AN ORDINANCE ADJUSTING APPROPRIATIONS in THE 2022 BOND
PROGRAM FUND IN THE AMOUNT OF $ 295,000.00, BY INCREASING
APPROPRIATIONS IN THE SOUTH HULEN STREET AND OAKMONT
BOULEVARD HIGHWAY SAFETY IMPROVEMENTS PROJECT (CITY
PROJECT NO. 104039), AND DECREASING APPROPRIATIONS IN THE
TRAFFIC SIGNALS PROGRAMMABLE PROJECT (CITY PROJECT NO
PB0006.) BY THE SAME AMOUNT; PROVIDING FOR A SEVERABILITY
CLAUSE; MAKING THIS ORDINANCE CUMULATIVE OF PRIOR
ORDINANCES; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH;
AND PROVIDING AN EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH,
TEXAS:
SECTION 1.
That in addition to those amounts allocated to the various City departments for Fiscal Year 2023-2024 in the
Budget of the City Manager,there shall also be adjusted appropriations in the 2022 Bond Program Fund in
the amount of to$295,000.00,by increasing appropriations in the South Hulen Street and Oakmont Boulevard
Highway Safety Improvements Project(City Project No.104039),and decreasing appropriations in the Traffic
Signals programmable project(City Project No.P130006)by the same amount.
SECTION 2.
That should any portion,section or part of a section of this ordinance be declared invalid,inoperative or void
for any reason by a court of competent jurisdiction,such decision,opinion or judgment shall in no way impair
the remaining portions,sections,or parts of sections of this ordinance,which said remaining provisions shall
be and remain in full force and effect.
SECTION 3.
That this ordinance shall be incorporated into the ordinance effecting the budget of the municipal government
of the City of Fort Worth for the ensuing Fiscal Year beginning October 1,2023, and ending September 30,
2024, and all other ordinances and appropriations amending the same except in those instances where the
provisions of this ordinance are in direct conflict with such other ordinances and appropriations, in which
instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed.
SECTION 4.
This ordinance shall take effect upon adoption.

the Amount of$250,970.00 for the South Hulen Street and Oakmont Boulevard Highway Safety Improvement Project,Adopt Appropriation
Ordinances,and Amend the Fiscal Years 2024-2028 Capital Improvement Program(2022 Bond Program)
RECOMMENDATION:
It is recommended that the City Council:
1. Adopt the attached Resolution authorizing execution of an Advance Funding Agreement(CSJ#0902-90-212)with the Texas Department of
Transportation in the amount of$660,162.00 with Federal participation in the amount of$385,831.00, State participation in the amount of
$23,361.00 and local participation in the amount of$250,970.00 for the South Hulen Street and Oakmont Boulevard Highway Safety
Improvements project(City Project No. 104039);
2. Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the Grants Cap Projects Federal Fund,
subject to receipt of the Grant, in the amount of$428,701.00,of which$385,831.00 is Federal funding and$42,870.00 is City funding,
transferred from the 2022 Bond Program Fund,for the purpose of funding the South Hulen Street and Oakmont Boulevard Highway Safety
Improvements project(City Project No. 104039);
3. Adopt the attached appropriation ordinance adjusting appropriations in the 2022 Bond Program Fund by increasing estimated
appropriations in the South Hulen Street and Oakmont Boulevard Highway Safety Improvements project(City Project No. 104039)in the
amount of$295,000.00 and decreasing appropriations in the Traffic Signals programmable project(City Project No. P130006)by the same
amount;and
4. Amend the Fiscal Years 2024-2028 Capital Improvement Program.
DISCUSSION:
The purpose of this Mayor and Council Communication(M&C)is to adopt a resolution authorizing execution of an Advance Funding Agreement
(AFA)with the Texas Department of Transportation(TxDOT)in the amount of$660,162.00,of which$250,970.00 is City of Fort Worth's(City)
participation and authorize acceptance of Federal Grant funds and State funds in the amount of$385,831.00 for construction of the South Hulen
Street and Oakmont Boulevard Highway Safety Improvement project.(City Project No. 104039).
The scope of this project includes improving traffic signals,and constructing an additional northbound left turn lane at the intersection of South
Hulen Street and Oakmont Boulevard.
This project will be let by TxDOT in August 2024.The State is responsible for all construction activities within the scope of this project.The State
will be responsible for securing the Federal and State share of the funding required for the development and construction of the project. City funds
have been appropriated to this project for design, right-of-way,utilities and project management costs.The AFA will require Fort Worth to fund cost
overruns.At the end of the project,the asset will remain with the City of Fort Worth.

Funding is budgeted in the 2022 Bond Program Fund for the purpose of funding the S Hulen St&Oakmont Inter Imp project.
This project is included in the 2022 Bond Program. The City's Extendable Commercial Paper(ECP) (M&C 22-0607;Ordinance 25675-08-2022)
provides liquidity to support the appropriation. Available resources will be used to actually make any interim progress payments until debt is
issued. Once debt associated with a project is sold,debt proceeds will reimburse the interim financing source in accordance with the statement
expressing official Intent to Reimburse that was adopted as part of the ordinance canvassing the bond election(Ordinance 25515-05-2022).
Funding for this project was not included in the Fiscal Years 2024-2028 Capital Improvement Program(CIP)because the project and funding
sources were unknown at the time of its development.This action in this M&C will amend the Fiscal Years 2024-2028 Capital Improvement
Program as approved in connection with Ordinance 26453-09-2023.
Approval of recommendation 3 would adjust appropriations between a programmable project and convert the S Hulen St&Oakmont Inter Imp
project(City Project No. 104039)into a static capital project.This action is needed as future funding for S Hulen St&Oakmont Inter Imp
project(City Project No. 104039)is anticipated from other sources and the scope of this project differs from that of current programmable project.
This project is located in COUNCIL DISTRICT 6.
A Form 1295 is not required because:This contract will be with a governmental entity,state agency or public institution of higher education:Texas
Department of Transportation
FISCAL INFORMATION/CERTIFICATION:
The Director of Finance certifies that upon approval of the above recommendations and adoption of the attached appropriation ordinances,funds
will be available in the current capital budget,as appropriated, in the Grants Cap Projects Federal Fund and 2022 Bond Program Fund. Prior to
expenditures being incurred,the Transportation&Public Works Department has the responsibility to validate the availability of funds.This is an
advance grant.
