WFIEREAS, the City o� Fort 'GVorth and the City af Benbrook have a leng�hy
his�or�r af mutually b�neficial cooperative efforts in the provisian o� fir�
fighting services; and
WF�REAS, pursuant to Chapter 791 of �he �`e�as Govexz�ment Code, the
Texas Interlocal Coopera�ion Ac�, �.he Ci�y of �'oxt Worth and the City of Ben-
�. brook desa�e ta cantinue these cooperative efforts �o prov'ide adequate fiare
fightinq services to �he citizens of their respect�vr� czties in the most ef--
ficient and economical manner; and
WH'E12EAS, the City of Fort Worth and the City of Benbrook desire �o
specify the terms and conditions of an agreemen� �hrough which this mutually
beneficial relatinnship may continue into the �uture:

This contract and agreement is entered into by and between the City of
Senbrook ("Benbrook"}, a home-rule municipaiity in. Tar.rant Caunty, acting -
through its duly authorized Mayor, and the Cit�r of Fort Worth ("For� Wbrth"),
a home-rule municipali�y in Tarran� Coun�y, acting �hrough �ary Jackson, its
duly authorized City Manager; and

7.. SERVICE AREA; PROCEDURES
k'oxt Wo�th wi11 provide fi�e p�otection service at the service level
specified hereinafter to Benbrook in the serviCe a�ea, �he e�act location of
wha.ch is designated in a location map marked Attachment "A," hereto incorpo-
rated and specifical.ly made a part of this agreement. Fire protection serv-
ices will be provided in accordance with standard opera�ing procedures af t1n.�
Fort Worth Fir� Department, in conformance with E`or� Worth's rules, regula-
tions and ordinances relating �o provision of such sexva.ces. '4A��z -�-��.� �.ti_�,�1_-�

alarm proceduxes sha�� be whol�y undex tha Fort Worth Fire Department's con-
trol. It is recognized and understood �ha� For� Wo�th cannot and does not as-
sume responsibilzty for the provision o£ £ire services beyond those of the
service level chosen by Benbrook, nor outside the s��v�ce area.
2. DURATZON; RENEWAL
This agreemen� shall be in ef�eC� for a period of five (5) yeazs, com
mencing October 1, 2001, and expi�ing September 30, 20Q6, un�ess terminated
earlier fo= cause as specitied below. Cost adjustmen�s shall be made on an
annual basis. pursuant to the fo�mula set out in 5ection 3, "Cos� Calcula�ion
Formula�" and the respective at�achmen�s �hereto. At expiratian, the texxns
and conditions of this agreement may be extended for additional five-year pe-
riods, upon mutual consent of �ar� Wor�h and Ben�rook in writing.
3o COST CALCULATTON FORM[7LA
As consideration for the provision of fire services, Benbrook will pay
Fort Worth the amount set out in Attachment "B" which shall be calculated on
the basis of �he following fac�ors, subject to annual revision and adjust-
iaent :
A. Fart Worth's per capita cost of fire protection;
B. Benbrook's population serveci by this agreement;
C. The hazard potential factor tor the area covexed under this
agreement;
B. The level of service provided.
Each o� these �acto,�s is analytica�ly s�t put i.n gxeateac detail in Attachmen.t
"C" il�corporated and specifically made a part of this agreement. The actual
calculation figures for the current year of the contract, including servzce

4o CONSIDERATION
Fort Woxth and B�nbrook, as taxpayer-supported enta.ta.�s, ��cogz�.ize tk�e
impor�ance of timeliness ot providing cost figures for purposes o� budgetarp
convenience. Tlzerefore, F`ar�. Gifor�h covenants that i� will cause to be sent to
Benbrook no later than August 1�t of each year a calculation of the cost of
fire service �or the �oJ.lawing year similar in �ormat to Attachment "B"
hereof. Should Benbrook fail �o receive said cost Calcula�ion by August 15� of
that year, it shall notify Fort Worth. o� that �act by xega.st�xed ox cezti£ied
mail, requesting �ort U7or�h �o immediately provide same. Fort Worth covenan�s
that it will use its best efforts to provide appropriate cost information to
Benhrook in a �imely manne=.
Benbrook agrees to tender to Fort Worth twelve {12) equal monthly pay-
ments, each payment representa.ng �./7�2 af the total amnunt due under the terms
of this Contract. The first payment wal�l ba du� an or be£o�e Octab�r 15,
2001, and manthly paymez�ts th���after shall be made no la�er �han �he fif-
teenth (15th) day of each month. Payment shall be hy ceztified check ox by any
other method agreed to by Benbrook arcd E'oxt Woxth.
5. �RMiNATYON FOR CAUSE
Both cities recognize the impo�tance of fi�e se�vica and agree to act
in u�most good faith in their relations with one anothex under this agxee-
ment. Unilateral termination of this �greement shal�. be li.mited ta the fol-
lowing circumstances and only aft�r th� defaulting party has l�een �iv'en rea-
sonable opportunity to cure:
A. E`art Worth may terminat� this cantract for nonpaymen�. upon one hun-

5. L�'ABILIT'Y
Any eivii 1.iability ahall be determined pursuan� ta the terms of Texas
Government Code 791.006.
7. NON-WAIV�R OR �M�4IIi�iITi�S 7�iD DT�'�NS�S
It is expressly understood and agreed that, in the execu�ion of this
agreement and contract, neither city waives, nor sha11 be daemed hereby tq
waive, any immunity or defense tha� would otherwise be available to i�
against third-pa�'ty claitrts arising in the exercise of governmental �aowex's and
functions.
8. NON-ASS�GNABZLI�Y
Thi.s agreement is not assignable by eithe� party and any a��empt to as-
sign it is v'oid.
9. AMEN�M�N'Y'
This agreement may be amended at any time by mutua]. cansent of the par-
ties. Any such amendment �hall be in writing, attached hereto and filed with
the City Secretaries or o�hex' apprapriate official of the parties.

This writing with. its attachments and with any amendments, per the
foregoing paragraph, constiY.utes the entire agreement be�ween Fo�� Worth and
Benbrook, and no oral or written agreement exiets elsewhere to modify same.

The provisions of this contract are severable. Should any portiozi, of
it be adjudged �.n.va�.id by a court af competent jurisdiciian, the remainder of
its p�ovisions are to be qiven full force and effect as if �he affendinq por-

A. Varying types o� properties in the area to be protected. This in-
cludes a survey of small homes and }�usinesses which l�ave a mini-
mal poten�ial �o escala�e be�rond a first ala nn assign,ment; larger
homes, light industrial area, and o�her properties that have a
poten�ial �or escalation tp a hig�aer alarm level; industrial ar-
eas, hazaxdous operations, highrise buildings, large pubiic as-
sembly areas, and institu�ional properties wh�re lxfe hazard is
above average and othe� p.�opexti�s where the potential 'to esca-
late ta a maximum response �.s high.
B. Transportation Rou�.es. T�anspor�a�.ion routes aze £actored due to
the special p.�ablems railxoads, highways, and major traffic
routes can add to fi�e protection efforts.
C. Open Land. Both developed and undevel,oped open land is included
since fires in th�se typ�s oE azeas require special kinds of

All ratings of the patential prntection area axe done based on the re�
lationship of each factor to the "norm" of Foxt Worth. A ra�ing of � means
that a�actor is appxoximately the same as zs common to like factors in the
City of Fort Worth; a greater hazard factor would receive a hiqher rating.

Leve1 1 Full fire protection service, including full fire suppression;
emergency medi.cal fi�st responder se.�viCes; inspection of all
schoo�s, watex hyd.rants, comm�rcia]. estab�a�shments, and chuxches;
arson investigation; bomb squad; fire safety education; hazardous
materials response; emergency management; all other fire services
reCeitred by Fort Worth residents . The cost of I1ev'el 1 sertrice is
based on the full per capita cast of Fort f�Tarth �a.xe pxotection.
Level 2 Full fire supp�ession service, emergency medical services firs�
responder service, inspe�tion of wa�er hydrants, and hazardous
ma�erials inciden� response. Tf the Fort Wor�h Fire Depar�ment
In�ident Commandeac de�ermines that any speciali�ed serva.ces, �.n-
cluding but not limited to hazardous materials response, techni--
cal rescu�, and/or et�ergenCy med.ical services are rec�uirecl for a
particular incident responded to in the contracta.ng city by the
Fort Worth Fire Aepartment the contracting c�ty wiil not be
charged for such additional services. Level 2 service is provided
�or 90$ of �he �ull per Capita �ost of Eor� Worth �ire pro�ec-
ti.on.
Level 3 %Tea=es� one-alarm assignntent. For this level of serviCe '�he Fire
D�partment wi1]. eespond to th�e nearest on�-aZa�'m assignment,
which includes, on average, two Pump companies, one Ladder com-
panp, and one Ba��alion Chief. This level af service does no� in-
clude emexgency med�.ca1 �a.rst �esponder s��vice o� hazardous xna-
terials response. If the k'oxi Worth k'a.xe Depaxtment Incident
Commander determines that any specialized services, including but
riot lir�i�.ed �a hazardous ma�erials response, -�echnical rescue,
and/or emerger�cy medical servic�s a.�� ��qu.i.zed far a part�cul.ax
incident responded to in the contracting city �ay the Fort Gdorth

Level 4 Nearest one-alarm assignment. For this Ievel of service �he F'ire
Department will respond to the nearest one-alarm assa.gnment,
rnrhich includes, on averaqe, two (2} Pump companies, o�rz� (l� Lad-
der coznpany, and an� (l.j Battalion Ch�e�. This �evel vf serviCe
does not include emergency medical first responde= ser�srice or
hazardous materials response. If the For� Warth Fire D�partment
Incident Commander d�t�rmines that any specialized services, in-
cluciing but not limited to hazardous materials responsep techni.-
cal rescue, and/or emergency medical services axe required far a
par�icular incident responded to in �he �ontracting city by the
Foxt Woxth Fire Dep�rtxttent the contxacting city will not be
charged for such additianal services. This level of service also
requires the contracting city to supplement �he Fire ground ��-
sources by �espandinq up �o all available �ire personnel and ap-
paratus when xequested by the Fort Worth fire commander. Such
supplemen�al resources will work under the ditectidn of tlle Fort
iniorth �'ire ]]epar�men� dis��ic� chief or inaident commander. Leve1.

RECOMMENDATIDN:
It is recommended that the City Council authorize the City Manager ta am�nd the contract for the
prov9sion of fire serviees ta the Cify of Ben�rook, changing the language for Section 6: Liability.
DISCUSSION:
On Octob�r 2, 2p01 (M&C C-187B1), the City Cour�cil ap�raved a mulfi-year contract for the provision
of fire services to the City of Benbroak {City Secretary Contract No. 27161).
The original fiability section inciuded language specityir�g that Benbrook would be responsible for al[
[iability for any damage to Fort Worfih equipment, and all lia�ility for personnel and employee benefits
for Fort Worth personnel providing services under the agreement, including workers' compensation,
pension, an� retiremenfi benefits.
After discussions with Benbroo�c this section was changed, and now specifies that any civil liability shall
be determined pursuant io the ierms of Texas Government Code 799 .00fi.
lt is the opinion of the City Attorney that the change provides sufficienfi protection to the Ci�y of Fort
1�'Vorth.
