Crer�eral Requirements A. The �'olicy for �1ie Installation af Cam�nunity Facilit'r�s ("Polic�'} dated Ma�rch 2001, approved by the City Cauncil of ihe City of Fort Worth, is her�by incolpo�rated into this Community Facilities Contract as if copy herein verbatim. Developer ag�rees to cnxn.ply with all provisions of said Policy in the perfaz7nance af its dut�es a�d obligations hereunder. B. The rrequixements of the Policy shall govern this Community Facilities Agireement, provided, however, �hat any conflict between ihe terms of this Cornmunity Facilities Ag�reement and the Policy shall be resolved in favor oi ihis Agreement. C. Developer shall provide financial security in conformance with paragraph b, Sect�ion II, ofthe Palicy. D. The Developex shall award all contracts for the cvns�nzction of �ommunity facilities in accardance with Section II, paragraph 7 of the Palicy. E. Th� contracts for the constructio� of the pu6lic infrastructure sha�I be administered in conformance with paragraph 8, Section II, ��'�� .� � ; � �� ' � � ii �l�rp � i � � e F. The Dev�loper further covenants a.nd agrees ta, and by t�es� presents does hereby, fu11y indemnify, hold haimless and defend the City, it� officers, agents and emplayees �'ram a11 suits, actians or claims of any character, whether re�t or asserted, brought for or an account of any in�uries or damages sustained by any persons (including death) or io any property, resulting from or in connectian wit�i the construction, design, performance or cornpletion o£ any work to be performed by said Developer, his cantractars, subcontractors, officers, agents or employees, or in consequence of any failure to prvperly safeguaxd the work, or an account of any act, intentional or otherwise, neglect or misconduci of said DEVELOPER, his contractors, sub-contractors, off'xc�rs, agents or employees, whether nr nat such i�iuries, death or dama,�es are caused, ita whvle or in nart, bv the alde�ed r�e�ti�ence of tlae City of Fart Worth, its o�cers, servants, vr emtrlovee.�. G. Developer shall install or adjust a11 of the required utilities to serve the develapment or to construct the improvements required herein. H. In the event that City participation exceeds $25,000, Developer agrees that no s#reet construction or starm drainage will bagin priox �o City Council approva.l of this Community Facilities Agreement. Developer agrees that no lat shall be occupied under a certi.fcate of occupancy until the improvements required hexein have been constructed {Artic1�;104.I00, Ordinance 7234}. J. Developer hereby releases and agrees to ind�mnify and hold the City harmless for any inadequacies in the preliminary plans, specifications and cost estimates supplied by the Developer for this contract. K. Da�eloper agrees to pravide, at its expense, all necessary rights of way and easemenis across property ovvned by Developer required to construct current arxd future irnprovements provided for in this agreement. • � r � � II. The Develaper(s) agree to install or to ca.use to have insfialled, the street, storm c�rainage, street lighfzng, slxeet name sign and other community facilities improvernents shown as "current irr�provements" on the attached Exhibits B, B 1 and C. B. As shown below in the "Summa�ry of Cost for Sireet and Storm Drain Facilities", the Developer sha11 fund iis share of "current improvements" and shall pay ta Yhe City fox its share of the cost of street, storm dra.inage, streef lighting, street name signs as shown on the aiiached Exhibits B, B 1 and C.
