HomeMy WebLinkAboutContract 58594-A1CSC No. 58594-A1 AMENDMENT No . 1 TO CITY SECRETARY CONTRACT No. 58594 WHEREAS, the City of Fort Worth (CITY) and Mesa Design Associates, Inc., (ENGINEER) made and entered into City Secretary Contract No. 58594, (the CONTRACT) which was administratively authorized on the 15th day of December, 2022 in the amount of $ 96,850.00; and WHEREAS, the CONTRACT involves engineering services for the following project: Ciquio Vasquez Park Phase I Design, CPN 104195; and WHEREAS, it has become necessary to execute Amendment No.1 to the CONTRACT to include an increased scope of work and revised fee. NOW THEREFORE, CITY and ENGINEER, acting herein by and through their duly authorized representatives, enter into the following agreement, which amends the CONTRACT: 1. Article I of the CONTRACT is amended to include the additional engineering services specified in proposal attached hereto and incorporated herein. The cost to City for the additional design services to be performed by Engineer, which was authorized by M&C 23-0838 on the 26th day of September, 2023 in the amount of $431,810.00. (See Attached Funding Breakdown Sheet, Page -4-) 2. Article II of the CONTRACT is amended to provide for an increase in the fee to be paid to Engineer for all work and services performed under the Contract, as amended, so that the total fee paid by the City for all work and services shall be an amount of $528,660.00. 3. All other provisions of the Contract, which are not expressly amended herein, shall remain in full force and effect. DISCUSSION: The purpose of this Mayor and Council Communication (M&C) is to authorize execution of Amendment No. 1 to City Secretary Contract No. 58594 with Mesa Design Associates, Inc., in the amount of $431,810.00 for additional engineering services for design and development of Phase I improvements at Ciquio Vasquez Park (City Project No. 104195) for a total design contract in the amount of $528,660.00. Ciquio Vasquez Park is a 41.3-acre site formerly named Echo Lake Park. It is located north of Cole St. and east of Interstate 35, Monarch Highway. On December 15, 2022, an engineering services agreement (CS# 58594) was administratively executed for the design and development of the Ciquio Vasquez Park Master Plan. The master plan process included multiple public presentations/meetings that resulted in the final park master plan and phase I priority improvements. The master plan was presented and endorsed by the Park & Recreation Advisory Board on May 24, 2023. Some of the phase I priority master plan elements identified through the public input process include baseball fields, memorial for Mr. Ciquio Vasquez and police officer Patrick Zamarripa, playgrounds, trails, security lighting, picnic areas, and parking improvements. The City's Extendable Commercial Paper Program (M&C 22-0607; Ordinance 25675-08-2022) provides liquidity to support the appropriation. Available resource will be used to make any interim progress payments until debt is issued. Once debt associated with a project is sold, debt proceeds will reimburse the interim financing source in accordance with the statement expressing official Intent to Reimburse that was adopted as part of the ordinance canvassing the bond election (Ordinance 25515-05-2022) A Request for Qualifications was advertised/issued and subsequent Statements of Qualifications were received, evaluated, and scored by Park Recreation Department staff. All professional services submittals were included in the overall scoring, which was broken into six specific types of design. Assignment of design service on each capital project based on expertise & availability for specific project scope. Business Equity — Mesa Design Associates, Inc., is in compliance with the City's Business Equity Ordinance by committing to 11 % Business Equity participation of this project. The City's Business goal on this project 11 %. Funding is budgeted in the Park & Recreation Department's 2022 Bond Program for the purpose of funding the Ciquio Vasquez Park Phase I project, as appropriated. Ciquio Vasquez Park is located in Council District 11. FISCAL INFORMATION / CERTIFICATION: The Director of Finance certifies that funds are available in the current capital budget, as previously appropriated, in the 2022 Bond Program Fund for the 2022 Bond Ciquio Vasquez Park project to support the approval of the above recommendation and execution of the amendment.
