AN ORDINANCE REPEALING ORDINANCE 15295 AND ADOPTION OF
ORDINANCE VACATING AND EXTINGUISHING EXCESS RIGHT-OF-
WAY IN THE WILLIAM HUBBELL SURVEY, ABSTRACT NUMBER 151,
AND BEING A PORTION OF NEST FIFTH STREET AND FOREST
PARK BOULEVARII RIGHT-OF-WAY BEGINNING AT THE
SOUTHEAST CORNER. OF LOT 1, BLOCK 1, CALVARY ADDITION
CONTAINING 19,759 SQUARE FEET OR 4.454 ACRES OF LAND AND
VACATING AND EXTINGUISHING A PORTION OF PENN STREET
RIGHT-®F-WAY LOCATED IN THE A. ROBINSON SURVEY,
ABSTRACT NUMBER 1259, BEGINNING AT THE SOUTHWEST
CORNER OF LOT 16, OARLOCK'S ADDITION, CONTAINING 84,804
SQUARE FEET OR ].946 ACRES OF LAND, CITY OF FORT WORTH,
T T COUNTY, TEXAS; PROVIDING THAT THIS ORDINANCE
SHALL BE CUMULATIVE; PROVIDING A SEVERASILITY CLAUSE;
PROVIDING A SAVINGS CLAUSE; AND PROVIDING AN EFFECTIVE
DATE.
NOW, THEREFORE, BE IT ORDAINED BY TIiIE CITY COUNCIL OF TIE
CITY OF FORT` WORTII, TEXAS:
SECTION 1.
That a portion of the right-of way located in the William: Bussell Survey, Abstract
Number 1 S 1, and being a portion of West Fifth Street and Forest Park Boulevard right-of-way
(variable width right-cf way) beginning at the southeast corner of Lat 1, Block 1, Calvary
Addition according to the plat recorded in Volume 388-168, Page 7, Plat Records, Tarrant
County Texas and containing 19.789 square feet or 0.454 acres of land, City of Fort Worth,
Tarrant County Texas, as more specifically described in Exhibit A attached hereto and
incorporated herein by reference, be and the same is vacated and extinguished and

Robinson Survey, Abstract Number 1289, beginning at the southwest corner of Lot 16, Oarlock's
Addition, an addition to the City of Fort Warth, accanding to he plat recorded in Volume 106,
Page 55, Plat Records, Tarrant County Texas, containing 84,804 square feet or 1.946 acres of
land, City of Fort Worth, Tarrant County Texas; as more specifically described in Exhibit B
attached hereto and incorporated herein by reference, be and the same is vacated and
extinguished.
SECTION 2.
That the fee to the land in the above described vacated street rights-of way are hereby
released and sha11 revert to the adjacent owner as provided by law.
SECTI®N 3.
That all existing utility easements shall be retained by the City until such time all utilities
located in that easement are relocated at the owner's expense.
SECTI®N 4.
That all ordinances or parts of ordinances in conflict herewith are hereby repealed.
SECTI®N 5.
That this ordinance shall take effect upon adoption.

PROPERTY DESCRIPTION
BEING a tract of land situated in the A. Robinson Survey, Abstract Na. 1289, City of Fort
Worth, Tarrant County, Texas and being a portion of Penn Street right-of-way (variable width
right-af-way) and said tract being more particularly described by metes and bounds as
follows:
COMMENCING at the southwest corner of Lot 16, Carlock's Addition, an addition to the City of
Fort Worth according to the plat recorded in Volume 106, Page 55, Plat Records, Tarrant
County, Texas and being in the east right-of-way of said Fenn Street;
North 00"28'26" West, with the west line of said Lot 16, Carlock's Addition and with said east
right-of-way line of Penn Street, a distance of 10.53 feet to the POINT of BEGINNING of
herein described tract;
THENCE North 89"56'41" West, a distance of 177.19 feet to a point in the west right-of-way
line of said Penn Street and being the beginning of a non-tangent curve to the left having a

Robinson Survey, Abstract Number 1289, City of Fort Worth, Tarrant County, Texas
RECOMMENDATION.
It is recommended that the City Council repeal Ordinance No. 18298 and adopt the attached ordinance
vacating and extinguishing excess right-of-way in the William Russell Survey, Abstract Number 151 and
being a portion of West Fifth Street and Forest Park Boulevard beginning at the southeast corner of Lot 1,
Black 1, Calvary Addition containing 19,789 square feet or 0.454 acres of land and a portion of Penn Street
right-of-way located in the A. Robinson Survey, Abstract Number 1289, beginning at the svuthwes# corner
of t_ot 16, Oarlock's Addition, containing 84,804 square feet or 1.946 acres of land, City of Fort Worth,
Tarrant County, Texas.
DISCUSSION:
Pier 1 Import, inc., of Fort Worth, Texas, owner of the above-described properties, has requested vacation
of the excess right-of--way easements to replat with adjoining land. The said right-of-way easements shall
be retained as utility easements for existing water and sanitary sewer lines unless other satisfactory
arrangements are made, including relocation at the applicant's expense.
The City Plan Commission recommended approval at its Public Hearing on August 28, 2002.
The Engineering Department, Real Property Services Division states that a fee of $37,813.50 will satisfy the
public interest. Reviewing City departments and public utility companies have raised no objections to this
request. An acceptable replat has been provided (FS-02-212).
The value of the right-of-way will be credited towards the City's participation in the Economic Development
Program agreement between the City and Pier-FTW, inc.
Ordinance Number 15295 does not properly reflect the decision of the Plan Commission. The repea! of
Ordnance No. 15295 and adoption of the attached ordinance will correct this error and reflect the accurate
recommendation of the Plan Commission and the action by the City Council.
This request is located in COUNCIL DISTRICT 9.
