HomeMy WebLinkAboutContract 28664COMMUNYTY FACTLITIES AGREEMENT City Secretary COLTNTY OF TARRANT § Contraci No�O� ��-� WHEREAS, �F'illow Wood, L.P., Raleigh Development Company, Inc., its G�neral Partner, hereinafter callec� "Developer", desires to make certain improvements to Willow Wood Addition, an addition to the City o�Fort Worth, Texas; and THE STATE OF TEXAS § WHEREAS, the said Develop�r �tas requested the City of Fort Worth, a municipal cvFporation of Tarrant and Denton Counties, Texas, hereinafter called "City", ta do certain work in cannection with said irnprovements. NOW, THEREFORE, KNOW ALL BY THESE P�S�'NT�: � That said Developer, acting herein by and throu�h Lee Nicol, its duly authorized Vice Pr�sident, and the City, acting herein by and through Marc Ott, its duly authorized Assistant Cify Manager, for and in consideration flf the covenants and conditians contained herein, do hereby agree as follows: I. Gen�ral ReqUirements A. The Palicy for the Instailation af Community Facilities ("Palicy") daied March 2001, approved by the City Council of the City of Fort Worth, is hereby incorporated into this Community Facilities Contract as if copy herein verbatim. Developer agrees to corr�ply wi#h all provisions o� said Policy in the performance of its duties and abligations hereunder. B. The requirements of t��e Policy shall gavern this Community Faciliiies Agreement, provided, however, that any conflict between the terms of this Community Facilities Agreement and the Policy shaZl be resoIvec� in favor of this Agreem.ent. C. Developer shall provide �ir�ancial security in conformance with paragraph 6, Section II, of the Policy. D. The Developer shaIl award all contracts for the construction of community �acilities in accardance with Section II, paragraph 7 of the Policy. E. The Dev�loper further cavenants and agrees to, and by t%ese presents daes hereby, fully indemnify, hold harmless and defend �lie City, its oifcers, agents an� employees frorr� all suits, actions or claims of any character, whether real or asser�ed, brought for ar on account of any injuries ar damages sustained by any persons (including death) or to any property, resulting from or in connection with the construction, design, performance or completioiz of any work to be performed by said Developer, his contractors, subcontractors, afficers, agents ar emplayees, or in consequenc� of any failurre to properly safeguard th� work, or on account of any act, intentional ox atherwise, neglect or misconduct of said DEVELOPER, l�is coz�t�ractors, sub-contractors, officers, agents or employees, whetlaer or �at such rrx�uries, deatl� or datna�es are eaused, in wltaLe or iia nrtrt, bv tlie alleged ne�ligence of tlze Crtv of Fort Wortla, ' its officers, servarzts, or enz�tovees. G. Developer shall install or adjust all of the required utilities to serve the development ar to construct the improvements required herein. H. In the event that City participation exceeds $25,000, Dev�loper agrees �at no street constructinn or storm drainage wi11 i�egin prior to City Council approval of this Community Facilities Agreement. (Article 104.100, Qrdinance 7234). I. Deve�aper agrees that no lot shall be occupied under a certifcate of oecupancy until the improvements required herein have been constructed {Article 104.100, Ordinance 7234). J. De�eloper hereby releases and agrees fo indemnify and hold the City harmless for ar�y inadequacies in the preliminary plans, speciiications and cost estirnates supplied by the Developer for this contract. K. Developer agrees t� provide, at its expense, all necessary rights o� way and easements acrass property owned by Developer required to construct current and fu�ure improvements provided for in this agreement. � II. Street and Storm Drain Facilities A. The Developer(s) agree to install or to cause to have installed, the street, storm �rainage, street lighting, street name sign and other communi�y facitities improvernents shown as "current improvements" on the attach�d Exhibits B, B 1 and C. B. As shown below in the "Summary o.f Cost for Street and Storm Drain Facilities", the Developer shall fund ifs share of "current improvements" and shall pay to the City for its share of the cost of street, storm drainage, s�reet lighting, street narne signs as shown on the attached Exhil�its B. Bl and C. C. STREET LTGHTS WORK DESCRIPTION: 1. The Deve�oper shall provide for the installatian o� s�reet�ights at tha approxima�e �ocations shown in Exhibit "C", immediately after �ina1 acceptance o� the s�reet consfiruction, in accordance with �ngineering plans and sp�cifications approved by the Transpartation and Public Works Department. 2. Streetlights on residential and /or callector str�ets can be ins�a�led using overhead ar underground conduckozs wath the approval of the Direc�o� of Transportation and Public Works. 3. 5treetligh�s an arterial streets shall be installed wi�h undergxatzzid conduit and conduc�ors. 4. Th� D�veloper sha�1 provide for the installation of a 2-inch schedule 40 PVC conduit at a depth not less than 30 in�he� and at least i8--inch, behi.nd the curb, "clear from ail other utilities". 5. The Developer sha�1 provide for the installation of a 2-inch schedu�.e 40 PVC conduit between streeCligYits proposed for installation ax�d the power sourc� to b�come operational. 6. A 3-inch schedulc� SO PVC conduit is required when crassi.ng stiareets at a depth nat l.ess than 30 inches, unl.ess indicated otherwise on �he pl.ans conc'r�te pull boxes shall be provided a� �he crossing points. 7.
