funding the North Beach Street and Western Center Boulevard project(City Project No. 104038); 3. Adopt the attached appropriation ordinance adjusting appropriations in the 2022 Bond Program Fund by increasing estimated appropriations in the North Beach Street and Western Center Boulevard project(City Project No. 104038)in the amount of$412,000.00 and decreasing appropriations in the Traffic Signals programmable project(City Project No. PB0006)by the same amount;and 4. Amend the Fiscal Years 2024-2028 Capital Improvement Program. DISCUSSION: The purpose of this Mayor and Council Communication(M&C)is to adopt a resolution authorizing execution of the Advanced Funding Agreement (AFA)with Texas Department of Transportation (TxDOT)in the amount of$842,143.00 with City participation in the amount of$343,828.00 for the Intersection Improvements at North Beach Street and Western Center Blvd.project(City Project No. 104038). The Texas Transportation Commission passed Minute Order Number 116073,and 116292 authorizing the State to undertake and complete a highway improvement or other transportation project generally described as intersection improvements at the intersection of Beach Street and Western Center Boulevard in Fort Worth,Texas. The Intersection Improvements at North Beach Street and Western Center Blvd.project intends to create a cost-effective solution to improve efficiency while increasing visibility,safety,and traffic flow.The project scope includes the rebuilding of the eastbound and west bound traffic signals,adding a separate right turn lane for westbound traffic,and pedestrian improvements to comply with Americans with Disabilities Act (ADA)regulations.The construction of the project will be the responsibility of TxDOT. This project will be let by TxDOT in June 2024.The State is responsible for all construction activities within the scope of this project.The State will be responsible for securing the Federal and State share of the funding required for the development and construction of the project. Funding appropriated by this M&C will be used for design,right-of-way, utilities and project management costs for this project.The AFA will require Fort Worth to fund cost overruns.At the end of the project,the asset will remain with the City of Fort Worth. This project is included in the 2022 Bond Program. The City's Extendable Commercial Paper(ECP) (M&C 22-0607; Ordinance 25675-08-2022) provides liquidity to support the appropriation. Available resources will be used to actually make any interim progress payments until debt is issued. Once debt associated with a project is sold,debt proceeds will reimburse the interim financing source in accordance with the statement expressing official Intent to Reimburse that was adopted as part of the ordinance canvassing the bond election (Ordinance 25515-05-2022). Funding for the grant portion of the project was not included in the Fiscal Years 2024-2028 Capital Improvement Program because grant funding is appropriated at the time of the grant award. The action in the M&C will amend the Fiscal Years 2024-2028 Capital Improvement Program as approved in connection with Ordinance 26453-09-2023. Approval of a recommendation 3 would adjust appropriations between a programmable project and convert the North Beach Street and Western Center Boulevard,project(City Project No. 104038)into a static capital project.This action is needed as future funding for North Beach Street and Western Center Boulevard project(City Project No. 104038)is anticipated from other sources and the scope of this project differs from that of current programmable project. The above-mentioned project is located in COUNCIL DISTRICT 4. A Form 1295 is not required because:This contract will be with a governmental entity,state agency or public institution of higher education:Texas Department of Transportation FISCAL INFORMATION/CERTIFICATION: The Director of Finance certifies that upon approval of the above recommendations and adoption of the attached appropriation ordinances,funds will be available in the current capital budget,as appropriated, in the Grants Cap Projects Federal Fund and 2022 Bond Program Fund. Prior to expenditures being incurred,the Transportation&Public Works Department has the responsibility to validate the availability of funds.This is an advance grant.
