commit auto theft is of�en hindered because the range of operations of the criminal
offender is greater thar� the jurisdiction of the peace o�fficers called upan to investigate
the crime; ar�d,
lI�HI�RFAS t#�e existence of a multiplicity of �olitical jurisdictions in Tarrar�f, Jac�,
Jo�nson, Palo Pinto, Parker, Somerv�l� and Wise Gounties imped�s the effectiveness
of individual law enforceme�t agencies fio deteci and eradicate auto theft; and,
!lV�1�REAS past experience has indicated that a coaperative effart between law
enforcement agencies and Tarra�t County Y�as. b�er�.effective in detecting and det�rring
the activities ot targeted criminai groups�to the mutual ber�efit of al! the palitical entities
of Tarrant County and neighboring counties; and,
'4�!'H��E�AS pursuant ta Chapter 362 of the Texas Loca! Go�ernmerrt Code, the
Texas Interlocal Goaperation Act, Chapter i9� of ih� T�xas Gavernment Cad�, and
Article 4413(37) of the Texas Revised Ci�il 5tatutes Annotafed, an Act relating to the
creation, powers and duties o# the Texas Autamabile Theft Prevention Authority, and
the law of the State af Texas, the contracting cities to-wit: Arlington, Benbrook, Euiess,
Fort Worth, Haltom CEty, Hurst, River Oa�Cs, Sansom Park, Westworth Village and White
Settlem�nt, the County of Tarrant, the Tarrant Counfy Criminal District Attorney, the
Tarrant Caunty Sheriff, Johnson Co�nty, and the Johnson County Sheriff, hereby agree
to parkicipate in, and be a part of the caaperative in�estigative, �nforcement, and

Task Force; and,

That Tarrant County, acting by and through its duly authorized County J�dge, the
Criminaf Distriet Attar�ney of Tarrant County, the 5heriff af Tarrant County, Jvhnson
County, acting by and through ifs duly authorized Caur�ty ,�udge, th� Sherrff of Johnson
County, anc! the cities that ha�e executed, a�e executing, or will execute substantially
sim�lar copies hereof at this tim� or in #he future during t�e time that this agreement is in
force, acting herei� by and through t�eir duly auihorized chief administrative officer do
hereby cavenant and agree as follows:

T�e Tarrant Regional Auto Theft Task Force ("Task Force") will be a par� of the
Tarrant County� Sheriffs �ffice, for administrati�e pUrposes. T�e activities of the Tas�C
Force shal� be supervised by an eleven �11) member Board of Govemors. Each
gvvernor wilf represent one (1) or more specifc municipaiities so that each municipafty
in Tarrar�t County has a specific representative on tf�e Board. Johnson Gounty will be
represented by its Sheriff. This Board will include as permanent voting members the
Fort Warkh Chiefi of Police, the Arlingt�n Chief of Police, the Tarrant County Griminal
District Attomey, and a Chairperson, who shall be the Tarrant Caunty 5heriff,
Additionally, the Board wiEl consist of a Police Chief from a Mid-Cities area police

department; a Police Chief fram a city with a�opulation under � 0,00�; a Polic� Cnief
#ram a city with a popuiation be#ween 10,000 and 30,000; a Police Chief from a city with
a population ouer 30,OaQ; a Police Chief representing the Wesfiern Tarrani County cities
of: Azle, Benbroak, Blue Maund, Burleson, Crawley, Lake Wvrth, �akeside, Pelican
Bay, Ri�er Oaks, Saginaw, Westworth Viflage and White Settlement; the Johnson
County Sheriff and a Regional Captain of #he Texas Department of Public Safety's
Motar 1/e�icle Theft Services. Ex offcio members, if any, may be added by agreement
of the voting members; ex �fficiv members shal! be nan-voting. City papulatio�
brackets may be changed by agreement of the Board without the necessity of changing
�his agre�ment.
The Board of Governors shall have the respvnsi�ility fior poiicy, direction, and
cantrol of the Task Force. The Board �f Governors will have direct responsibili#y for the
seieetion of a Cammand�r for the Task Force. The Board will monitor the activities and
accomplishments of the Task Force ta ensure order�y progress towards attainment of al[
�tated vbjectives.
There will be on� unit, which may form sub-groups or teams as appropriate, The
activities and i�ve�tigations of these sub-groups ar teams shal� be d'trected by #he
Commander of the Task Force. Thes� sub-groups or teams will have the duties
ass9gr�ed to them by the Commander.

Auto theft inves#igations wi#hin the jurisdietional bounds of the entities joining this
agreement may be coordinated through t�e Task Force. All commercial au#o theft
intelligence recei�ed by a law enforcement agency that is a party to this agreemen# may

be referred ta the Tasic �orce for inves#igation. The Task Force will maintain
inteliiger�ce fifes. The as�igned office�s will respond to complaints in a timely manner.

All assei seizures de�eloped by the Task Force in Tarrant County under Chapter
59 of the Code of Criminal Procedure wtll be prosecuted by #he Tarrant Caunty Criminal
Distr�ct Attorney's Office.
There is hereby created a certa�n fund ta be known as the Auto Theft T�sk Force
Assef Seizure �und (hereinafter called "Fund"), said Fund to be created in compliance
with State law and the requirements of the grar�t restrictions.

Upon entry of a judgmert� in a jucficial �raceeding awarding monies ar other
�raceeds to the Tarrant Regional Aufo Theft Task Force, sai� moni�s or praceeds will
�e irnmediately deposited in the Auta Theft Task Force Seizure Fund. The monies and
proceeds in this Fund must be used to further the purpose of the Taslc Force as
required by the Tarrant Regional Auto Theft Task Force Grant awa�d: Enhancement af
currer�fly funded andlor future motor vehicle theft enforcement and pr�vention
programs.
All forfe�ture funds and other generated program income shall be subject to audit
by �he Auditar of Tarrant Coun�y, Texas and the Texas Autamobile Theft Prevention
A�fhority.

Any conveyance or �ehicle tha� is the subject of a final forFeiture shalf be
awarded to t�e Task Force to be used to further the pur�ase ofi the Task Force as
required by the Task �orce grant award:
Upon #ermination of this Agreement, ownersnip of equ�pmen#, hardware, and
other non-expenda�le items wilf re�ert fa the appiicant for which it was acquired, subject
to the approval of the Automohile Theft Prevention Authority af the 5tate of Texas.

Any peace officer assigned to the Tasl� Force hy a go�ernment er�#ity which is a
party to this agreement sha{I �e empowered to enforce all laws and ordinances
applica�le in the ju€risdiction of th� county and municipal entities signatory io th�s
agreement, including the power to malze arrests, ex�cut� search warrants, and
investiga#e auto theft aff�nses outside of the geogra�hical jurisdiction firom which he or
she is assigned, but witt�in the area covered by the j��isdic#ions of the counties and
municipal entities which are parties to t1�Es agreementa
While functionir�g as a peace officer assigned to #he Task Force, he or sh� shall
�ave all of the law enforcement powers of a regular peace officer of such otf�er politicai
entity.
A peace ofFicer who is assigned, designa�ed, or ardered by the offcEal designated
by #he governi�g �ody of any entity to perform law enforcement duties as a member of
the Task Force shall receive the same wags, salary, pension and afl ather
compensatior� and all other rights for such service, i�cluding injt�ry or death bene�its and
workers' compensafion benefits, paid in accordance with the Texas Automo�ile Theft
P�revention Authoriiy Grant Guidelines, as existing or as may be amended, and

applicable law, as though the service had been rendered within the limits of the enfity
from which he or sF�e was.assi�ned. Recogniz�ng th� benefifs tn a partic9pa�ing entity to
this agreement, it is agreed that all wage and disabi[ity payments, includir�g workers'
compensaiion benefits, pension paymen#s, damage to equipment �wit� the exception of
leas�d vehicles, for which damages wil! be covered under the provisions of t#�e lease(s))
and clothing, medical expense and expense of travel, faod and iodgir�g shall be paid ir�
accordance with the Texas Automobile Theft Prevention Authority Grant Guidelines, as
existir�g ar as may be amended. Hawever, peace officers assigned to tt�e Task Force
wi�l not work over�ime thaf is nat reimbursab�e #o their assigning agency without prior
approval �rom their assigning agency su�ervisor. (For example, �ort Worth police
officers assigned fo fh� Task Fprce wiil not work Task Force overtime, which is not
reimbursabfe to #he Fort Worth Police Department, wifhout priQr approval from their Fart
Worth police suparvisvr,} Instead, they rrvill be ��rmitted to flex their work hours as
necessary to accomplish Task Force ob�ectives and assignments.
In further recognition of the ben�fit ta be gained by fhe entity partici�ating in the
Task Force, i� is agresd that no entity that is a parky to this agrsement shall receive or
be entitled to reimbursement from another entity participating in #his agreemeni for any
services performed pursuant to this agreement.
It is further agreed that, in the ever�t tha# any peace Qfficer assigned to the Task
Force is cited as a party defendant to any civil lawsuit, state ar federal, ar�sing ouf of his
ar her official acts while funcfioning as a peace officer assigned ta the Taslc Force, said
peace officer shall be enti#led fo ihe same benefits tha# such officer wauld b� en#itled to
receive had such civil act�on risen out of an official act witi�in the scop� af his ar her

du#ies as a member and �n th� jurisdic�ion of #he law enfvrcement agency from which he
or she was assigned. Furtf�er, no entity shall be responsib�e fo� the acts of a peace
officer of anather entity assigned to the Task Force. Each entity participa#ing herein
indemnifiies and holds alf otner parkicipating entities harmless far all acts of its own
officers and employees acting hereunder, to the �uil extent permitted by law.

This Gontract is subject to ail grant conditions applicable to the grant of fhe
Texas Automobile Theif Prev�nt�ori Autho�ity to the Tarrant Regianal Auto Theft Task
Force.
Each party to this agreement expressly wai�es a�l claims against every other

party for compensatior� for any lass, damage, personal injury, or death occurri�g as a
consequence of the performance of this agre�ment.
Third party claims agains# members shall be go�erned by the Texas Tort C�aims
Act or other appropriate statufes and [aws of t�e State of Texas and the United Stafes.
�t is express[y understood and agreed that, in t�e executian of this agreement, no
party waives, nar shall �e deemed hereby to waive, any immunE�y ar defens� that would
otherwise be availa�le ta it against cEaims arising in fihe exercise of governmental
powers and functions.
The validity af this agreemen# and af any of its terms or provisions, as well as the
rights and duties of the parties hereunder, shail be go�erned hy the laws of the State of
Texas.
In case any one or mar� of the pravisions contained in t�is agreement shall for
any reason be heEd ta be in�alid, illegal, or unenforceable in any respect, such in�alidity�,

illegality or unenforcea�ility shalf not affect any other pro�ision thereaf and this
agreement shall be construed as if such invali�, illegal ar unenforceable pro�ision had

This agreement shal[ become effective as to a party hereta on the day of t}�e
execution of the agreement by the party, and shal! continue in effect as to a partrcipating
enfify for one year from t1�e dafe of srgnature and fhereaffer un�il if has been ferminafed
or rescinded by appropriate acfion of the participa�ing entity"s governing body, or expires
due fo te�'minafion of fhe grant or by operation of law. {To minimize the administrative
difficulty of signat�re be#ween ti�e many parties, each city or other 1aw enfarcement
enti�y will sign a substantialiy similar agreement with Tarrant �vunty; however, each
party signing substantially similar capies is immediately bound one to ar�other to ail
o#her entifie� participa�ing during the time said agreemen# is En force as to sai� entity,
even though the parties' signatures appear on different copies of the su�stantially
similar copies. Any entity being acfded after the agreement is in effect need only sign
the documents which Tarrant Co�nty signs to be fu11y a�arty bo�nd to all otner parties,
and such signature shall, as of the date af the signing, haWe the same force and e�Fecfi
as between the joining a�d alr�ady-bound members as if a single document was signed
simultaneo�sly by all then-participa#in� entities.}
If program enhancement acti�ities are terminated, �anexpended revenues will be
promptiy returned to th� Texas Automobile Theft Prevention Authoriiy.
This agreemer�t may be amended ar madified hy the mutual agreernent of the
parties F�ereto i� writi�g. The InterEocai Agreement is for the period and on the
conditions herein cor�tained, and on suc� conditio�s #o this agreemen# as may be added

by amendmer�t or by �aw, and not for any period beyond that permitted �y faw, nor for
any purpose no# permitted by law.
This instrumen� contains all cornmitments and agreements of the parties, and no
oral or writt�n commitments have any force ar effec# to alter any #erm or con�ition of this
agreement, unless tf�e same are dohe in prop�r form and in a manner consiituting a
bona fide amet�dment herefio.
Twa non--Eoca� entities, the Texas Department of Public Safety an� the Texas
Department of Ir�sura�ce (an behalf of the State Fire Mars�al's �ifi�e} eac� enter
separate agreements with Tarrant County for the following reasons: Each entity's stafF
mem�er carries a statewide law enforcement commission and t�erefore does not
require the enhanced law enforcemer�t jurisdiction afforded by this agreement; Each
entity f�nds their sfiaff inember's saf�ry and frir�ge benef[is ��Q°/a; Each entity's s#aff
m�mber perForms in a support ro[e to the Task �orce and is avaiiable less than 100°/a of
their work wee� because the avaiiability af each is subject to assignments from their
entity.
The parties agree t�at their collec#i�e agreement may be e�idenced by the
execution of art ir�enfical counterpart of this instrument by the duly authorized official(s)
of each Participant and the failure of any anticipated mem�er to enter into or renew tl�is
agreement shall not affecf the agreement betweer� and amor�g #he parties executing the
agre�ment.

Signa#ure of this Agreemer�t constit�tes acceptance of all grant condit�ons, grant
restr�ctions and the terms of all a�plica�Ee laws.
This is to certify that the objecti�es of the Tarrant Regional Auto Theft Taslt Force
as stated in its Gran# A�pl�cation for tha fiscal year{s) funding covered by this
agreement have been re�iewed and that it is mutua[ly agreed to cooperate #o whatever
extent is necessary in carrying out the work pla� described in �he appl�cation(s).
Add�tionally, each participafiing agency and entity is cognizant of th� grant and
agrees to abide by any and al� ru�es or speciai conditions in r�katron to the applicatEon.

As �art of �his agreement, all participatir�g enti#ies entitled to reimbursement wil!
�e reimbursed far their participation in this program by grant fu�ds, fhro�gh the grant's
fiinancial officer (th�s is presently S. Renee Tidwel�, Auditor, Tarrant Co�nty, dt�t is
subject to change by Tarrant County; if changed, #he change will be made 9n
accordance with the gran# and al! participating er�tiiies will he ad�ised i� writing)
according to the en#ity's applicable submitted budget schedule, �o t�e extent that the
budget schedule is consistent with the grant. To the �xt�n# t�at the budget sc�edule is
inconsistet�t wit� the grant, t�e grant controls. A cQpy of fhe latesf and most currenf
Granf Award Digesf wil! be provided to all parficipafing agencies when received by
Tarrant Counfy.
Participating e�tities may bill the financial afficer for reimbursement at such
pe�odic intervals as are appropriate and in accordance witf� the grant.

THEFT TASK FORCE FOR FY2�02 '
RECQMMENDATION:
It is recommended that the City Council:
1. Autharize the City Manager to renew the interlocal agreement with the Tarrant County Auto Theft
Task Force for FY20p2; and .
2. Authorize the agreement to begin October 9, 2001, and expire September 30, 2�02, with options to
renew for five additional ane-year periods.
D15CU5S[ON:
The Cify of Fort Worih �as been an active participant in the Tarrant County Auto Theft Task Force
program since 9 993, The program is funded by the Texas Auto Theft Preventian Authority, which
reimburs�s Tarrant Coun#y for part af the cvst of the task force.
Currently, nine municipal poiic� ager�cies, the Tarrant County Sheriff's Departmer�t, a�d the Texas
De�artment af Public Safety participate in t�e task force and are partially reimbursed for the
par�icipation of the�r staff. The Fire Department �as one arson inwest�gator and t�e Palice Departmen#
has one sergeant ar�d one detecti�e assign�d ta t�e task force with 80% of their salary and ber�efifs
r�imbursed by the grant.
The task �orce implemer�ts a caordinated �nd caoperative auto t�eft enfarcemen# �perativrt that �
includes the investigation of auto thefts and sales �f stolen parts.
RENEWAL OPTI�NS - This agreement may be renew�d for up to fi�e successive ane-year terms at
the C'rty's optiar�. Renewal does not require specific City Council approval provided that the City
Council has appropriated suffici�nt funds to satisfy the City's abligations during the renewal term.
FISCAL fNFORMATIONICERTIFICATION:
The �inanc� Di�ector certifies t�at the Police Department is res�onsible far the collection of revenues
under this agreement.
