A RESOLUTION AUTHORIZING THE EXECUTION OF AN ADVANCE FUNDING
AGREEMENT WITH THE TEXAS DEPARTMENT OF TRANSPORTATION IN THE
AMOUNT OF $796,658.00, WITH FEDERAL PARTICIPATION IN THE AMOUNT OF
$540,346.00, STATE PARTICIPATION IN THE AMOUNT OF $33,623.00 AND LOCAL
PARTICIPATION IN THE APPROXIMATE AMOUNT OF $222,689.00, FOR
ENGINEERING, ENVIRONMENTAL SERVICES AND CONSTRUCTION OF SOUTH
HULEN STREET AT SOUTH DRIVE HIGHWAY SAFETY IMPROVEMENT
PROJECT
WHEREAS, federal law establishes federally funded programs for transportation improvements
to implement its public purposes, and
WHEREAS, the Texas Transportation Code, Section 201.103 establishes that the State shall
design, construct and operate a system of highways in cooperation with local governments, and Section
222.052 authorizes the Texas Transportation Commission to accept contributions from political
subdivisions for development and construction of public roads and the state highway system within the
political subdivision, and
WHEREAS, federal and state laws require local governments to meet certain contract standards
relating to the management and administration of State and federal funds, and
WHEREAS,the Texas Transportation Commission has codified 43 TAC,Rules 15.50-15.56 that
describe federal, state, and local responsibilities for cost participation in highway improvement and other
transportation projects, and
WHEREAS, the Texas Transportation Commission passed Minute Order Numbers 116292 and
116073 authorizing the State to undertake and complete a highway improvement or other transportation
project generally described as rehabilitate traffic signals and improve traffic signals,install flashing yellow
arrow; and
WHEREAS, the City of Fort Worth identified the need to improve traffic signals and install
flashing yellow arrow at the South Hulen Street and South Drive intersection; and
WHEREAS,the City of Fort Worth and Texas Department of Transportation have negotiated
terms of an Advance Funding Agreement in the amount of$796,658.00,with federal participation in the
amount of$540,346.00, state participation in the amount of$33,623.00 and local participation in the
approximate amount of$222,689.00, for engineering, environmental services and construction of South
Hulen Street at South Drive highway safety project improvements.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF FORT WORTH, TEXAS, THAT:
The City Manager or their designee is hereby authorized to execute an Advance
Funding Agreement with the Texas Department of Transportation (CSJ: 0902-90-207) in the
amount of $796,658.00, with federal participation in the amount of $540,346.00, state
participation in the amount of$33,623.00 and local participation in the approximate amount
of $222,689.00, for engineering, environmental services and construction of South Hulen
Street at South Drive highway safety project improvements. All cost overruns will be the
responsibility of the City of Fort Worth.

Amend the Fiscal Years 2024-2028 Capital Improvement Program(2022 Bond Program)
RECOMMENDATION:
It is recommended that the City Council:
1. Adopt the attached Resolution authorizing execution of an Advance Funding Agreement with the Texas Department of Transportation(CSJ
#0902-90-207)in the amount of$796,658.00 with Federal participation in the amount of$540,346.00,State participation in the amount of
$33,623.00 and local participation in the amount of$222,689.00 for the South Hulen Street at South Drive Highway Safety Improvements
project(City Project No. 104095);
2. Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the Grants Cap Projects Federal Fund,
subject to receipt of the Grant,in the amount of$540,346.00 for the South Hulen Street at South Drive Highway Safety Improvements project
(City Project No. 104095);
3. Adopt the attached appropriation ordinance adjusting appropriations in the 2022 Bond Program Fund in the amount of$370,000.00, by
increasing appropriations in the,South Hulen Street at South Drive Highway Safety Improvements project(City Project No. 104095),and
decreasing appropriations in the Traffic Signals programmable project(City Project No. PB0006)by the same amount;and
4. Amend the Fiscal Years 2024-2028 Capital Improvement Program.
DISCUSSION:
The purpose of this Mayor and Council Communication(M&C)is to adopt a resolution authorizing execution of an Advance Funding Agreement
(AFA)with the Texas Department of Transportation(TxDOT)in the amount of$796,658.00,of which$222,689.00 is City of Fort Worth's(City)
participation,for construction of the South Hulen Street at South Drive Highway Safety Improvement project(City Project No. 104095).
The scope of this project includes engineering,environmental,and construction to improve traffic signals and install flashing yellow arrow at the
intersection of South Hulen Street at South Drive.
This project will be let by TxDOT in August 2024.The State is responsible for all construction activities within the scope of this project.The State
will be responsible for securing the Federal and State share of the funding required for the development and construction of the project.Funding
appropriated by this M&C will be used for design,right-of-way,utilities and project management costs for this project.The AFA will require Fort
Worth to fund cost overruns.At the end of the project,the asset will remain with the City of Fort Worth.

Funding is budgeted in the 2022 Bond Program Fund for the purpose of funding the S Hulen St and S Drive W Inter Im project.
This project is included in the 2022 Bond Program.The City's Extendable Commercial Paper(ECP)(M&C 22-0607;Ordinance 25675-08-2022)
provides liquidity to support the appropriation.Available resources will be used to actually make any interim progress payments until debt is
issued.Once debt associated with a project is sold,debt proceeds will reimburse the interim financing source in accordance with the statement
expressing official Intent to Reimburse that was adopted as part of the ordinance canvassing the bond election(Ordinance 25515-05-2022).
Funding for this project was not included in the Fiscal Years 2024-2028 Capital Improvement Program(CIP)because the project and funding
sources were unknown at the time of its development.This action in this M&C will amend the Fiscal Years 2024-2028 Capital Improvement
Program as approved in connection with Ordinance 26453-09-2023.
Approval of recommendation 3 would adjust appropriations between a programmable project and convert the South Hulen Streat at South Drive
Highway Safety Improvement project(City Project No. 104095)into a static capital project.This action is needed as future funding for South Hulen
Street at South Drive Highway Safety Improvement project is anticipated from other sources and the scope of this project differs from that of
current programmable project.
This project is located in COUNCIL DISTRICT 6.
A Form 1295 is not required because:This contract will be with a governmental entity,state agency or public institution of higher education:Texas
Department of Transportation
FISCAL INFORMATION/CERTIFICATION:
The Director of Finance certifies that upon approval of the above recommendations and adoption of the attached appropriation ordinances,funds
will be available in the current capital budget,as appropriated,in the Grants Cap Projects Federal Fund and 2022 Bond Program Fund. Prior to
expenditures being incurred,the Transportation&Public Works Department has the responsibility to validate the availability of funds.This is an
advance grant.
