COMMUNITY FACIL�TIES AGREEMENT THE STATE OF TEXAS § City Secretary � �� �' �—� COUNTY OF TARRANT § Canixact No. -' ��� � WHEREAS, Beazer Homes, L.P., hereinafter called "Deueloper", desires to make certain impravernents to Lakeview North Addition, an addition to the City of Fort Worth, Texas; and WHEREA�, the said Developer has requested the City of Fort Worth, a municipal corparation of Tarrant and Denton Counties, Texas, hereinaf�er called "City", to do certain wark in connection with said 'unpravements. NOW, THEREFORE, KNOW ALL BY THESE PRESENTS: That said Developer, acting herein by and through Beazer Homes of Texas Ho�dings, Iuc., and Bruce Freach, iis duly authorized Vice President, and the City, � acting herein by and through Marc Ott, its duly autharized Assistant City Manager, for and in consideration o�the covenants and conditions contained herein, do hereby agree as follows: I. General Requirements A. The Policy for the Installation of Community Facilities ("Palicy") dated March 2001, approved by the City Council of the City of Fort Worth, is hereby incorporafed inta this Community Facilities Gontract as if copy herein ��rbatim. Developer agtees to comply with all provisions of said Policy in the performance of its duties and obligations hereunder. B. The requirements af the Policy �hall govem this Commuiuty Facilities Agreement, provided, however, that any conflict bet-vveen the terms of this Community Facilities Agreemen# and the Policy shall be resolved in �avor of this Agreernent. C. Developer shall provide fin.ancial securiry in conforrmance with paragraph b, Section II, of fihe Policy. D. The Developer shall award all confracts far the construcfion of community f�.cilities in accordance with Section II, paragraph 7 af the Policy. E. The contrac#s for the consfiruction of the public infrastruciure shall be administered i�n confarnaance with paragraph 8, S�ction II, of the Policy. CF.4 LAICEVIEW.4DDNNORTH F. The Developer furfher covenants and a�rees io, and by these presents dfles k�ereby, fully indemnify; hald harml�ss and defend ihe City, it� aificers, agents and employees from all suits, actions or claims af any character, whether real or asserted, brought far ar on aecount of any injuries or damages sustained by any persons (i.ncluding death) or to any property, resulting from or in connection with the coxastruction, design, perfortnance or completion af any work to be perfozmed by said Developer, his confrac#ors, subcantractors, afficers, agents or ernployees, or in consequence of any fai.lure ta prop�rly safaguard the wark, ar on accaunt of any act, intentionaX or otherwise, na�lect or misconduct of said DEVELOPER, hzs contractors, sub-coniractars, officers, agents or employees, whelher ar r�at such i�iuries, death or dama�es a�e caused. in whole ar in part, bv tlie alleged ne�li�ence of the Citv of Fort Worth, its officers. servants. or emplovee� G. Developer shall install or adjust all of fhe xequired t�tilitias to serve the dev.elopment or ta construct the improvements required herein. H. In the event that Gity participafion exceeds $25,OOQ, Develaper agrees that no street constructian or stonn drainage will begin priar to City Council approval of this Community FaciliY�es Agreement. (Article 104.I00, Qrdinance 7234}. I. Developer agrees that no lot shall be occupied under a certificate of occupancy until the improvements required herein have been canstructed (Article 104.100, Oard�izaanee 7234). J. Developer hereby releases and agrees to indemnify and hold the Giiy harmless for any inadequacies in the pr�liminary plans, specifications and cost estiumates supplied by the Developer for this contract. K. Developer agrees to provide, at its expense, aIl necessary rights of way and easexnents across property awned by Developer required to cor�truci curren# and future ixnprovements provided for in this agreement. The Developer(s) agree to install or to cause to have installed, the street, storm drainage, street Iighting, street name sign and other community facilities improvemez�ts shown as "current improvements" on the attached Exhibits B, B1, and C. B. As shown below in the "Surnrnary af Cost £or Street and Starm Drain Facilities", the Developer shall fiuid its share of "current impxavements" and s�all pa.y to the City for its share of the cost af slxeet, starm drainage, street lighting, street name signs as shown on tlie attached Exhibii� B, B1, and C.
