HomeMy WebLinkAboutOrdinance 26532-10-2023 ORDINANCE 26532-10-2023 AN ORDINANCE ADJUSTING APPROPRIATIONS IN THE 2022 BOND PROGRAM FUND IN THE AMOUNT OF $ 385,500.00, BY INCREASING APPROPRIATIONS IN THE COOKS LANE AND BRENTWOOD STAIR ROAD HIGHWAY SAFETY IMPROVEMENTS PROJECT(CITY PROJECT NO. 104035), AND DECREASING APPROPRIATIONS IN THE TRAFFIC SIGNALS PROGRAMMABLE PROJECT (CITY PROJECT NO PB0006.) BY THE SAME AMOUNT; PROVIDING FOR A SEVERABILITY CLAUSE; MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That in addition to those amounts allocated to the various City departments for Fiscal Year 2023-2024 in the Budget of the City Manager,there shall also be adjusted appropriations in the 2022 Bond Program Fund in the amount of to $385,500.00, by increasing appropriations in the Cooks Lane and Brentwood Stair Road Highway Safety Improvements Project(City Project No.104035),and decreasing appropriations in the Traffic Signals programmable project(City Project No.P130006)by the same amount. SECTION 2. That should any portion,section or part of a section of this ordinance be declared invalid,inoperative or void for any reason by a court of competent jurisdiction,such decision,opinion or judgment shall in no way impair the remaining portions,sections,or parts of sections of this ordinance,which said remaining provisions shall be and remain in full force and effect. SECTION 3. j That this ordinance shall be incorporated into the ordinance effecting the budget of the municipal government j of the City of Fort Worth for the ensuing Fiscal Year beginning October 1,2023,and ending September 30, 2024, and all other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed. Adopt the attached resolution authorizing execution of an Advance Funding Agreement with the Texas Department of Transportation(CSJ# 0902-90-209) in the amount of$675,694.00 with Federal participation in the amount of$466,750.00,State participation in the amount of $28,507.00 and local participation in the approximate amount of$180,437.00 for the Cooks Lane and Brentwood Stair Road Highway Safety Improvements project(City Project No. 104035); 2. Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the Grants Cap Projects Federal Fund, subject to receipt of the Grant, in the amount of$466,750.00 for the Cooks Lane and Brentwood Stair Road Highway Safety Improvements project(City Project No. 104035); 3. Adopt the attached appropriation ordinance adjusting appropriations in the 2022 Bond Program Fund by increasing estimated appropriations in the Cooks Lane and Brentwood Stair Road Highway Safety Improvements project(City Project No. 104035)in the amount of$385,500.00 and decreasing appropriations in the Traffic Signals programmable project(City Project No. PB0006)by the same amount; and 4. Amend the Fiscal Years 2024-2028 Capital Improvement Program. DISCUSSION: The purpose of this Mayor and Council Communication(M&C)is to adopt a resolution authorizing execution of an Advance Funding Agreement (AFA)with the Texas Department of Transportation(TxDOT)in the amount of$675,694.00,of which$180,437.00 is City of Fort Worth's(City) participation and authorize acceptance of Federal Grant funds and State funds in the amount of$466,750.00 for construction of the Cooks Lane and Brentwood Stair Road Highway Safety Improvement project. (City Project No. 104035). The scope of this project includes installation of traffic signal and safety lighting at the intersection of Cooks Lane and Brentwood Stair Road. This project will be let by TXDOT in August 2024.The State is responsible for all construction activities within the scope of this project.The State will be responsible for securing the federal and State share of the funding required for the development and construction of the project.City funds have been appropriated to this project for design, right-of-way, utilities and project management costs.The AFA will require Fort Worth to fund cost overruns.At the end of the project,the asset will remain with the City of Fort Worth. This project is included in the 2022 Bond Program. The City's Extendable Commercial Paper(ECP)(M&C 22-0607;Ordinance 25675-08-2022) provides liquidity to support the appropriation. Available resources will be used to actually make any interim progress payments until debt is issued. Once debt associated with a project is sold,debt proceeds will reimburse the interim financing source in accordance with the statement expressing official Intent to Reimburse that was adopted as part of the ordinance canvassing the bond election(Ordinance 25515-05-2022). Funding for this project was not included in the Fiscal Years 2024-2028 Capital Improvement Program(CIP)because the project and funding sources were unknown at the time of its development.This action in this M&C will amend the Fiscal Years 2024-2028 Capital Improvement Program as approved in connection with Ordinance 26453-09-2023. Approval of recommendation 3 would adjust appropriations between a programmable project and convert the Cooks Lane and Brentwood Stair Road Highway Safety Improvements project(City Project No. 104035)into a static capital project.This action is needed as future funding for Cooks Lane and Brentwood Stair Road Highway Safety Improvements project(City Project No. 104035)is anticipated from other sources and the scope of this project differs from that of current programmable project. This project is located in COUNCIL DISTRICT 5. A Form 1295 is not required because:This contract will be with a governmental entity,state agency or public institution of higher education:Texas Department of Transportation FISCAL INFORMATION/CERTIFICATION: The Director of Finance certifies that upon approval of the above recommendations and adoption of the attached appropriation ordinances,funds will be available in the current capital budget, as appropriated, in the Grants Cap Projects Federal Fund and 2022 Bond Program Fund. Prior to expenditures being incurred,the Transportation&Public Works Department has the responsibility to validate the availability of funds.This is an advance grant.
