Paniaqua, its duly suhhorized assistani city managez, and Bazan Roofing, �nc., hereina#ier refsrred to as "Contractor", actiag herein by and tl�rough Jorge Bazan, its duly authorized president, for the anstallation of a new roof at Fire Station 25, located at 2909 Schvvartz A�enue, Fort Worth Texas. 1.0 CONTRACTOR'S RESPONSISILTTIES 1.1 Cantractor, at its sole cost an8 expense, s�all suppIy the labor, and all needad taals and equipment to replace the roof, repair gutters, and ali appurtenant work at Fire� Station 25, 2909 Schwartz Avenue, Fort Worth, Texas. 1.2 Contractar, suhject to reimbursement by the Owner, shall pxovide a dumpster foz the r�moval and disposal of debris and trash, minor incidental anaterials, and project specific insurance as required herein. Tk�e total reimbursament tl�at Contractor shall be entitled to hereunder shall not exceed $2,Q.Q�. 1.3 Cantractoz shaIl repair, refinish, and �ake good on any danaage to the buildin� resulting fr�m any of its operations. This shall include, but not be ii.x�aiteci to any darnage to plaster, wall cavering, fiirniture, paiu�t, ceiling, floar or any othez �'inished woxk. Dainage done to the building, equipmen.t or pxoperty sball be repaired at the Conlractor's expense, halding Owner harjnless to any other clairn for properly damages and/ar personal injury. 1.4 Contractox uz�derstands that Owner wiIl occupy the buildiug at re,gular hours and shall coordinate its work in such a manner so as to not interfere with the nozmal operai�ons. 1.5 Contractor shall employ safe prac�ices in handling materials and equipment used ixi pezfoz�iing the reqnired work so as to insure the safety of its workers, accupants of the facilaty, Owner ernployees and tk�e public, 1.6 Conir�ctor shall keep the premisas free at all times from accumularian of waste materials or rubbis� by plac:ing same in receptacles. At the completion of the wozl�, Coniractox shall dispose of all vvaste and xubbish from and about the work axea, sha�l remove all tools, equipment and surpins materials, and s$all leave the site in the condition it was in before the worTc rvas undertaken. TJVarkexs' Camaensation Insurance. Conlractar shall procure a�d maintain duriug the term of this Contract, statutory Workers' Compensation Insurance for all of its ernployees at the site of the Project, and in case any work is sublet, . Contractor shall reguire its suhcantractors sixrailarly to provide Workers' Gampensation Insnrance for ali af their ernplayees unl�ss such emplayees are cwered by the 'W'ori�ers' Compensation. The Cvntractor shall provide a cerkificate of insurance dncumenting Owner as a"Cez�ti�ficate Holder", and noting the speci�tc project(s} covered by the Contractor's insurance as dacuznented on the c�rtificate of insurance. More than ane certiiicate �xlay be required of t�e Contractor depending upon the agents and/or insurers �or the Contractor's insurance coverage's specified for the projact(s). 1.10 Other Insurance Related Requirements. 1.10.1 Ow�er shall be an addit�onal insured, by endorsement, an liability insurance policies. 1.10.2 Workers compensation insurance poliey shall each be endorsed with a waiver of subrogation in favor of the Dwn.er, l.1d.3 Insurers of policias maintained by Contractar and its subcontractor(s), ii applicable, shall lie au'thr�rized ta do 6usiness in the Siate of Te�cas, oT othezwis�e approved by the Orvner. At the Owner's sole discretion, a less iavora'6Ie rate may be accepted bp the Owner, whicb sl�all be approved by the Owner in writi�g. 1.10.4 Deductible limits an Cantractox's insurance policies andlor self insured retention's exceeding $10,000 require approval of the Owner as respects this Contract. 1.1{�.5 The Owner shall be notified in writing a rniixm�.urn of �ty (30) days prior to an� insuser's action in the event of can�ellatior�, non-rener�al or materia] change sn caverage ragarding any polxcy providing insuraz�ce coverage required in this Contract. 1.10.5 Fn111amits of insurance r�quued in Sabsec�iAn I.9 sha11 ba availabl� for claims a�zsing out of this Contract wi#h the O�vvner. 1.10.7 T3ae Contractor sha11 provide cerkificates of insurance to the Owner prior to comxnencernent of operatians pursuant ta this Contract. General: All +nrarrantees are calculated from the date of fEnal acceptance 6y th� City, The Cantractor sha{[ be fully responsibie for the wark until date af final acceptance. B. Manufacturer's: Provide a non-prorated, 20 year manufacturer's warranty an the roof system to include membrane and all flashfng and accessories fior the full repEacement value of the roof inembrane, including all rnaterial, labor and equipment costs, #or the removal and instailation af a new roaf system with all membrane flashings and accessaries. C. Insta!ler: Two year material and labor for all work including all metal flashings. 4.3 Certification of Ow�er's Maintenance Farces: M�nufacturer shall provide, at his expense, aefequate training on th� rspair and modif�cation of mod9fied bitumen, torch down roofing at a{ocation within the DFW Metroplex in order ta certify the Building Maintenance Division of ihe Transportation and Public Warks Depariment for warraniy repairs and modifications of the manufactur�r's roof systems. The City of Fort Worth will pay for tra�el and per diem costs incidental to the training.
