COUNTY OF TARRANT
WHEREAS, the City Of Fort Worth (City) and Lockwood, Andrews &
Newman, Inc. , (Engineer) made and entered into City Secretary
Contract No. 28790, (the Contract) which was authorized by the City
Council by M&C C-19585 on the 13th day of May, 2003 and;
subsequently revised by three Previous amendments; and
WHEREAS, the Contract involves engineering services for the
following project:
Sanitary Sewer Rehabilitation Contract 1XVII (67)
WHEREAS, it has become necessary to execute Amendment No. 4 to
said Contract to include an increased scope of work and revised
maximum fee;
NOW THEREFORE, City and Engineer, acting herein by and through'
their duly authorized representatives, enter into the following
agreement which amends the Contract:
1.
Article I, of the Contract is amended to include the addition-
al engineering services specified in M&C C-20452, adopted by the
City Council on the 21st day of December, 20041 and further
amplified in a proposal letter dated October 11, 2004, copies of
which are both attached hereto and incorporated herein. The cost to
City for the additional services to be Performed by Engineer total
$80,710.00.
2.
Article II, of the Contract is amended to provide for an
increase in the maximum fee to be paid to Engineer for all work and
services performed under the Contract, as amended, so that the
total fee paid by the City for all work and services shall not
exceed the sum of $399,076.00.

All other provisions of the Contract which are not expressly
amended herein shall remain in full force and effect.

RECOM MENDATION:
It is recommended that the City Council authorize the City Manager to:
1. Authorize Execution of Amendment No. 4 to Engineering Agreement with Lockwood, Andrews & Nenam,
Inc. for Sanitary Sewer Rehabilitation Contract LXVII (67);
2. Authorize the transfer of$80,710.00 from the Water& Sewer Operating Fund to the Sewer Capital Project
Fund; and
3. Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the Sewer
Capital Project Fund in the amount of$80,710.00 from the available funds.
DISCUSSION:
On May 13, 2003 (M&C C-19575), the City Council authorized the City Manager to execute an engineering
agreement with Lockwood, Andrews & Newnam, Inc. in the amount of$260,706.00 for the design of sanitary
sewer rehabilitation contract LXVII (67). The contract was subsequently revised by three previous
amendments totaling $61,350.00 that are further described as follows:
• Amendment No. 1 in the amount of$22,350.00 provided survey and engineering design services for
the replacement of additional sanitary sewer mains as requested by the Water Department;
• Amendment No. 2 in the amount of$20,410.00 provided for the rerouting of sewer main M-132
currently located on private property into public right-of-way, and
• Amendment No. 3 in the amount of$14,900.00 allowed for the preparation of an alignment study that
provided several alternate routes for a sewer main to covey wastewater from the redevelopment of the
Montgomery Ward property and the surrounding area.

o The preparation of additional temporary and permanent construction easements.
Lockwood, Andrews & Newnam, Inc. proposes to perform these additional services for a lump sum fee of
$80,710.00. City staff considers this fee to be fair and reasonable for the scope of services proposed.
Lockwood, Andrews & Newnam, Inc. is in compliance with the City's M/WBE Ordinance by committing to
an additional 15% M/WBE participation on this Amendment No. 4.
This project is located in COUNCIL DISTRICT 9, Mapsco 62X and 62Y.
FISCAL INFORMATIONI—CERTIFICATION:
The Finance Director certifies that upon approval and completion of recommendation 1, and the adoption of
the attached appropriation ordinance, funds will be available in the current capital budget, as appropriated, of
the Sewer Capital Projects Fund.

Survey and Engineering Design Services for White Settlement Sewer Main

Dear Mr. Conlon:
As discussed, we have revised this Amendment No. 4 for the above referenced project. The
amendment corresponds to the performance of survey and engineering design services for the
redesign of the White Settlement Road sewer main that is to be constructed to serve the north
portion of the Montgomery Ward property and areas to the west including the Linwood
Addition. Based upon the results of the alternative alignment study as prepared under the
requirements of Amendment No. 3 to our contract, the preferred design (Alternate C) will direct
sewage flow from the area, to the north on Foch Street and connect with the M-248 trunk sewer
main located on the south bank of the West Fork of the Trinity River. This new alignment will
require permitting through the Tarrant Regional Water District for approval to cross under the
river levee and construction of a junction box for connection to the M-248 trunk sewer main. The
alternative alignment for the sewer main is needed in order to avoid conflict with the Trinity
River Vision (TRV) project that will be located in the area to the cast of the Fort Worth and
Western Railroad right-of-way.
The selected alternative will require the survey and engineering design of approximately 5,200
linear feet of sewer main ranging is size from 8 to 24-inches in diameter. This is in addition to
the survey and design work previously completed under the original contract scope. A revised
preliminary opinion of construction costs for the new sewer main portions to be designed is
$921,696.
Based upon the work to be performed as described above, a lump sum fee addition of$80,710 is
hereby requested. This fee has been adjusted in recognition of the previously performed data
collection and design document preparation that can be used in support of the additional sewer
line design. A summary of the contract values affected by the amendments Including
