Ordinance No. 18683-d8-2009 AN ORDINANCE INCREASING ESTIMATED RECEIPTS AND APPROPRIATIONS !N THE GRANTS FUND IN THE AMOUNT OF $50,dOd.Od, UPON RECEIPT OF SUPPLEMENTAL ENVIRONMENTAL PROJECT FUNDS, FOR THE PURPOSE OF FUNDING A "MOW DOWN AIR POLLUTION" MOWER EXCHANGE EVENT; PROVIDING FOR A SEVERABILITY CLAUSE; MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES: REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That in addition to those amounts allocated to the various City departments for Fiscal Year 2008-2049, there shall also be increased estimated receipts and appropriations in the Grants Fund in the amount of $50,00090, upon receipt of Supplemental Environmental Projects funds, for the purpose of funding a "Maw Down Air Pollution" mower exchange event. SECTION 2. That should any portion, section or part of 2 section of this ordinance be declared invalid, inoperative or void for any reason by a court of competent jurisdiction. such decision, opinion or judgment shall in no way impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining provisions shat! be and remain in full force and effect. SECTION 3. That this ordinance shall be cumulative of Ordinance No. 18283 and all other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in diroct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed. A total of $43,387.44 in SEP funds were received by the Gity in Fiscal Year 2408. The Fiscal Year 2048 SEP grant earned interest in the amount of $1,238.25; TCEQ has authorized the expenditures of $124.16 during the Fiscal Year 2048 and the transfer of $1,114.09 to the Fiscal Year 2049 grant year. Any future interest earned will be authorized to spend an the SEP grant. As of May 2049 three separate parties have been identified to provide $20.108.00 in contributions to the City of Fort Worth in settlement of an enforcement action brought by the TCEQ. The City plans to use these and any additional funds identified by the TCEQ to host a "Maw Down Air Pollution" Mower Exchange Event this summer. Funds identified to date will remove approximately 100 gasoline-powered walk-behind mowers from service and result in an estimated reduction of three and one half tons of volatile organic compound (VQC}emissions and removal of seven and one half tons of carbon monoxide emissions per year. The event will also assist in educating citizens on ways they can reduce ozane- forming emissions. FISCAL INFORMATION 1 CERTIFICATION: The Financial Management Services director cerkifies that upon approval of the above recommendations and adoption of the attached appropriation ordinance, funds will be available in the current operating budget, as appropriated, of the Grants Fund.
