Horton — Texas, Ltd., hereinafter called "D�velaper", desires to make cextain iznprovemen�s to Alexandra Meadows, Phase I, an addition to tih� City of Fort Worth, Texas; and WHEREAS, the said Develop�r has requested the City of Fort Warth, � municipal eorporation of Tarrant and Den�on Counties, Texas, hereinafter called "City", to do certain work in connection wit1� said improvements. NOW, THEREFORE, KNOW ALL BY THESE PRESENTS: That sazd Devaloper, acting herein by and through Ranciy Horton, its duly authorized Assistant Secretary, and the City, acting herein by and ihrough Marc Ott, its duly authorized Assistant Ciiy Manager, for and in cansideration of the covenants and conditions confained herein, do hereby.agree as follo�s: I. General Requirements A. The Policy for the Installation af Commun�ity Facili�es ("Policy") dated March 2001, approved by the City Council oi the City of �'ort Worth, is hereby incorparated into this Community Facilities Contracf as if copy herein ve�barim. Deve�aper agxees to comply with all pz-ovisions of said Policy in the performance of its duties and obligations hereunder. B. The requirements of the Policy shall govern this Cornrnunity Fac�lities Agreement, pravided, however, that any canflict betwe�n �he terms of this Community Facilities Agreement and the Policy shall be resalved in favor of this Agree�nent. C. Dev�loper shall provide financial security in conformance vvith paragraph b, Section II, of the Poliey. D. The Developer shall award a11 con�racts for the construction of community facilities in accordance witla Section II, paragraph 7 a�fhe Poiicy. E. The Developer fiirther covenants and agrees to, and by these presents does hereby, fully indemnify, hold hannless and defend the City, its office:rs, Ce� � agents and employees froax� all suits, actions or claims of any characterr, whether real or asser�ed, brought for or on account of any inju:ries or damages sustained by any persons {xncluding death) or to any property, resulting from orr in connection with the construction, design, performance or completion �f any wark to be performed by said Develaper, his cantractors, subcontractors, officers, agents or employe�s, or in cans�quence of any failure to properly �afeguard �he work, or an account of any act, intentional or otl�ez-vvise, neglect or misconduct of said DEVELOPER, his contractors, sub-contt'actars, ot'ficers, agents or employees, whether nr not such iniuries, death or� damages a�e causer% in whole or in �vart, bv the adleged ne�li�ence of the Citv of Fort Worth, its off�cers� se�vants, or emnlavees Developer shali install or adjust all o� the requirad utilities to serve the development or to construct the improvements required herein. In the event that City participation exceeds $25,000, Developer agrees that no street construction or storm drainag� �vill begin prior io City Council approval of this Community Facilities Agreement. (Article 104.100, Ordinance 7234). I. Developer agrees that no lot shall be occupied 1�11C��P a certificate af occupancy until the irnprovements required herein have been constructed (Article 104.10b, Ordinance 7234). J. Developer hereby releases and agrees to indemnify az�d hold �li� City harmless for any inad�quacies in the preliminary plans, specifications and cast estima#es supplied by the De�eloper for this cantraet. K, Developer agrees to pravide, at its expense, all necessary rights of way and easements across pzoperly owned by Develop�r raquired to canstruct current and future improv�ments provided for in this agreement. The Develop�r(s) agree to install or to cause to have installed, the streei, �torm drainage, street lighting, stree# name sign and other community facilities improvements shovvn as "current improvements" on the attached Exhibits B, B1, and C. B. As shawn below in the "Surnrnary of Cost for Street and �torm Drain Facilities", the Develaper shall fund its share of "current improvements" and shall pay to the City far its share of the cost af street, starm drainage, street lighting, street narne signs as shown on the attached Exhibits B, B1, and C. The astimated total cost of current improvements and related s�upport ser�ices specified in tlus agreement, including design, construction and inspection is estimated ta $1,0�4,664. STREET LIGHTS WORK D$SCRTPTTON: 1. Th� Dev�loper shall provide for the installation of streetlights at the approximate �ocations shown in E�hibit "C", immediately after final acceptance of the street construetion, in accordance with engineering pXans and speci�xcations approved by the Transpo�tation and Public Works Department. � 3 Streetligh�s on residentxal and /ar ca��ecror streets can be installed using overhead or underground conductors with the approval of the Director o� Transportation and Public Works. S�ree�lights o� arterial streets shall be install�d with underground conduit and conductors. 4. The Developer shall provide far the �nstalla�xo� a� a 2-xnch schedul.e 40 PVC conduit at a depth not less than 30 inches and at least 18-inch behind �he curb, "c7.ear from a7.7. other uti7.ities" . 5. The Developer shall provide for the ir�stallation of a 2-inch sehedule 40 PVC conduit between s�reetligh�� proposad �or installation and the power source to become operational. 6. A 3-in.ch schedule 80 PVC eonduit is required when crossing stree�s at a depth no� �es5 than 30 inches, unless indi�ated otherwise on the plans conerete pull boxes �hall be pro�rided at the crossing poi.nts . 7. Street light conduit and foating� shall be installed b�r the developer's contractor as part of asd at the time af street constiruction. The city will �btain electric sarvica and complete the street light constructian in aacordance with appraved plans. 8.
