Pursuant to the Contract, contract renewals are at the sole option of the City. This letter is to inform you that the City is exercising its right to renew the Contract for an additional one (1) year period, which will begin immediately after the Expiration Date. DISCUSSION: This professional services agreement will provide waterway and watershed engineering consulting services. Related services include, but are not limited to, hydrologic modeling, pollutant load modeling and analysis, structural controls, permitting, technical expertise, watershed analysis, and engineering design of pollution control systems to meet site needs. This agreement will also provide specialized services as necessary to ensure projects meet all regulatory requirements. A Request for Qualifications was advertised on September 4th, 11th, and 18th, 2022. The City received one responsive submittal from Atkins North America, Inc. on October 6, 2022. The submittal from Atkins North America, Inc. was reviewed and selected based on demonstrated competence and qualifications as provided in the statement of qualifications in accordance with Chapter 2254 of the Texas Government Code. The Code Compliance Department anticipates spending $300,000.00 in Fiscal Year 2023 and funds are available within the existing appropriations for these expenditures. RENEWAL OPTIONS - This agreement may be renewed for up to four successive one-year terms at the City's option. Renewal may be affected by notice in writing by the City Manager, or his designee, to the contractor within 30 days of the expiration of the prior term. This action does not require specific City Council approval, provided that the City Council has appropriated sufficient funds to satisfy the City's obligations during the renewal term. Atkins North America, Inc. is in compliance with the City's Business Equity Ordinance by committing to 6% Business Equity participation on this project. The City's Business Equity goal on this project is 670. This agreement serves the entire City in ALL COUNCIL DISTRICTS.
