General Requirements A. The Policy for �he �nstallation of Commt�nity Facilities ("Policy") dated March 2Q01, apgraved by the City Council of the City af Fort Worth, is her�by incarporated into this Cornmunity Facilities Contract as if copy herein �erbatim. Developer agrees to comp�y with all provisians Qi said Policy in the per�'ozxnance of it� duties and abligations hereunder. B. The requiremEnts o£ the Policy shall govern this Community FacilitiEs Agreement, prowided, hawever, �hat any conflict betw�en the terms of ti�is Community Facilities Agreement and the Policy shall be resolv�d in favor o�this Agreement. C. Dev�lopez sha�l pravide financial sccurity in conformance with paragraph 6, Section II, flf the Palicy. , D. The Developer shall award all contracts for the consiruction of eomrnunity facilities in accordance with Section II, paragraph '7 of the Policy, E. The DeveZoper further covenants and agrees to, and by these presents does hereby, fu1Zy indemnify, hold ha�mless and defend the City, its officers, agents and employees from all suits, actions ar claims of any character, whethEr r�al ar �asserted, braught for or on aecount of any injuries or damages susta.ined by any pe:rsons (including death) or to any property, . resulting from or in connection with the constr�.iction, design, performance or. completian of any wfl:rk to be performed by said Developer, his contractors, sui�contractors, officers, agents or employees, or in consequence of any failure to properly safeguazd the wark, or on accoun# of any act, intentianal ar otherwise, neglect or m�isconduct of said DEVELOPER, his c�nixactors, sub-contractors, officers, agents or employses, whether or not such iniuries. death or damaFes are caused. in whale or in part, bv the alle�ed negli�e�ce vfthe Citv ofFort Worth. its afficers, servants, or emnlovees G. Developer shall install or adjust all of the required utilities to serve #he developrn�nt ar ta construct the improvements required herein. H. In �he event t�at City participation exceeds $25,040, Developer agrees that no street construction or storm drainage will 6egin prior to City Counci� approvai of this Commuxuty Facilities Agreernent. (Article 104.I00, Ord.inance 7234). I. Developer agrees that nfl Iot shall be occupied under a certificate of occupaz�cy until the improvemerits r�quired �herein liavc been constr�xcted (Articl� 104.100, Ordinance 7234). J'. Developer hereby releases and agrees to indemnify and haId ihe City harmless fQr any inadequacies in the preliminary plans, spccifications and cast esti�nates supplied by �he Developer for this contract. Developer agrees to provide, at its expense, all n.ecessary rights of way and easarnents across property owned by Developer required to construct c�zrrent and future unprovements provided for in this agreement. As shawn belovv in the "Surnmary of Cost for �treet and Storm Drain Facilities", th� De�veloper sb,all fund i�s share of "current improvements" and shall pay to ihe Gity for its share �f th� cost of sfreet, storm drainage, street lighting, street name signs as shown an the attached Exhihits B, B�1, and C.
