Genera.Z Requirements � A. Tlie Policy for �he Installation of Community Facilities ("Policy") dated March 2001, approved by the City Cauncil of th.e Cify of Fort Worth by M&C G-I3181, is hereby i�co�porate�. into th�is Cox�utaity Facilities Coniraci as if copy hereiri verbat�m. DeveZoper agrees to comp�y with all pravisions of said Policy in the perforrnance of its duties and obligations hEr�under. B. The requirements of the Policy sYzall govern tbzs Community Facilrties Agreement, provided, howevEr, that any conflict befi�een the terins of this Comrnuni�y Fa.cilities Agreemeni and the Palicy shall be r�solved in favor of this Agreex�nent. Deueloper shail coxnpetitively bid all work for the public infrastructure and comply with t�e z'eq�i.re�xzents of Chapter 252, Texas Lacal Government Cade. E. The eontracts for the canstruction of the public infrastrr.tcture shall he administered in conformance with paxa�raph 8, Section II, of the Policy. F, Developer hereby releases and halds the City haz�nless for any respansibilities far any inadequacies in fih.e preliminary plans, speczfications and cast estimatEs supplied by �he Developer �or tk�is cantract. G. Developer shall install oz adjust alI af ihe required u�iiities to serve the Property or to construct Y.�ie iznpxoveznents required herein. H. Developer agrees that no .consY.ruction o� the comznurkity facilitzes contezz�plated by this Com�nunity Facilities Agreerrient will begin priar to City Council appraval. L. It is agreed for any increase in the cost of the public infrastructure that is related to a request franr� Developer to change the scape af work or that would resu�.t in an increase . in the cost of the public infrastruct�-e necessary to provide service to the Property must be approved in writing by the City and ihe Developer p�rior to such deviation. S�xch inerease in constni.ction costs shall be ihe respor�sibiiity of the Developer. Any incxease in the cost to the public inirastructu�re due to conditions er�cauz�tered during constructiorz shall be borne by City azxd Ueveloper eacb i.xa accordance with the pa.rticipation outlir�ed on page 4. The Developer shall r�ot be obliga��d for any costs associated with chan�es in the scope of tk�e project rec�uested by the Ci#y, except to ihe extent sucb changes are necessary to serve Developer's praperiy. II. Wa�er and �ewer Facilities A. Developer sha11 install, at its expense, the proposed water Ii.ne(s), fire �ine(s) andJor meters as shown on Exhibit A, the estimated cQs� af which is $�'�,8x0. The City ag�-ees to record the lacatzon of each sard service line in respeci to the corner of the lot served, and to retain said records in its possession. B. Developer shall install sarutary nriain as shown on E�ubit A�., the estimated cast of which $9,380. The Developer and the City shail share ihe cost of this �acility. The.
