JUSTIFICATION (REASONS) FOR CHANGE ORDER
The purpose of Change Order #1 is to add funds to the Guaranteed Maximum Price (GMP) of the construction contract for the Forest Park Pool. Steele &
Freeman was selected as Construction Manager at Risk (CMAR) in March 2023. Change Order No. 1 ($3,537,209.00) increases the original contract amount
($9,497,625.00) for a revised contract amount of $13,034,834.00, a 37.2% increase to the original contract, approved by M&C 23-0815. No additional contract
time is approved in this change order.
It is understood and agreed that the acceptance of this Change Order by the contractor consitutes an accord and satisfaction and represents payment in full (both
time and money) for all costs arising out of, or incindental to the above Change Order.

RECOMMENDATION:
It is recommended that the City Council
1. Authorize the execution of a Change Order for Construction Manager at Risk Contract with
Steel & Freeman, Inc., in the amount not to exceed $3,537,209.00, including an Owner's
Construction Contingency Allowance, for a total project budget of $13,034,828.00, for the
Forest Park ENFAC (City Project No. 103326);
2. Adopt the attached appropriation ordinance increasing estimated receipts and appropriations
Park and Recreation Department of the General Fund in an amount not to exceed
$1,958,492.00, from available fund balance, for the purpose of transferring to the General
Capital Projects Fund for the Forest Park ENFAC project (City Project No. 103326);
3. Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in
the General Capital Projects Fund, in the amount of $1,958,492.00 transferred from the General
Fund, for the purpose of funding the Forest Park ENFAC project (City Project No. 103326);
4. Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in
the PARD Gas Lease Capital Project Fund, in the amount of $1,000,000.00, from available
funds, for the purpose of funding the Forest Park ENFAC Project (City Project No. 103326) ; and
5. Amend the Fiscal Year 2023 Adopted Budget and Fiscal Years 2023-2027 Capital Improvement
Program.
DISCUSSION:
The Forest Park Pool project has completed the Construction Document stage and Steele & Freeman
provided a final Guaranteed Maximum Price (GMP) price of $13,034,828.00. A change order is
requested in the amount of $3,537,209.00 for the shortfall amount. On March 21, 2023, the City
Manager's Office approved the use of Fiscal Year (FY) 2022 General Fund Surplus Mayor & Council
Communication (M&C) (23-0095, February 14, 2023) in the amount of $1,958,492.00. Additional
funding has also been committed from the Park and Recreation Department (PARD) Gas Lease
Capital Project Fund in the amount of $1,000,000.00.

Funding for this project was included in the FY2023-2027 Capital Improvement Program in the
amount of $11,000,000.00. Additional funding in the amount of $2,958,492.00 is needed due to the
increase in cost can be attributed to the inflation/escalation in construction materials and labor. The
action in this M&C will amend the FY2023-2027 Capital Improvement Program as approved in
connection with Ordinance 25773-09-2022.
This project is included in the 2022 Bond Program. The City's Extendable Commercial Paper (ECP)
(M&C 22-0607; Ordinance 25765-08-2022) provides liquidity to support the appropriation. Available
resources will be used to actually make any interim progress payments until debt is issued. Once
debt associated with a project is sold, debt proceeds will reimburse the interim financing source in
accordance with the statement expressing official Intent to Reimburse that was adopted as part of the
ordinance canvassing the bond election (Ordinance 25515-05-2022).
On 2/14/23, the City Council approved M&C 23-0095, assigning $9,458,492 for Capital Project
Shortfalls as a part of the Fiscal Year 2022 year-end process. To date, the City Council has
authorized M&C 23-0567 of $4,000,000 for the Fire Station 43 - Walsh Ranch on 6/27/23, M&C 23-
0272 of $1,500,000 for the Intermodal Parkway Improvements project on 4/11/2023. Approval of this
M&C will appropriate $1,958,492 and leave a remaining balance of $2,000,000 for Capital Project
Shortfalls.
Waiver of Building Permits - In accordance with the City Code of Ordinances, Part II, Chapter 7-1
Fort Worth Building Administrative Code, Section 109.2.1, Exception 2; "Work by non -City personnel
on property under the control of the City of Fort Worth shall be exempt from the permit fees only if the
work is for action under a contract that will be or has been approved by City Council with notes in the
contract packages stating the fee is waived.
Business Equity - Steele & Freeman, Inc agrees to maintain its initial M/WBE commitment of 25\%
that it made on the original contract and extend and maintain that same M/WBE commitment of 25\%
to all prior change orders up to and inclusive of this Change Order No. 1. Therefore Steele &
Freeman, Inc remains in compliance with the City's M/WBE Ordinance and attests to its commitment
by its signature on the Acceptance of Previous M/WBE Commitment form executed by an authorized
representative of its company.
Forest Park Pool is located in COUNCIL DISTRICT 9.
FISCAL INFORMATION/CERTIFICATION:
The Director of Finance certifies that funds are available in the General Fund and the PARD Gas
Lease Capital Project Fund and that upon approval of the above recommendations and adoption of
the attached appropriation ordinances, funds will be available in the General Capital Projects Fund
and the PARD Gas Lease Capital Project Fund for the Forest Park ENFAC project to support the
approval of the above recommendations and execution of a contract. Prior to any expenditure being
incurred, the Property Management Department and the Park & Recreation Department has the
responsibility of verifying the availability of funds.

COVID-19 or Pandemics issues may delay delivery of equipment and/or labor. Any and all delays related to COVID-19 or unforeseen
circumstances outside the Construction Managers control shall be claimed on a day for day basis.
Construction Management Fee and General Condition Expense are a fixed lump sum cost.
Force Majeure /Pandemic/Supply Chain Matters. Construction Manager shall not be liable for delays in performance or for nonperformance
due to Acts of God; actions or inactions of Contractor or Owner or Owner's Design Team; war (including impacts from the Russia/Ukrainian
War); epidemic/pandemic; fire; flood; hurricane; tornado; extreme weather; sabotage; terrorism (domestic or foreign); labor shortages, labor
strikes or labor disputes; riots and civil disturbances; governmental requests, demands, restrictions and/or allocations; newly-
passed/imposed laws, regulations and/or tariffs; governmental and/orjudicial orders or actions; unavailability of or delays in transportation
due to any of the aforementioned activities or occurrences; default of suppliers due to any of the aforementioned activities or occurrences
(including materials, supply shortages, labor shortages or discontinuations and/or spikes in supplier prices greater than 10% as of date the
bid was submitted); or, other unforeseen circumstances, events or causes beyond Contractor's reasonable control. Subject to the survival of
viable communication systems, Construction Manager will timely notify Owner if and when one or more of the above identified matters have
occurred and whether and to what extent the same may result in delay of performance or in a specified non-performance.
Div 01 General Reauirements
1 We have excluded state sales tax on INCORPORATED materials.
2 We have excluded tap, impact & meter fees.
3 The Building Permit cost has been excluded.
4 Plat and easements by others.
5 Bids are based on Construction Documents as noted in Exhibit'B' and Alternates as noted in Exhibit'F'.
6 We have excluded materials testing and special inspections.
7 It is assumed that the contract documents have been thoroughly reviewed to meet Federal, state and local codes.
8 We exclude all seismic requirements referenced in the specifications due to the Project's location in Fort Worth does not require any Seismic
consideration.
9 Schedule does account for weather delays; any weather events, will have a day -for -day impact on the schedule.
10 Submittal schedule is excluded, priority submittals will be identified as they are transmitted to the architect.
11 Recovery schedules are excluded.
12 All telephone, paging, low voltage, computer, server, switching, network, cable TV, radio and DAS equipment and testing is excluded.
Deposits required in advance to procure materials will be included on the pay application within the same pay period in which payment is due
13 for deposit to the subcontractors / suppliers, when approved by City of Fort Worth.
Materials that are stored onsite or stored at subcontractor's warehouse will be included on pay applications. Invoices and photos of stored
14 materials will be provided upon request.
The contract contingency is for the Construction Managers exclusive use to cover those costs considered reimbursable as the Cost of the
15 Work but not included in a Change Order. All construction contingency expenditures will be documented monthly with each application for
payment.
All unforeseen scope not clearly identified , not quantified and/or not properly referenced in the contract will be presented to the Owner as a
16 Proposed Change (PC).
This project is not a LEED project, therefor VOC Content Restriction (greater than federal or state requirements) and Commissioning is
17 excluded.
18 Video of recorded training, if any, will be provided on a thumb drive.
19 Temporary Environmental Controls, Flush Out & Air contaminant testing is not included in this scope of work.
20 Materials Testing Laboratory Services shall be provided by the Owner and is excluded from this scope of work.
21 TDLR/TAS review and inspections are excluded. To be provided by Owner.
22 SFI will provide access to the ProjectSight project management software for project documentation, if requested.
SFI will notify City of Fort Worth of any priority submittals requiring Owner's approval to ensure project stays on schedule. If additional time is
23 required for approval, then delay to material fabrication and delivery could affect the construction schedule.

26 Franchise utility service charges have been excluded for communication lines, electrical power, Atmos gas, etc.
Delegated Design submittals are recognized for the following sections: 05 12 00 Structural Steel Framing, 05 52 16 Aluminum Pipe Railings,
27 13 1100 Swimming Pools, 13 14 13 Waterslides, 26 05 29 Hangers and Supports, 26 0 73.13 Short -Circuit Studies, 26 05 73.19 Arc Flash
Hazard Analysis, 26 56 00 Exterior Lighting. No other Delegated Design requirements are recognized.
28 Unforeseen material delivery and availability issues beyond Steele & Freeman's control shall be a day -for -day schedule delay.
29 All utilities, including but not limited to, domestic water, irrigation water, electricity, gas and communications shall be transferred into the
Owner's name at Substantial Completion. All utilities from this date shall not be funded thru the GMP Estimate.
Due to the current market with shortages of material, we reserve the right to provide substitutions for approval if the shortage or material
30 causes an increase in material pricing, color, or finish limitations or affects the construction schedule or availability of those materials during
construction.
Div 02 Existing Conditions
1 Hazardous materials identification, testing, abatement, removal, demolition, and/or disposal is excluded.
2 Removal of underground storage tanks, contaminated soils and related remediation is excluded.
3 Items not detailed in the contract documents to be removed or demolished are excluded from this work.
Div 03 Concrete
1 All belled piers have been bid as dry, with bearing elevation at 15' below finished grade, per the structural general notes. No Unit pricing for
added, deducted length, or casing is included.
All exposed slab finishes to be Class B and per the specifications for unshored suspended slabs have a minimum FF of 25
2 (which translates to 1/4" vertical variance in 10')
3 All concrete is bid as hand -finished. Mechanical screed, vibratory screed and paving machines is excluded.
5 Any underground obstructions discovered to the new foundation will be handled as a change order to contract contingency on an individual
basis.
6 Hot or cold weather cooling or heating of concrete. Proposal may be requested if conditions fall within hot or cold weather parameters.
7 Rock coring or rock drilling are excluded.
8 Monument sign foundation is included as shown, and was added per the Alternate No. 3.
9 We have included an allowance for repairs to the 1920 Sacred Concrete Circle per Pre -Bid RFI #2. See Exhibit C - Allowances.
The stained concrete "bubbles" that are shown on L201 and Detail 1/L2.02 will be a stained concrete finish per the answer on Pre -Bid RFI #7
10 and the Specification Section 32 15 11 issued with the RFI. Color to be from Manufacturer standard colors. Specification 32 15 12 Colored
Concrete Paving is no longer applicable for this project and is excluded.
Div 04 Masonry
1 Mortar shall be grey in color.
2 Galvanized wire brick ties are included per Pre -Bid RFI #3.
Div 05 Metals
1 We have excluded all AESS steel finishes. None shown.
2 Upsizing of steel beyond what is clearly shown, sized and located in the contract documents is excluded.

Div 32 Exterior Improvements
Landscape and irrigation scopes are included as shown for the Pool Drawings. For the Alternate No. 1 Street Widening areas, we have

We have included the ornamental fencing where located on the documents. Fencing is included as 7' tall TCF7-Eagle 7' Tall iron Fence,
5 galvanized inside and out, with 3/4" 14" ga. pickets, 11/2" 14 ga. Rails (3 rail system), and 3" 14 ga. Posts, and a 15 year paint warranty,
and 5 year labor warranty. This product is a better than or equal to the specified Ameristar fence.
We have included an Allowance to recover, re -set, and re -use the existing six (6) existing round umbrellas, and the two (2) rectangular shade
6 structures. Foundations are as noted per the documents and are not included in this allowance. See Exhibit C - Allowances.
Div 33 Utilities
1 Underground utilities not shown by the contract documents (unknown conditions) are specially excluded.
