In addition to all ather requirements of the City's Policy for the Installatian of Community Facilities, the DEVELOPER specifically agrees fo foilow #he proc�dures set forth beEow; 1. To employ a construefion contractor who 9s ap�roved by the Direcfor Tra�spor#atian and Public Works Department and who is 19censed and bonded ta do work in public streets. 2. To require the Contractor #o furnish the City af Forf Worth dual obligee perFormanc� and paym�:nt �onds in the name of khe DEVELOPER and the City, and, iF required, a maintenance bond in the narne of the City on forms provided by the Ciiy, for � QO% of the cantract price of the facilily, said perforrnance, payment, and mair�tenance bonds to be furnished to the City before work is commenced. 3. DEVELOPER shall pay to #he City In cash for lhe construction inspecfio� a fee equal fo two percenf (2%) of the DEVELOPER's share of the construction cost of related street, storm drain, streetlight andlor street sign facilities as stated in the construction contract. 4. To require the Contractor ko give 48 hours nokiee to Director af the Department of Engineering prior to commenci�g consfr�ckion of the facility or facilifies so that inspection personnel will be available. 5. To make this agr�emenl, as wel� as ihe Standard Specifications for 5tree# and Storm brain Construction an integral part of any contract with a contractor to construct any or all of the facilities invoEved. 6. To require the Con#ractor ta allow the construction to be subject to inspection at any and all fimes by City inspecfion farces. 7. To require the Contractor to have such IaboraEory tests made as the City may require. 8. To secure approval by the I]irector of the EnginEering Department of any and ail partial and finaE payments to the Confractor, such appravai to per#ain only to satisfactory completion of the work for which payment is made and nat to cvnstitute approvaf of the quantities an which paymeni is based. 9. Ta furnish simultaneously with the execution af the construction contract let by the DEVELOPER a developer's bond in the name of the City of one hundred pereent (100%) of ihe estimated contract cost af khe related communi#y faciiifies, as stated in the constructio�r contract, ��1�� 1� !"#" �19,fY` 10. ta guarantee timely payments fo the Contractar for completed work andlor to guarankee satisfactory performance of this agreement and substantial campletion of the communiky facilitiss ta be instalEed. In lieu of khe developer's bond, lhe Developer may deposit cash one htandred twenty-five percent (125%) of the estimated DEVELOPER's share of the cos# of the community facilities. 1�. D�VELOPER agrees to complete sll the improvemants covered by this agreement within 90 calendar days after havir�g been instructed to do so, in writing, by the Director of Transportatian and Public works. It is understood that the DEVELOP�R will initiate the construction of all impravemer�ts ta conform to his own schedule, except for thase impravements which #he Transportakion and Public Warks Director deems necessary for the proper and orderly developmeni of the area. In the s�ent DEV��OP�R fai{s ta carry out any such instrucilons within the 90-day period, the DEV�LOP�R gives the Ciky the right to design and awa�d a contract, and inspect the improvements in queskion, and agrees #o pay to the City prior ta fhe award of the contract, khe amount of the low bid. 12. D15CUSSION: On December 19, Z000, the City Council a�opted a resolution authorizing the issuance of $45 million in Ce�iificates af Ob[iga�ion to address critical capital projects which includ�d $2.5 million in development funds to supplement the 1998 Capital lmprovement Program new developmeni funds. On March 20, 2001 (NI&C G-13181), the City Council approved the amendment of the "Policy for the Installation af Comm�niiy Facilities" and an ordinance establishing unit prices for City participation in community facilities agreemenfs. These recommendations included City participation of alf wiring and strest li�ht fixtures, and the cosi for installation of standard street name signs on public streets. The City pays 75% for street lights and �DO°/4 for street name signs.
