In addition to all ofher requirements of the City's Policy far the Installation of Comm�niiy Facilities, the DEVELOP�R specifically agrees to follow the procedures set forth below: 1. 7o employ a consfruction confractor who is approved by the Director Transpor�ation and Public Works Department and who is lic�nsed and bonded ko do work in public streets. 2. To require the Contractnr to furnish the City af Fart Worth dual o�ligee performance and pay�-nenf bonds in the name of #he �EVELOPER and the City, and, if required, a maintenance bond in the name of the City on forms pravided by the City, far 100% of the contrack price of the facility, said performance, paymant, and maintenance bonds to be furnished to the City before work is commenced. 3. pEV�LOP�R shal! pay to the City in cash for the construction inspeckion a fee equal to two percent {2%) of tf�e []�V�LOPER's share of the construction cost of related street, storm drain, streetlight andlor street sign facilities as stated in the construction confr�ct. 4. To require the Cankractor to give 48 hours natice to Directar af the Department af �ngineering prior to commencing construction of the facility or facilities so that inspectian personne! will be availa�le. 5. To make this agreement, as well as the Standard Specifications for Street and Storrn ❑rain Construction an integral part of any contract with a contractor to construct any or all of the faciliti�s involved. 6. To require the Gontractor to allow the canstruction to be subject to inspectivn at any and all times E�y City inspection forces. 7. To require the Contraetar to ha�e such laboratory tests made as the City may require. 8. To secure apprava! by the Director of the �ngineering Department of any and all partial and final payments to tne Contractor, such appro�al to pertain only to satisfactory complekion of the work for which payrnent is made and not to constitut� approval af the quanfities.on which payment is based. 9. To furnish simultaneausiy with the execukian ofi the consiruction contract let by the DEVELOP�R a deueloper's bond in ihe name of the City of one hundred percent (10D%} of the estimated cantract cosf of the related community facilities, as stated in the construction cantract, -1 � ,� � ..� :�U� � ) , �_ � 9. In lieu of the developer's bond, the Developer may deposit ca�h one hundred kwenty-fve �ercent {� 25%) of th� estimated bEVELOPER's share of khe cast of lhe communiky facilities. 11. DEVELOPER agrees to complete all k{��_ Improvements covereti by this agreement within 90 calendar days after having been instructed t� do so, in writing, by the di�ectar af�Transportat�on and Public works. ik is understood that the �EVELOPER will initiate t�e construction of all improvements to conform to his own schedule, except for thase improvements +rr�ich the 7ranspo�tation and Public Warks Oirector deems necessary for kf�e proper and orderly development of the area. !n the event p�VELOPER fails to carry aut ar�y such instructians wit�in the 90-day period, the DEVELOP�R gives the Ciky the right to design and award a contract, and insPect the improvemer�ts in question, and agreas io pay to the City pr9or to the award af the eontract, t�e amo�nt of the low bid. �2. These recommendations included City participatian of all wiring and street light fixtures, and the cost for installation of standard street name signs on pubiic streets. The Cify pays 75% for street lights and 100% for street name signs.
