INTERLOCAL AGREEMENT
BETWEEN THE CITY OF ��RT W4RTH AND TARRANT COUNTY
FOR AN AIR POLLUTYON CONTROL PROGRAM
THIS AGREEMENT i� �t�tered into by and between the City of Port 'Worth, Texas, a
home-rule municipal corporation sit�zated in Tar�-ant and Denton Counties, Texas, ("City"),
ac�ing here�n by and through Libby Waison, its duly authorized Assistant City Manager and
Tarranr County, Texas, ("County") acting herein by and through Tom Vandergrif�, its duly
authorized County rudge, as clirected by the Commissionexs Court of Tarrant Caunty, Texas.
WII�REAS, Article 3, Section b4, of the Texas Constitutian and the Intez'local Coopera�ion Act
(Chapter 791 of the Texas Government Code) aut�orize counties and cities in the State af Texas
to cantract with one anather far the performance of various govez�nmental fu�ctions and services,
including those in the area af gublic hea�th at�d wel�are; and
WHEREAS; the City of Fart WartY� and Tarrant County, pursuant to the Constitution and the
laws of the State of Texas, desire to make and enter into a contract whereby the City af Fort
Worth will retain its Air Po1lu�ion Cantrol Program and make available to t�►e County certain air
�ollutian tes�ing for Fiscal Year 2003;
N4W THEREF�RE, IT IS AGREED AS �'OLLOWS:
1.
City shall provide the following serVices to County:
A. New Source Reviews/i'ermits - provide comment on permit applicaiions
submitted ta the 'Texas Comtnissian on Environm�ntal Quality ('Z'C�Q) and
monitor permit compliance;
B. Fie�d Inspection - conduct xnspectians on a11 emission sources and new source
performance siandards. Investigate alI complaints and send reports to the TCEQ;
C. Respond to citizen camplaints associatecl with air �oll�tion from industrial
aetivities, eonstruction projects, �ehicle emissians and ather outdoor
containm�nts;
D. Provide, on a daily basis, the po�lutant standard zndex for ozone to local nnedia;
and
E. Cond�et monitoring for particulate emissians for compliance with tlxe sta�dard
and report the index to �he local media.

2.
This Agreement covers the unincorporated areas of the County. Services specified in Section �
will be provic3ed as requested by the County rudge or the Judge's designee. The Cxty shall
submit the names af the violators to the TCEQ to take any enforcement acCian tY�e TCEQ
believes is warranted.

This Agreement shall be valid from Dctober 1, 2002 ihraugh September 30, 2003.

As fair compez�sation to City for providing the services pursuant to this Agreement far the
County, County hereb�r agrees to pa�y �Q City �e sum of thirty-six thousand two h�ndred sixty
dollars ($36,260.Q0}, which shall be paid in equal quarterly installments of nine khousand sixty-
five (�9,065.00) due on December 31, 2002, Max'ch 31, 2003, June 30, 2QQ3 and Septern�er 34,
200�. Payment hereunder shall be made from current xe�enues available to the County.

Czty will pra�ide County with q�aarte:rly reports af activ�ties perforrned pursuant to thzs
Agreement.
6.
Ciiy is an in.c�ependent contractor under the terms o� this Agreement and is nat an officer, agent,
servar�t or �mployee of the Cou�ty.
7.
This Agreement cantains aIl coznmitments and Agreements of the parties hereto, and no other
aral vr �i+ritten cQmmitments shall ha�e any farce or effeei if not contained herein, except that
this Agreement can t�e a.mended or modxfied by the parties if such amendment or madification is
in writing and signed by City and Connty.

RECOMII�'IENDATION:
1t is recommended that the Cify Co�ncil:
9. Authorize the City Managsr to execute a contract with Tarrant County in an amount nat to exceed
$36,260 for the Air Pollution Control Program for FY2002-2QQ3 far the periad of Ocfober 1, 20Q2,
through September 30, 2003; and
2. Adopt the attach�d appropriation ordinance increasin� estimated receipts and appropriations in the
Grants Fund by $36,260.

For the past several years, the City and Tarrant County have entered inta an l�terlocal Agreement for
air pollution control services in the unincorporated areas of Tarrant County. On January 17, 2003,
Tarrant County appraWed this agreement fior fhe period of October 1, 2�Q2, througY� September 3D,
20�3. During the period of the contact, the City wiil make the fol[owing services available to the
unincorporated areas of Tarrant County:
� IUew sources reviewlpermifs; and
o Field inspectians; and
o Response to citizen camplain�s associated wifh air pallution; and
� Provide the Pollutant Standard fndex for ozone to the local media; and
� Conduet monitoring for particulate emissions,
The services specified will be provided as requested by the County Judge or his designee. Tarrar�t
County has agreed #o pay the City $3�,260 fior these ser�ices.
FISCAL INFORMATI�NICERTIFICATION:
The Finance Director certifies that upon adoption of the attached appropriation ordinance, funds will be
available ir� the current operating budget, as appropriated, of the Grants Fund. The Environmentai
Ma�►agemeni D�par�meni is responsible for the collection of funds due to the City under this agreement.
