WHEREAS, the Tarranf County Elections Administrator is the Caunty Officer in charge of Tarrant
County election duties; and
WH�REAS, the Ciiy� af Fort Worth is a home-rule municipal corporation located in Tarrant, Denton,
and Wise Counties; and
WHEREAS, th� City of Fort Worth is scheduled ta hofd tY�e Farf Wor�h City Council Election on
May 3, 20D3; and
WHEREAS, �he Cify and the Coun#y have deie�mined that it is in fhe public interest of the inhabitants
of the City of Far� Warth tha# the followirtg contract be made and entered into fior the purpose of having
Tarrant County furnish �o the City of Fort Worth certain election services and equipment ne�d�ci by the City
to canduct its electian on May 3, 2003.
NOW, TH�REFORE, KNOW ALL MEN BY TH�SE PRESENTS:
That the City of Fort Worth, a home-ru[e munici�al corporation located in Tarrant, Denton, and Wise
Counties, acting herain by and through its duly authorized City Manager, hereinafter referred to as "City",
and Tarrant Count�, acting herein by and through iis duly authorized Elections Administrator, hereinafter
referred to as "Caunty", do hereby ca�enant and agree as fol[ow:
DUTIES AND SERVICES OF TARRANT COUNTY.
The Tarrant County Elections Aciministrator agrees to coardinate, supervise, and handle all aspecfs
of administering the �art Warth City Council Election in accordance with the pro�isions of Section
31.092, of the Texas Election Cade and as outlined in this Agreement.
The County shaf{ be responsible for performing the following duti�s anci shall furnish the following
ser�ices and equipmenf:
(a) Arrange for the nntification, train�ng, and compensa�ion of all presiding judges and
alternate judges, as recammended by the Ciiy, and of all clerks, and th� judge of
the Central Couniing Station, subject to appro�al of the City.

The Elections Admir�istrator will be responsible for noiifying each election judge and
alternate judge of his or her appa�ntment and for determining the number of clerks
and oth�r el�ctian workers authorized to work at each voting focation. Eleciion judges
shall be responsible for picking up election supplies and materials at the place deterrnined
L�y the Tarrant County Eleciions Administrat�r.
(b) Pay cast of election judges and clerks.
(c) Procure, prepare, proof, and distri�ute ballots.
(d) Procure, prepare, and distribute election judge kits and pra�ide training.
(e} Procure, prepare, anci distribute fables and chairs, transport equipmer�t to and from
fhe polling places.
(f} Pracur� and defiver to pollir�g places all OPTECH �AGLE equipment. The rental
cost shafl include programmEng, preparation, delivery and pick-u� af equipment,
use of bal[ot boxes, and use of voting booths.
(g) Arrange for the use of voting piaces.
The Electians Acfministrator will select and arrange for the use of and paymer�t of
all �oting focations, subject to the approval of the Fort Worth City Couneil.
Vating �ocations will be, whene�er possible, those Iocatians iisted on Exhibit "A"
of this Agre�m�nt. Voting pr�cincts may be combined upon the approval of the
City Council. In the event a voting location is not a�ailable, the �lections Administrator
will notify fhe City of any change from the lacatians listed on Exhibit "A". At such time
as commitments far voting locations in all precincts are secured, the Elections
Administrator sha11 furnish the City a list of all such locations and their corresponding
precincts for finaC approWaE by the City CounciL Thereaf�er, fhe El�ctions Administrator
immecfiate[y shall notify the City of ar�y changes to the final list.
The final list of �ofing locations secured by the Eleciians Administrator wilf be
furnished fa the City when camplete.
(h) 5upervise the conduct of early voting in person and by mail and su�ply personne! ta
serve as Deputy Early Voting Clerks.
Robert Parter�, Tarrant County Eiections Administrator, will serve as Early Voting Clerk
in compliar�ce with Sections 83.001 and 83.005 of the Texas Election Code. Glaria
Pearson, For� W�rtf� City Secretary, w�ll serve as Chief Deputy Early Voting Clerk.
Other De�uty Early Voting Clerl�s uvill be appointed as ne�ded to process early voting
mail and to conduct early �ating at �he branch early voting locations by use of Direct
Recording Electronic (DRE) voting systems.

Extended hours for early voting shall take place at all early voting si#es on Saturday,
Monday, and Tuesday, April 26, A�aril 28, and Aprif 29, 2003 from 7:00 a.m. #o
7:0� p.m. each day and Sunday, April 27, 2003 fram 11:40 a.m. to 4:00 p.m.
Any person eligible to vote �arly by personal appearance may do sa at ar�y one of
the early v�ting locations on Direct Recarding Electronic (DRE) equipment.
(I) Afl requests for early �oting ballots by mail that are received by the City will be
firansported on the day of receipt to the Office of the Tarra�t County Electians
Administratar far processing. Persons voting by mail will send their marked ballots
to the Office of the Tarrant County �Iections Administrator.
(j) All early �oting ballots (those cast by mail ar�d those cast by DRE personal appearance),
will be prepared far count by an Early Vating Ballot Board appointed by #he City in
accordance with 5ection 8i.001 0# the Texas Efection Code.
(k) Arrange for use of a Central Counting Statian ancE for ta6ufating personnel and
equipment needed at the Counting Station and assist in preparatian of programs
and test materials for tabulation o# the ballots ta be �sed with electronic vofing
equipment.
{I} Provic{e legaf natice of the date, time, and place of the tes#ing of the electronic
tabulation equipment and conduct such testing.
(I} Supervise the handling and disposition of electian returns, voted ballois, etc., and
tabulate afficial returns ancf assist in preparing t�e tabulation for the afficial canvass.
Each precinct judge will bring the votecf ballots, the electivn returns, and supplies
to the Central Counting Statian ai the Tarrant Caunty Courthouse or designated
county building immediately after the polls close on election day.
The Tarrant County Elec#ia�ts Administrator wiil be responsible for establishing and
aperatir�g the Central Caunting Station ta receive and tabulate the voted ballots in
accordance with the pro�isions af the Texas Election Code and of ihis Agreement,
Section 127.002, Counting Station Manager, Ra�ert Par�en, 5ectior� 12T.OD3,
Tabulation Supervisor{s), Chris Walker and Gayle Hamiltan, Section 127.Oa4,
Assistant Tabulation Supervisor, Germaine 1Nlliams; Sectian 127.OQ5, Presiding
Judge for Caunting Sfation, Jeanne Lyon.
The Manager ofi the Central Counting Station will deliver to the City timely cumufative
re�arts of the electian results as precincts are tabulat�d. The City Secretary af the
City wiEl be responsible for releasing to the media and the ger�eral public, cumulati�e
totals and precinct returns from the election. The place of release will be the office of
the City Secretary, City of Fort Warth, 1000 Throckmorton Sire�t, Fort Workh, Texas
76142.

T�e Caunty Elections Ac[ministrator will prepare the uno#ficial can�ass report after
all precincts have been counted, and will deliver a copy of the unofficial canwass to
the City of Fort Warth as soon as possible after all returns have been tabulaied,
but in no eWent later than 10:00 a.m., Monday, May 5, 2043. The City will be
respansible for the afficial canvass of its elections.
{n} Tarrant County will conduct a manual caunt af at least one percent (1%) of the
elsction precincts or in three precincts, whiche�er is greater, and su�mit a written
repart of the results ta City Secretary, Gloria Pearson, in accordance with Section
127.209 of fhe Texas Election Code.
(o) S�rve as custodian of the voted ballots and other records, and provide at no cost for
the storage of eleciions records for sixty (60) days as provided by law.
(�) Pra�ide, if necessary, assistance in translating the ballats into Spanish. (No charge.)
(q) Pro�ide list of vaters who voted.
(r) Provide the same se�vices, equipment, anci supplies necessary for th� City ifi a runofFelection
is required on May 24, 2Q03. (Cost will be based on the acfual number of hours required in
furnishing #he additional services times the cost per hour specified in this contract, togefher
with the actUal cost for supplies, equipment, and r�ntals.} In the ever►t a runoff election is
necessary, the City and County will enter inta an amer�dment ta this cnntract.
DUTIES AND SERVICES OF CITY OF FORT W�RTH.
The City shali, a# its sole cost and expense, perForrn the following:
(a} Prepare apprapriate documents for assisting the Electio�s Administrator in
establishing the precincts and polling places a�d in seleciing the electian judges
for each polling place and the members of the �arly Voiing Baqot Baard.
(b) Prepare all �1�ction orders, resolutions, notices, and �ti�er pertinent dacuments for
adoption by the City Council and for execution by the appro}�riate City officer; and
take all actians required by law for calling the election, appointing th� presiding judges,
alternate �udges, judge af the Central Counting S�ation, a�d ather election officers,
es�ablishing precincts and pollir�g places, handling contests, canvassing the retums,
and declaring the results.
{c) Approve the Tabulating Supervisor and Assistants and the Central Counting Station
Manager, as recommended by th� El�ctions Administrator.
(d} Pr�pare and publish in the official City newspaper, or �ast, all required election
natices.
(�} Deli�er to the Electians Administrator on March 20, 2003 or as soan as possible the
official candidates and wording that is to be printed on the ballot with the exact form,
arders, wording and spelling that is to be used. The City Secretary shall have the
righi to review and approve the finai form and wording of fhe proposed ballot as if
related to the city eiections. �

(fi} Provide the services necessary to translate any election doc�ments info Spanish.
(g) Pay any additional costs incurred by the Elections Administrator if a recount far the
election is required, or the election is contested in any manner.
(h ) Prepare and submit to the U. S. Department of .�usfice under the F�deral Votin�
Righfs Act of 1965, the required submissions on voting changes.
(i) Establish phane service (2 lines) at four Early Voting lacations, no later than
April 1, 2003.
{j) Bills shall be submitted to the City by the Elections Administrator and payment shall
be made directly foy the City to the Elections Administrator, who will �e responsible
far payment to all parties who have provided services, supplies, and �oting locations
far the elections. The City sha11 rtot be liable to any third pariies far any default by
the County in connection with holding the election, including the �ailure by the
county or its Elections Admirtistrator ta pay for services, supplies, and voting
locations for the election.
III. PAYMENT FOR SERVICES:
(a) For and in consideration of the complete and sat'sfactory performance of the services described
in �#f. Dut�es and Services af Tarrant County," the City will pay Tarrant County on the basis of
the actual casts incurred by Tarrant CQunty in furnishing same, plus an administrati�e fee of
10% of such actual costs; provided, however, that in no e�ent shall payment by the Cify to
Tarrant Caunty for actual costs and administrative fee exceed the total sum of $�00,�78.50
without the farmal approval of the Fort Worth City Council.
The astimated casts tv be incurred by Tarrant County in canducting the election, plus 10%
administrati�e fee, are reflected on Exhibit "B" attached hereto, in the amount o�P$'16�,778.5D.
In addition Exhibits "C" and "D" reflect the total cost f�r rental equipment far use during Early
Vofing and or� Election Day at a cost of $�,OOD.00 and $�4,5U0.00 resp�ctively.
(b) As partial payment of the above described contract price, the City shall pay ta Tarrar�t County
the sum of $�v,00D.00 , upon execution af this agreement. The ba[ance far such services
shall be paid within thirty {30) days from the receipt of the biA for same, said billing ta follow the
date of the election. In the event the balance due reflects an actual cost and administrative fee
af greater than $ 768,778.�0 th�n the City 5ecretary will present fo the City Council for
consid�ration a request for paymenf of that �ortian of #he balance due wh�ch is greater than the
estimated $ 200,27$.5fl .

29th day of_April ,�OD3. Rental shall not extend to a date thatwil{ interfere with subse�uent efections forwhich the Couniy
is responsible.

Only equipment that the County believes ta be in safe operating conditian wiil be pro�ided and the Renter agrees to
�old the Caunty harmless for any damages arising from the use thereof,

Renter agrees io r�imburse the County for the costs to repair damages to the said equipment during such time as the
County does not ha�e control c�stody of said equipment.

hereinafter designa#ed as "Renter", has requested the rental of 140 Optech III-P �agle �oting machine(s) at $ 175.00 per machine on
the terms stated be�ow.

Th� rental period of vo#ing machine(s) shall commence with the 3rd day of MAY , 20Q3, and shall not extend ta a date which
wiil interfere with subsequent elections for which the County is responsible for prqviding the �oting machines(s) for pubfic use. If the
security p�riod for prese�vir�g election results is extended pursuant to Sections 126.p32 ar 126A33 of fhe 7exas Electian Cade and v�ting
machine(s) are required by the County for use in anofher election, Renter will seek a couri order at Renter's expense to release the
affected �oting machine{s) for a time before the elec#ion that will not interfere with use af the machine{s} in the election.
III.
Onfy vating machine{s) which the County believes to be in safe operafir�g condi#ion will be pro�ided and the Renier agrees ta hold
the County harmless for any damages arising from tt�e Reni��'s use af the vo6ng machine(s).
IV.
Renter agrees to return the vofing machine(s) in the same condition as when recei�ed, normal and considerate usage wear
excepted. Renter agrees to reimburse the County for fhe casfs to repair damages to the said machin�(s) during such time as the Counfy
does not have control or custody of said machine(s).
V.

REC�MMENDATiON:
lt is recommended that the City Council appro�e tF�e attached cantracf wifih Tarran# County in the amount
o# $200,278.50 for elec#ion services for the May 3, 2003 Mayor and Cfty Gouncil election.
DISCUSSION
The election for the Mayor and City Cau�cil members wil[ he held an May 3, 2003. The attached contract
pro�ides far the Tarrant County Elections Administrator to provide election serv�ces and equipmenf needed
by the City to conduct #he election, including training and campensation of election judges and clerks,
preparing and distributing ballots, supervising early �oting and arranging for use of pubEic places. The
City will pay $759000 ta Tarrant County upon execution of the agreement, and the balance will be billed
after t�e �lection.
FISCAL INFDRMATIONICERTIFICATION:
The Financ� Directar e�rtifies t�at funds are a�ailable in the current bu�get, as apprapriated, of the Non-
Departmental Fund.
