Lessor vvill assess a iate penalty charge of ten percent (10%) af the rental paym�nts due p�r
month in additian to the en�ire month's rer�t for each mon�h for whic� rent is past due.

Lessor, as securi�r £or th� futl and faithful performan�e by Lessee of the te�nns, conditions,
and covenants of this lease on L�ssee's part ta be �er£ormed and kept. This deposit �aes not
constiiute advance p�yment of the finat rental paym�nt di�e under this lease, unle�s ��
e�press canditions specified in Subsection �I} are met. A Pet Deposit of ��00.00 will be
deposited with the L�ssor a�d will due vvith the fir�t months lease paym�nt.
(B}Lessor agre�s io hold such €�epasits £or Lessee, and it is u�derstood that Less�r's c�a.im to
such deposits sha11 be pxior to any creditor of Lessee, excluding �. trustee in bankruptcy.
(C) Lxcluding the final rental payrnem to be made under this Iease, if at any time during th� lease
term, Lesse� de�aults in the payment of rent or anq portion of rent reserved in this lease, or a£
arty ofiher sums expressly constitutin.� rent, other than advance rental payments, Lessvr may
appropriate and apply any parCion of the security deposit as may be nec�ssary to the paymen�

(A)I�' at any time durin� the Iea�e �Erm, L�ssee should £ail to repair any damage to the Ieased
premises t1�t Lessee is requir�d to repair under the terms of this le�.se for a period greater
than thirty (34) �ays after Lessar serves an �,essee written demand to make such repair, then
Lessor may appropr�ate and apply any portion a£ the security deposrt as may be reasonably
necessary to rnake such repai�s. �
{E) I� on termina.tion of this tenancy for any reasan, L�ssee does not leave the leased premises in
a reasonably clean condition a,�d in good repair, e�c�uding normal wear a�d tear, then Lessar
may appropriate and apply any portion of the s�ccurity deposit as may be r�asonahly
necessary to put the premises in clean canditian and good r�pair. As used in this lease
"norm�l wear and tear" means deter.ioration that results frorn the intended use of dws3lin�,
and dc�es not include deteriora�ion that results fro�n ne�ligence, carelessness, acciden#, or
�bus� af the �rernises by Lesses, by a member of Lessee's househo�d, or by a requ�st o:f
Lessee.
(F) In the event a�tuat cause �xists far ret�ning a11 or any partion af the security depasit, Lessor
sha11 reiurn the balance of the securi�y depasit, if any, together with a written d�scriptian and
iternized list of a1I d�ductions. �uch d�duetions sball be limi#ed to damag�s and charges for
which Lessee is legally liable under tlus a�reament or as a. result af breaEhing this agreement.

{H} Should Lessor transfer Le�sor's interest under this Iease in any rnanner, Lessnr must do one
of the folIowing acts, either of which wi11 relieve iessor of further liability with respec� to

(1) Trans�er the portian of such deposi� r�mainiug after any law£ul
deductions, a,s abo�e, to the successor in interest, and tt�ereaftex not�iy L�ssee bq
registered m�.il of the t�ansfer and th� transferee's nams and address. On rec�ipt
o�Lessee of a stat�rnent signed by txte successor in inter�st acknowledging receipt
af and responsibi3ity for the deposits, Lessor's successar in interest shall have at1
of the obligativns af I.�ssar with respect tn such deposits; or
(2} Return to Lessee �t�e porrion of such deposits remaining after auy lawful
deductions h�,ve been mac�e.
(n If Lessee has provided noiice of surrender nf the Leas�d Premises in accordanc� with
Subsection (G) �ierein, and L�ssor, in its sale discretion, deternvnes that the leased premis�s
are in sa.tis�'acto�r condition and have been mai�ntained in good re�ai�r, Lessee may elect io
have the balanc� af the security deposit applied to Lessee's final payment due under t#�is
lease agreement.

Lessee shail be responsible %r the payment of a1l utilities. Lessee rnust pay pramptly, as
they become due, all charges far t.he furnishing af water, sewer, gas, electricity, g�rbage service,

� The Leas�d Premises shatl be used solely and exclusively for private residential purposes
for Lessee and iheir immediate family. Lessee further agrees that Less�e shall not cond�ct any
commercial use ai ihe Leased Premises without prior wri�ten approval of Lessor and any
unau��ori�ed comrnercial use shall constitute a breach of this lea�e.

EVICT�OI� Al�TD ABAI�DC�]�1�1�TT
A. Lessor sh�.11 be �ntitled to institute proeeec�'sngs to evici Lessee fi otn the premises, at any time
�hat Lessee is in default under this ��as� or holds over after the �xpiration of �he lease term or
any successive ren�wal terms, and Lessee hereby specifically wa,ives any rights it may have
to the �olltiwing:
1. Natice by L�ssor oftermination of #�e t�nancy;
2. Any notice to vacate or quit the prernises as sp�cified iin the Te�as Property Code,
�ection 24_005 (a}; and
3. Any other notices required by law.
B. Tn the event the Lease is terminated for any reasvn ar Lessee abandons or is evicted from the
premi�e�, Lessar shall not be responsible For any real or persanal property of Les�e�
rema.ining on the prem�ses at the time af said eviction, ai�andonment or ter�ninatio�, and said
p�rsonal property sha11 be deeined abandoned by Lessee if it remains on the premises at any
time subsequent to the terminatian of Lessee° s lawful possession of the pr�mises.

Lessee shall cQmply with all applicable laws, ordinances and regul�.tivns prevailing in the
jurisdictian in which the i,ea�ed Premises are located, includin� but not timited to federal, state,
local laws and the City ordinanGes, rules, regulatians and specifications.

A. Lessee agrees that Lessee shall maintain the Leased Premises and keep same in good repair
a� Lessee's sole cost and expense. All ma.intenance, minor repairs and upk��ep of the Leased
Premises shall be in accflrdance vvitl� all applicable law� including City ordinances, rules,
re�ulations, and specificatioz�s.

C. I,essar hereby agrees to make au�r major repairs to the premises up to the amaunt of $1,500
per y�ar upan written request QFLes�es, howev�r, �f t�e cast ofthe ma.jar repairs is more than
$1,S4D, Lessor will determine, at iis sale discretian, whethar to repa�ir the premises or notify
the Lesse� that the lease will be terininated according ta Sectian 16.

Lessee shall �at constnxct any improv�ments ar structures on the premises without the
prior writt�n consent of L�ssor, and all improvements constructed an ihe pr�mises sha�l be
cons#ruct�d at Lessee's sole e�pense. Lesse� must maintair� anc� protec� all impravementa,
struciures, fences or appurter�ances existzng o� the L�ased Premises. Less�e covenants az�d
agrees #�at �,e�see shall not be entitled to any reitnburs�ement for the aast or �alue of said
impravem��ts, str�tctures, Fences or appurtena�ces. In addition, on ar before the termination date
af ti�is lease, Lessee sha11 be respansible for removing any real or pers�nal praperty own�d or
otherwis� belonging to Less�e and not deemed to be ihe pr�per�y of LEssor. The removal of all
rea.l and p�rs�na! property of Lessee sha11 be accomplished solely through Lessee° s eir�arts and in
removing any of lLessee's real nr p�rsonal property from the Leased Premises subsequent to the
termination of tl�i� lease. The Le�a,sed Prenuses shall be de�med to laave been abandoned by
Lesse� if Lesse� does not use and occupy said premise� �n accard�,nce with the purpases of this
lease term o!r anq successive renewal period. This 1�ase shali be te�-minateci upon the
abandonrnent ofthe Leased Premises withaut notice ta Lessee.

Lessee shall not assign ar sublet this lease without the prior written approval af Lessor,
and any such unauthorized assignrne�t or suhlease shall consti�ut� a breach a�this lease.

Lessor shall l�ave the right �o terminate this lease a,� any time for any reasan unrslated to
Lessee's deiault or breach �f any afthe terms expressed h�reian Uy giving Lessee thirty (30) days
written notice priar ta the in�ended terminatian date. Lessor may ter�ninate the lease
immediate�y u�on any default o� breach of �ny of th� provissons hereunder without any prior
notice to Lessee. �Said r�otices shall be deemed effective as o�the date they are mai�ed. IfLessee
elects t� ternninat� the leas� because of any a�leged d+efault or breach by Lessar or an�r lease
provisions, Le�s� shal.l be required to give T.,essor i.mm�diate notice o� said intention xn wri�in�
stat�ng sp�cifically the reasons therefar an� ailowing �,essor th�rty {3�) days after the date of
Lessor's receipt o� such notice to cure any or a11 default(s} or breach(es} speci�ied in said notiee.
�f the specified default{s) or lareach(es) of Lessor are cured within said thirty (30) day periad,
Lessee shall be deerned ta have waived said sgecified deiault(s) or breach(es), and this lease
sha.11 continue #ca be effective unless termin�ted pursuant io same other provisions specified
herein or by virtue of some subsequent uncured default vr breach of L�ssor, in wh�ich case Lessor
shal� be entit�ed ta any a�ditional na�ice period required #�y the terms af this lease.
If #�iis lease is t�rrninated under this �ection, or �as a re�ult of the e�iration o£ the leass
term or any ren�wal period, neither party shall have any furth�;r oblxgation or liaUility to the ather
under this �ease, exeept tha� Lessee �hall be liabie �or the br�ach o£ az�y term, cavenant ��
conditian cantained in ihis �easa ocaurring prior to the date of the surrendar af the pre�ises by
L�ssee pursuant to �he tenninatian. Lessee shall be bound by th� tierms, COVET1a.1af5 an�k
conditxons �xpressed herein until Lessee surrenders the premis�s regardless af whether the dat�
of surrender coincides with the dat� of termination of the lease. The waiver by Lessar of any
defa�alt ar b�-each o£ a t�rm, covenant or condition of this lease slxall nat be deemed to be � waiver
of any other breach of tt��.t ierm, covenant or coz�dition or of any ather term, co�enant ar
cor�dition af this lease, regardless nf when th� breach ocaurred. Further waciver by Lessar of �.ny

It i� hereby agre�d that Lessee will pravide Lessor with a certif�cate af insurance
documenti�ag liability insurance at a minimum lirnit of $3�6,000 each occuirence as respects the
property and prernises addressed herein. The effective date of insurance coverage shall b�
commensurate wiih the tertn of the lease. Lessor shail be endorsec� as an additional insured in the
certi%cate. The insurer of L�ssee's liability itnsn.xrance shall be acceptable to the Lessor insoiar as
the company's fiinancial strength and salvency. The policy providing liability insurance sha11 be
endorsed to provide Lessar with a miniinum thirty (30) day notice of cancellation, non-renewal
or m�.terial change in coverage. Less�r's insurance requirem�nts may be revised at Lessor's
aptio�, and Lessee shall xespond accordin$iy witnin thirty (30) days o� Lessee's receipt of a
written natice af such r�quirement. Any faalure an part of Lessor ta reguest c�rtificatian of
insurance require� herein shall not be cons�rued as a waiver af such requirement.

breach of this lease shall be i.n Tarratit Coun�.y, Texas.

A. This l��.s� daes not give Lesse� az�y right to use, mine, lease ar otherwise deriv� any b�nefit
firom any o�l, gas, coal, gravel, minerals, trees or deposits of any type ar natnre, and title to a11
a� sa.id substa.�ces sha11 remain in Lessor. In addition, Lessee shall nof have an� right or

DISCUSSION:
This property, which is Eacated within the 6� decibels LDN {day-night sound level}, was pur�has�c! by
the Gity ta facilitate naise mitigatian at Fort Worth A!liance Airpart, The Engineering- Department, Real �
Property 5�rvices Division, at the request of the Aviation Department, marketed the property far lease.
The manthly leas� amount of $1,100 was establish�d based upon an independent rental survey,
exposure ta the market, la�ation, and con�it�on of the existing improvements. After making adjustments
to the rental comparables for location and amenities, Gity staff determined tha# the fair market rental for
t�18 SUY�J�Ct �?iD�}EC�y 15 ��,1D� per mo�ti�. R�venue for the remainder vf this fiscal year will be $550.
