The undersigned �EVELQP�.R has familiarized himseff witY� tF�e City of Fort Warth`s "Policy for
the Installation of Community �acilities" governing street paving, storm drain, street lighks, and
street name signs facility insfallatEans and fiully understands a1! the pro�isions, terms and
conditians of that poGcy, and wishes to exercise the option cantaine� in that policy permjt#ing a
D�V�LQP�R to let his own contracts for construction of sueh street paving, storm drain, stre�t
lights, and street name signs.
In addition to all ofher requirements of the City's Policy far the Installation of Comm�niiy Facilities,
the DEVELOP�R specifically agrees to follow the procedures set forth below:
1. 7o employ a consfruction confractor who is approved by the Director Transpor�ation and
Public Works Department and who is lic�nsed and bonded ko do work in public streets.
2. To require the Contractnr to furnish the City af Fart Worth dual o�ligee performance and
pay�-nenf bonds in the name of #he �EVELOPER and the City, and, if required, a maintenance
bond in the name of the City on forms pravided by the City, far 100% of the contrack price of the
facility, said performance, paymant, and maintenance bonds to be furnished to the City before
work is commenced.
3. pEV�LOP�R shal! pay to the City in cash for the construction inspeckion a fee equal to two
percent {2%) of tf�e []�V�LOPER's share of the construction cost of related street, storm drain,
streetlight andlor street sign facilities as stated in the construction confr�ct.
4. To require the Cankractor to give 48 hours natice to Directar af the Department af
�ngineering prior to commencing construction of the facility or facilities so that inspectian
personne! will be availa�le.
5. To make this agreement, as well as the Standard Specifications for Street and Storrn ❑rain
Construction an integral part of any contract with a contractor to construct any or all of the
faciliti�s involved.
6. To require the Gontractor to allow the canstruction to be subject to inspectivn at any and all
times E�y City inspection forces.
7. To require the Contraetar to ha�e such laboratory tests made as the City may require.
8. To secure apprava! by the Director of the �ngineering Department of any and all partial and
final payments to tne Contractor, such appro�al to pertain only to satisfactory complekion of the
work for which payrnent is made and not to constitut� approval af the quanfities.on which
payment is based.
9. To furnish simultaneausiy with the execukian ofi the consiruction contract let by the
DEVELOP�R a deueloper's bond in ihe name of the City of one hundred percent (10D%} of the
estimated cantract cosf of the related community facilities, as stated in the construction cantract,

estimaked contract cost of ihe reiated community Facilikies, as skated 9n the construction contract,
i 0. ta guarantee timely paymenks fo t�e Contractor for cam�leted wnrk andlor ta guarantee
satisfactory perFormance of this agreement and substantial completion of kh� oommunity facilities
to be inskalled. In lieu of the developer's bond, the Developer may deposit ca�h one hundred
kwenty-fve �ercent {� 25%) of th� estimated bEVELOPER's share of khe cast of lhe communiky
facilities.
11. DEVELOPER agrees to complete all k{��_ Improvements covereti by this agreement within 90
calendar days after having been instructed t� do so, in writing, by the di�ectar af�Transportat�on
and Public works. ik is understood that the �EVELOPER will initiate t�e construction of all
improvements to conform to his own schedule, except for thase improvements +rr�ich the
7ranspo�tation and Public Warks Oirector deems necessary for kf�e proper and orderly
development of the area. !n the event p�VELOPER fails to carry aut ar�y such instructians wit�in
the 90-day period, the DEVELOP�R gives the Ciky the right to design and award a contract, and
insPect the improvemer�ts in question, and agreas io pay to the City pr9or to the award af the
eontract, t�e amo�nt of the low bid.
�2. The D�V�LOP�R f�rther covenants a�d agrees to, and by these presents does he�eby, fully
indemnify, hold harm�ess and defend the Ciky, its o�cers, agents and emp�oyees from all suits,
actions or claims of any ct�aracter, whether rea! ar asserted, brought for ar on account of any
injuries or damages sustained by any.persons (including death) or to ar�y property, resulking frorri
ar in conneckion wiih the consiru�kion, design, perFormance or compietion of ar�y work to be
performed by said DEVELO�'�R, hls confractors, subcontractars, officers, age�ts ar employees,
or in consequence of any failure to properly safeguard tt�e wo�lc, ar on accou�f of any act,
intentior�al or otherwise, negieck or misconduct of s�id D�VEI.�PER, his contractors, sub-
contractors, afFicers, agents or emplayees, whefher or not such inluries. deafh or damaaes
are caused, irr whole ar in nart. bv the alleaed nealiaence of ihe Citv of Fort Worth. its
afficers. servants. or emplovees
9 3. It is express{y understood and agreed by the partEes he�eko that execution of this agreement
does not bind the City of Fort Worth ta participate 9n or contribute to the cost of any of the
improvements described herein; nor shall ti�e City of Fort Worth be respansib[e ar liable for any
portivn af the cbsts incurred by the DEVELOPER, its officers, ag�nks, employees, contractnrs or
sub-contractors for the design and construction oF the improvements described herein, unless
and until the parties hereto execuke a Formal Cammuni#y �acilities Agreement, duly a�tnorized by
the City Council at a reg�{ar meeting, signed by the City Manager, and providing for the City's
participation in the costs of said Emprovements.

2. STREET LIGHTS WORK DESCRZPTION:
1.. The Developer shall provide for the ins�allation o� s�reetlights a�
�he appxo�imate l.ocatians shown in Exhibit "'C", immediately after
final acceptance o� �he s�ree� cons�xuction, in accordance with
engixieering plan� and specifications approved by the Transpoacta�io�
arzd Public Wa�lc� Department .
2. Stree�lights on residential and /or collector streets can. be
installed using overhead or tutderground conductox's with the approval
of �he D�.rector of Transportation and Public Works.
3. S��'ee�lights on arterial streets shall b� inetalled with underground
conduit and conductars.
4. The De�reloper shall provide fo� the installation of a 2-inch
schedtkle �4 PVC conduit at a depth not le�s �.han 30 inches an.d at
least 18-inch behind tha curb, "clear frotn all other utilities".
5. The De�relope� sha11 �rovide for the installation of a 2-inch
sch�:dule 40 PVC conduit between streetlights propased for
iris�all.ata.om. and the power souree to become op�ratianal.
6. A 3-xnch schedule 80 PVC conduit is required when crassing streets
at a depth npt less than 34 inches, unless indicated otherwise on
the plans concret� pull boxes shal.l be provided at the crassing
paints.
7. Streat light conduit and footir�gs sha�.]. be installed by the
developer`s aontracto� as part of and at the time of street
cox�s��ucta.nn. The city will obtain electric service and complete the
street 1.ight construction in accordanee with appro'v'ed plans.
8. The develaper or their Contractor �hall contact City's street light
division 48 hours prior to starting any ins�.aXla�i.a� of condui.t
and/or streetlights at (817) 871-8100 to insure proper inspection of
work.

RECOMMENDATI4N:
lf is recommen�ed that the City Council authariz� the City Manager to execute an Infarmal Community
Facili#ies Agreement with multiple developers for the installation of street lights and street name signs for
McPherson Ranch, Phase I; Shadow Glen Estates; Heritage Glen, S�cfion 2; and Vista Greens, Phase I.
DISCUSSION:
On December 19, 2000, the City Council adopted a resa[ution authorizing the €ssuance of $4� million in
Certifica#es of Obligation ta address critical capital projects which included $2.5 million in development
funds to suppl�ment the 1998 Ca�ital Improvement Program new de�elo�ment funds.
On March 20, 200� (M&C G-13181), the City Cou�cil appro�ed the amendment of the "Policy for the
Installation af Community Facilities" and an ordinance establishing unit prices for City participation in
community faci[ities agreeme�ts. These recommendations included City participatian of all wiring and
street light fixtures, and the cost for installation of standard street name signs on pubiic streets. The
Cify pays 75% for street lights and 100% for street name signs.
