The unciersigned DEVELOP�R has familiarized himself wikh the City of Fort Worth's "Poficy far
the Installat9on of Community Facilities" gaverning street paving, storm drain, street lights, and
street name signs faeility installations and fully understands all the provisions, terms and
conditions af that policy, and wisF�es to exercise the option contai�ed in that palicy permifting a
DEVELOPER to let his own contracts for canstruction of such str�et paving, starrn drain, stre�t
ligE�ts, and sfreet name signs. �
In adciition to all other requirements of the City's Poiicy for the Insiallation of Community Facifities,
the DEVFLOP�R specifica!]y agrees to follow fhe procedures set forth below: �
1. To employ a construction contractor wha is approved by the Director Transportation and
Pubfic WorEcs Department and who is iicensed and bonded to da work in public streets.
2. To require the Contractor to f�rnish the City of Fort Worth dual obligee performance and
payment bands in the name of the �EVELOPER and the Ciiy, and, if required, a maintenance
bond in the name of ihe City an forms provided by the City, for 'k 00% af the contract price of the
facifity, said performance, payment, and maintenance bonds to be furnished to the City before
work is commenced.
3. D�VELOPER sha11 pay ta the Cify in cash for the construction inspection a fee equal #o kwo
�ercent (2%) of f�te DEVELOPER's share of the construcfion cost of relatec� street, storm drain,
streetlight andlor street sign facifities as staked in the construction contract.
4. To require the Contractar to give 48 hflurs noiice to Director of the Department of
Engineering priar to commencing construction of the facility or facifities so that inspectian
personnel will be a�ailable.
5. To make khis agreement, as well as fhe Standard Specifications for Stree� and 5torm Drain
Construction an integra! �arE of any contract with a contractor to cor�struct any or all of the
facilities involved.
6. To require the Contracior to allow tf�e construc�ion to he subject to inspection at any and all
times by City inspection forces.
7. To require the Con#ractor to have such labaraiory tesis made as the City may r�:quir�.
8, To secure approval by the Director of #he Engineering Depa�tment of any and all partial and
fina! payments to the Cantractor, such aparoval to periain only ta satisfactory completion of the
work for which paymeni is made and not to constitute appravai of the quant�ties on which
payment is based.

9. To furnish simultaneously with tF�e execution a# the consfruciian confract let by the
�EVELOP�R a develo�er's bond in the name of the Ciry af one hundred percent (100°!0) of the
estimated contract cost of the r�lated communify facilifiies, as stated in the construe�ion contract,
1 D. to guarantee timefy payments to the Cantractor for cornpleted work andlor to guarantee
satisfactary performance of this agreement and substantia] completion of the community facilities
fo be installed. 1n lieu of the developer's bond, the DeWeloper may deposit cash ane hundred
twenty-five percent (125%) of the esfima�ed DEVEL�PER's share of the cost of the com�nunity '
facilities.
1 i. D�VEL�PER agrees to camplete all khe improvem�nfs covered by this agreement within 90
calendar days after hav9ng been instrucfed ta do so, in writing, by the Cliractor of Transportation
and PUblic works. It is understood that the D�VELOPER will initiat� th� consfructian of all
improv�m�nfs fo conform to his own schedule, except far those irnpro�ements which the
Transportation and P�bIEc Works Director deems necessary for the proper and arderly
development of the area. 1n th� ��ent DEVELOPEF� fails to carry out any such instructions within
the 90-day period, the DEVELOPER gives the City the right to design and award a contracf, and
inspect the improvemenks in quesiion, and agrees to pay to the City prior to fhe award of the
contract, the amount of the low bid.
12. The DEVELOPER further co�enants anc! agrees to, and �y these presents does hereby, fu[ly
indemnify, hold harmless and defend th� City, its officers, agents and employees from all suiis,
actions or claims af any character, whefher reaf or asser�ed, brought for or on account of any
injuries or damages sus#ained by any persons {including death) or to any Qroperty, resulting from
or in connection wifh the construction, design, perFormance or compfetian of any wark to be
perform�d by said DEVELOPER, his contractors, subcontractors, afficers, agents ar employees,
or in consequence of any failure to properly safeguard the wark, or on account of any act,
intentional fl� otherwise, negiect ar miscanduct of said QEV�LOPER, his contractors, sub-
cantractflrs, officers, agenis or emplayees, whether ornat such iniuries, death or dama.aes
are caused, rn whole ar in part, bv the allea►ed nepliqence oi the Cifv of Fort Warth, its
officers, servanfs, or emplovees
13. It is expressly understood and agreed by fhe parties hereto that execution of this agreement
does not bind the City of Fork Wor#h to participate in or confr9bute ko the cast of a�y of the
improvements describ�d herein; nor shall the City of Fort Warth be responsibfe or liable for any
portion of khe costs incurred by the DEVELOPER, its officers, agents, employees, contractars or
sub-contractors for the design and construction of the improvements described herein, unless
and until the parties hereta execute a Formal Community Facilities Agreement, duly authorized by
the City Council at a regular rneeting, signed by the City Manager, and pro�Eding for the Ciiy's
Participation in the costs af said improvernents.

the approximat� locations shown in E�hibit "C", immediately after
final acceptance o� the street coz�.s��uction, in accordance �rz�h
engin�ering plans and specif�cat�ons approvad by the Transportat,ion
and Publ.ic Works Department.
2. Streetlights an residential and /ar collector s�reets can be
instal.led using overh�ad or undergroun.d conductors with the approva.l
o� the Direc�or of Transporta�ian and Pub�ic Works.
3. Stree�.ligh�� on, ar�exa.al, streets sha1.I. be installed with undex'graund
conduit and conductors.
4. Th� Dev�loper shall provide for the installation of a 2--inch
schedu�.e 40 PVC conduit at a depth nat Iess than 30 inches and at
least�l8-inch behind the curb, "�1ear from a11 other utili�ies".
5. The Deve�.aper sha1l provide for the installation of a 2-inch
schedule 40 PVC condui� between streetl.i.gh�s propased �o�
installation and the power source to become aperational.
b. A 3-inch schedule 80 PVC condui� is required when crossa.ng ��x'eets
at a depth not less than 30 inches, unleas indicated otherwise on
�he plans cor�.c�ete pu11. boxes shall be provided at the crossing
points.

street Iight construction in accardance with appraved plans.
S. The d�v�loper or their cQntractor shall contact City's street light
di'visxon 48 haurs prior to starting any instal.lation of conduit
and/or streetlights at (817) 87.1--8100 to insure proper inspection of
work.

RECOMMENDATION:
It is recommended that the City Cauncil autharize tihe City Manager fo execufe an Informal Commun�ty
Facilities Agreemer�t wi#h multiple developers for the installation of street lighis and street name signs for
McPherson Ranch, Phase I; Shadow Gfer� Estates; Heritag� Glen, 5ection 2; and Vista Greens, Phase I.
D15CUSSI�N:
�n Decemb�r 19, 2000, the City Cauncil adopted a resolution authorizing tne issuance of $45 million in
Certifiicates of Obligation ta address critical capital projects which included $2.5 million in development
funds to suppiement tf�e 1998 Capitai Improvement Pragram new develapment funds.
On March 20, 2001 (M&C G�13181), the City Counc�l a�pro�ed the amendment of the "Policy for the
lnstallation of Community Facifities" and an ordinance establishing unit prices for City participation in
community facilities agreements. These recommendations includ�d G�ty participation of all wiring and
street light fixtures, and the cost for installation of standard street name signs on public streets. Ti�e
City pays 75% for street lights and 10a% for street name signs.
