to the Cifiy of Fort Worth, Texas; and
WHEREAS, the said Developer has requested the City of For# Worth, a mur�icipal
corporation of Tarrant anti Denton Cou�ties, Texas, hereinafter called "City", fo da
certain work in connection with said improvements;

A. The Qeveioper (owner} agrees to install or to cause io have installed, the street,
storm drainage, street �ighting, str�et name sign and other cammunity facilities
improvements shown as "currenfi impro�ements" on ihe attached Exhibits �, �1,
AR1D G.
B. The Developer agr�es to comply with a!I city accepted practices, ordinances,
regufations, as well as pro�isions of the City Charter, fihe City Subciivis9on
Ordinance, Ci�y Design Standards and the current Poficy fior lnsfalfation of
Community Facilities in the design, contracting and installation of req�ired "currenf
impro�ements".
C. The De��loper agrees to comply with the General Requirements contained herein
� �Attachment A}. �
D. As shown on the attached "Summary of Cost", the De�eloper agrees to fund his
share of "current improvements" and to pay the City for his share of �he cost ofi
street, storm drainage, street lighting, street name signs as shown on the attached
Exhibits �, �1, and C. .
E. Payment is due at �he time this agre�ment is executed by the City and the
Developer,
F. The estimated total cost of current improvements ar�d relat�d support services
specified in this agreement, inciuciir�g design, construcfion and inspectian is
est�mated to �1,Q11,1�5AD.

G. Dev�foper agrees to provi�e, at his expense, all necessary rights of way and
easements required to construct currenf and fufure impra�ements pro�ided far in this
agreemen#. �

H. De�eloper agrees to r�lieve the Ciiy of any respons�bilities for any inadequacies in
the prel�minary plans, specifications and cost estimafes supplied for the purpose ofi
fhis contract. �
I. Developer also agrees to ins�afl or adjust all of the required utilities to serve #he
cfevelopment or to construct the impro�emenfis required herein.
,l. De�eioper agrees that no street construction or storm drainage will begin prior to
City Council approval of this Community Facilities agreement. {Article 104,100,
Ordinance 7234}.
K. De�eloper agrees that no fot shall be occupied until fmpro�ements ree�uired herein
h��e been constructeci {Ar�icle 1 Q4.9 Qa, Ord�nance 7234).
L.. Develop�r agress to complete fhe imprav�ments covered by this agreement within
90 calendar days afker ha�ing been instruc#ed to do so, in writing, by fhe Director of
Transpartation and Public works. It is understood that the developer w�ll initiate the
construciion af all improvements to canform with his own schedule, except for those
impro�ements �hich the Transportation and Public Works Director deems necessary
for th� praper and orderly deWelo�ment o� the area. In the event De�eloper fails to
carry out any such instructions wifhin the 90-day period, �he De�eloper gives the Ci�y
the right to design and awar'd a contract, and i�spect the impro�rements in qu�stian,
and agrees to pay to the City �rior ta the award of the contrac#, the amount of the
low bid.
M. City participation in "current impro�ements" sha11 not exceed 125°fo of cost shown in
Summary af Cost.

final aCCep�ance of the st�'ee� con.s�ruction, in accordanCe with
engineering plans and specifications approvcd by the Transpox'�ation
ar�d Public Works Department.
2. Strc��tlights on residenti.al and /or collector streets can be
ins�a�.�.ec1 using overhead or underground Conductors with �he approval
of the Director of Traxi�portation az�.d Publ.ic Works .
3. Streetlights on arterial st�eets shall be installed wi�h unclerground
condui� and conductors.
4. The Deve7.opex' sha11 provide for the ir�stallation of a �-inch
achedule 40 PVC conduit at a depth n.ot l.ess than 3D inches and at
least ].8-inch behin�d �he curb, "clear from all oth�r utilities".
5. '�he 17eve].opex eha11 provide for the installation of a 2-inch
schedule 40 PVC conduit betw�en streetlight� pxopased �or
installation and th� power source �o becotne operational.
6. A 3-inch �chedule BD PVC conduit is requi�'ed when crassing street�
at a depth not less than 30 i.r.a.ches, unless indicated otherwise on
the plans Concre�e pull�bo�es shall be provided at the crpssing
points.
7. Street ligh� condui� aar.�d faa�ings shaZl be ins�alled by the
develaper's contractor as part af and at �he time of street
construction. The ci�y r„rill obtain elec�ric ser�rice and co�mple�e �he

B. The d�v�loper o� thei�r can�ractor shall contact City's stxee� Xight
divisioz�. 48 hours prior to starting ariy zn.s�allation of conduit
and/ar streetlights at (817) 87�.-8100 to insure proper inspection o�
work.

A. It is agreed and understood �y the parties hereto that the developer shaU employ a
civii engineer, licensed to practice in fihe State af Texas, for the design and
preparation � of plans and specificatians for the construc#ior� of ali currenf
improvements covere� by this contract, subject to Paragraph B. �
B. For any project estimated to cost less #han $10,000 or for a�y project designe� to
s�rve a single !ot or iract, the developer may at his option request the City to
pro�ide the design engineering, and if such request is granted, the developer shaN
pay to the City an amount equal to 10 percent ofi the �nal construction cost o# such
project for such engineering services.
C. In the event the de��loper employs his own engineer to prepare plans and
specifications for any or all currer�t improvements, #he pians and spec�fications so
prepared shall be subject to a�praval by the depariment having jurisdiction. One (1)
reproducible set of plans with 15 prints and 35 s�ecifcations fo� each facilify shall
be furnished the c�epartment har�ing j�arisdiction. I� is agreed and ur�derstoad that �n
the event af ar�y disagreement on the plans and spec'rf'icatiorts, the decision of #he
TransportationlPubliC Works Department Di�ector, and/or Water Department
Director wilf be final.
D. li is f�rther �greed and understood by the par�ies hereto that upon acceptartce by
#he City, title to all facilifies a�nd impro�ements mentione� i�ereinabove shall be
vested at all times in the City o# For� Wor�h, and d�veloper here�y relinquishes any
right, titl�, or interest in and to said facilities or any part hereof.
E. lt is furth�r agreed that the decision of the City to not collecfi funds for "fiuture
impro�ements" requ�red in prev�ious CFA agreements does not constitute an
obligation on the part o� the City to construct such "future improvements" at its
expense.

F. Work hereunde� shall be compl�ted within two (2} years from date hereof, and ii is
understood that any oblig�tion on the pari of th� City to make any refunds with
respect to water an�lor sanitary sewer facilities or street, storm drain, street light
and street name sign shal! cease upon the expiration of two �2) y�ars from date
hereof, except for r�funds due from "front foot charges" on water and sanitary
sewer mains, which refunds may continue to �� made for a perivd of ten (10) y�ars
cnmmencing on the date that approach m�ins are accepteci by the Director. If less
than 70% of the �ligible coll�ctions dUe to the developer has been.collected, the
Developer may request in w�iting an extension of up to an additional � D years for
collection of front charges. lf the consfruct9on under the Community Facilities
Contract shall ha�e started within the two-year perio�, th� life of the Cammunity
Facilities Contract shall be extended for an additional one-year period. Community
� Facility Contracts not compfeted withi� the fiime periods stated above will fequire
renewal of the contract with all updated agr�emenis being in eompliance with the
poficies in eff�ct at the time of suct� renewal. Developers mus# recognize fihat City
funds may nof be available to pay all or a portion of the normal City � share �or
renewal contracts. It must be understaad by all parties to the Community Faciliti�s
Contract that any af the facilities or requiremenfs included in the contract that are to
be performed by the developer, bui not perFormed by the developer within the time
�eriods sta#ed above, may be campleted by the City at the develope�'s expense.
The City of Fort Wor#h shall nat be obligated to make any refiunds cfue to the
developer on any facilities constructed under this agreement unt�l afl pro�isions of
the agreem�nt are fulfilled.
G. PERFaRMANCE AND PAYMENT GUARANTEES

F'erformance and Payment bonds or cash deposits acceptabl�: to the City

bas�s, and must be f�rnished ta the City prior to executian of this eonfiract.

The performar�ce and payment bonds shall be in the amount of or�e hundred
percent (100°/a} of the devefoper's estimated share of �th� cost of fihe stree#s,
storm drains, street lights, and street name signs. !f the deposit is in fhe
form of cash, the deposit shall be in fihe amount of one hundred twenty five
percent (125%} of the dev�lope�s esfimated cast of the streets, storm
dra�ns, str��t lights, street name sigr�s, an� change orders (during the
course of t1�e project}. .
2. �or Future lmprovemen4:
Performance and payment bonds ar cash deposits, acceptable to the City
are required to be fumished by th� developer for� one nundred p�rcent
(100%) of the develaper's estimated cost resulting from the pav�ng,
drainage, fighting and name signage of border streets on an assessment
paving basis. {Reference Section Vi, Item 3, Deveia�ment Procedt�res
Manual.) 5aid perFormance and payment bonds or cas� �eposits m�ast be
fu�nished to the City prior ta execution of this contraet.
Where the City lets the co�tract, perFormanc� and payment bonds shall be
deposited, in the amount of one hundred percent (1QQ°/a) of the �stimated
cos� of construcfiion as s#ated in the construction contract, is required prinr to
issuanc� of a work order by the City.
3. For Wafier and Sanitary 5ewer �aciltfies,:
PerFormance and payment bonds, or cash deposits, acceptabfe ta the City
are required to be fiurnished by fhB developer for the installation of water and
sanitary sewer facilities.
a. Where the develaper lets the consfruc�ion contract far water and
sanitary sewer facilities, performance and payment bonds shafl �e
�eposited, �� the amount of one hundred percent (10D%} of the
estima#ed cost of construction, cash deposited s4�a11 be in the arnour�t
af one hundred twenty-fi�e percent ('f 25%), as stated i� the
construction contract, is required to be furnished s�multaneous with
execution of the construction contract. �

b. Where the City lets the contrac#, performance and paym�nt bonds
shall be deposited, in the amount of ane hundred percent (100%}
of t1�� estimated cost of construction as stated in the construction
contract, is required prior to Essuance of a work arder by the City.
4. Y�pes oi �[aaranfees:
a. Perfarmance an� Pavm�nt Bonds: Are required for the construction
of streets, storm drains, str�et lights, and sfreet name signs, the
fo{lowing terms �nd cond�tions shali apply:
(1) The bonds will .be standard perFormance and payment bonds
pravided by a licensed surety campany on #orms furnished by
that surety com�any.
(2} The bonds will be subject to the re�iew and a�prova! by the City
Attorney.
(3) The perFormance bond shali �e payable to the Cify and shall
guarantee performance af the street, storm drain, street light,
and street name sign cons�ruction contempla#ed un�e� t�is
contract.
(4) The Payment Bond shall guar�ntee payment �or a!{ iabor,
materials and equ�pmen� fiurnished in conn�ction with the str.eet,
s#orm dra�n, street light, and street name sign constructian
contemplated under fhis con�ract.
_ (5) ln order for a surety company to be acceptable, the name ofi the
surefy shall be includ�d on the current U.S. Treasury list of
acceptable sureties, and the amount of bond written by any one
acceptable company shall not exceed the amounf shown on the
Treasu.ry list for that company.
b. Cash Deposits: A cas� deposit shall be acceptable with verification
that an attempt to secure a bo�d has been denied, such deposit
shall be made in the Treasury of #he Ci#y of Fort W�_ ���C;� �.�
Fort Wor�h wiH not pay interest on any suct� cash dep�sli.

{1) At such time that the contract is bid far projects other than
assessment pro�ects, the cash deposit shall .be adjusted to one
hur�dred twenty fi�e percent (125%} af the act�al bid price. No
contract shall be awarded and no work order shall be issued
until such adjustment is made.
(2} When a cash deposit is made, the addiiional twenty five
' p�rc�nt (25%) beyond the on� hundred percent (� OQ%) of the
es�imated developer's share �epres�n�s additional funds for
� change orders durin� the course af tl�e project. This twenty fi�e
pefcent (25%} sh�11 be considered the developer's change
order fund. �
(3) If �he developer makes a cash deposit with the City, the
deve�oper may make timely withdrawals from the cash funds in
order to pay the contractor �ndlor subcontrac#or based on
amaunt of construction wark completed as approved and
uerified by the City Eng�ne�r or authorized representat�ve. For
pro�ects whase actual total contrac# cost is $400,OQ0 oT grea�er,
such r�lease of security sf�all ec�ual the percentage af work
completed for that period multiplied by nine#y-five percent
� {95°/fl}. This percentage
shall be applied to the actual eurrent iotal contract cost ta
determine the amount that may be reduced upan request of
de�eloper. For pro}ects whose actual fiotal contract cast is less
than $400,OOQ, suc� release of security shail equal #he
percentage of work completed for that period m�ltipiied by
ninety percent (9D%). This percentage shalf then be applied to
the actual current total contract cost to determine the amaunt of
security that may be reduced upon request of developer. The
remaining security, �i�e p�rcent (5%) for proj�cts of $400,000 or
greater and ten percent {10%) for projects less t1�an $400,000

togeth�r with the remaining funds from the Developer's Chang�
�rder Fund, if any, will be released to the developer after the
project has b�en accepted by the City. Partial refease of funds
shatl be limii�d to once per monfih. There shalf be no partiai
release of fUnds fo� projects of fess than $25,000. Proof that the
d�veloper nas paid the contractor shall be r�quired for partial
r�l�ases.
5. �urnose. ierm and f�et�ewal of �uaranfiees:
a, Performance and paym�nt E3onds, and cash deposits furnished
hereunder shall be for t�e purposes af guaranteeing sat�sfaciary
compfiance by the de�eioper with all requiremen�s, .terms and
condit�ons o# this agreement, including, but not limited to, the
satisfac#ory completion of the improvem�nts presc�ibed here�n, and
the malting of payments fo any p�rson, firm, corporation or other e�fity
with whom tY�e de�eloper has a direct contractUal relatianship for the
performance of work hereunder.
b. D�veloper shall keep said performance and payment bonds, andlor
cash deposits i� fit�11 force and efFect un�il such time as developer has
fiuNy complieci with the terms and cond9tions of �his agreement, anc�
faifure to keep same �n force and effect shall constitute a default and
breach of this agreement.
H. The City shall �ssume its sha�e c�f the cost ot the improvements covered by this
agreement along with the �ngineering fee only if funds are availabie for such
partic�pation. fn the� event that no funds are �vailable for City participation, the
developer shafl award th� contract and deposit with the Ci�y a perfarmance and
payment bands or cash for 100 pereent of the estimated total construction cast of
the �mprovements [p[us ten percent (1Q%) far engi.neering and miscellaneous casts
if the City prepares the plans].
, i. On al1 facilities inciuded ir� this agreement for which the developer awards its own

1. �f the City pa�tici�ates in the cost of th� faciliti�s, the construction contract
must be advertised, bid and awarded in accorda�ce with State statutes
prescribing the requirem�nfs for the letting of contracts for the construction
ofi public work. This incfucl�s ad�ertising in a loc�1 newspaper at least twice
in on� or more r�ewspapers ofi general circulation in the county or counties in
which the work is to be performed. The second pubiication must be on or
before the tenth {� Oth} day be�ore the first dafe bids may !�e submitted. The
bids must be opened by an afficer or employee of the City at or in an office
of the City.
2. To em�loy a canstructian contractor, who is approved by the Directo� of the
Deparkment having jurisdictior� over ti�e facility to be so constructed, said
contractor to me�t Cifiy's requirements for b�ing insu�ed, licensed and
bond�d �o do work in pu�lic right of way.
3. To re�uire #he coniractor. fa furnish to� the City payment, perfarmance an�
maintenance bands ir� the names of the City and the developer for one
hundred percent {9 00%} of the confract pric� n�f the faciiity, said bonds to be
furnished before work is commence. Dev�loper fur�her shall require th�
contr.ac#or to pro�id� public liability insurance in the amounts required by the
City's specifications co�eri�g that particula�- work.
4. To give 48 hours notice to the department having jurisdiction of intent to
commence construction of the facility. so that Cify inspection personnel will
be available; and to re�uire the contractor to allow the � �

2. Irrespective of any such �lecfiion and whether the wark is to be
performed by the City, ar by its contractor or by the developer through its

p�rformance and payment guarant�e in accardance with the provisions of

L.. The City's Policy for the Installat9on of Communiiy Facilities, as adop#ed by the City
Council an September 1992, is hereby incorporated herein by reference, and
Developer covenants and agrees to comply w�th said Policy as a condifion of this
contract and as a condition to the platting of the subject property.
M. The fiollowing descriptions of work apply, as appropriate, to the areas included �n
the Community Facilities Agreement:
1. STREETS
Streets as shown in Exhibit B will be in accordance with plans and
spec�fications prepared by the Owner's engineer and appro�ed by the
Director of Engineering.
2. STORM DRAlNAGE
Storm drain as shown in Exhibit B— 1 will be jn accardance with plans and
specifications prepared by the Owner's engineer and approved by the
Director of Engin�ering.
3. STREET LIGHTING
a. The dev�loper shall provide for #he installation of stree#fights at the
approximate locations shown in exhibit "C", immediately after final
acceptance of the sfreet construction in accordance wit� �ngineering plans
and specificatiorts approved by the Transpor�atior� and Public Wor4ts
Depar#ment. �
b. Streetfights on residential and 1 or co{lector streets can be installed using
overhead or undergrourt� con�ucfiors with the approval of the Director of
Transportatian and Pub�ic Works.
c. Streetligh#s on atterial streets shall be installed with underground conduit
and conductors.
d. The De�elo�er shalf pro�id� for tne instailation of a 2���cF� scheduie 4D
PVC conduit at the depth riot less than 30 inches and at least 'l8 inches
behind the curb, "clear from al1 other utilities". �

PVC conduit between streetlights proposed fo� installation and the power
source to hecome operational,
f. A 3-inch schedule 80 PVC conduit is required when crossing streets at

Concrete pull boxes s�ail be pro�ided at the crossing points.
g. Luminaire ballast shall be rated for multitap operafiion and eac� fuminaire
shall have it's own �.hofocell.
A�. TRAFFiC CONTROL DEVICES
a. The Developer agrees ta pay for the street r�ame sign installatians required
by this de�elopment to the extent of $80.00 per ir�spection. This unit cost
wili �e revised annual{y by the De�artment of Transpor�ation and Publio
Works to reflect pre�ail�ng costs of materials and labor.
b. This c�evelopment creates the fo�lowing number inter5ections at a total cost
as shown to the Developer,
c. The Developer r�ay either deposit cash funds with tf�e City �qual #a th�
� following amount at the time of Community Facilities Agreement aQproval
or wait until th� stre�t name signs are ta be installed. If the Dev�loper
eiects io wait, the cost of street name signs will be at th� rat�
prevailing when the Developer deposits funds with the Ci#y.
d, TY�e City will install the street name signs upon final approval of the street
constr�ction. The street name signs wi�l remain t�e property of, and wil{ be
main#ained by, the City.
5. OTHER WORKS
In the event that ather works is required it will be inclu�ed as specific
requirements to Community Facilifies Agreement,
N. De�efoper and City agrea that this Agreement represents the compl�te and
exclusive statement of tne mutual understandings of the parties and thaf this
Agreement supersedes and canc�ls anc� previous written and orai agreements and
communicatEons relat�d to the subject matter of fhis Agreement.

RECOMMENDATlON:
It is recommended that the City Councii authori�e the City Manager to execute a Community Facilities
Agreement w�th Barham & Harris One, L.P., for the ins�allation of community facilities far Park�iew Hills
Additian, Phase I.
DISCUSSION:
On December 19, �000, the Gity Council adopted a resolutian autharizing the issuance of $45 million i�
Certificates ofi Obligation ta address critical projects which inclt��ed $4 milfion in development funds
($2.5 million for CFA new development f�ands and $1.5 million for deveEapment funds related to new
school sites) tv supplement t�e 1998 Capi�al Improvement Program new de�eiopment funds.
Barham & Harris One, L.P., the de�eloper of Parkview Hills Addition, Phase I, has executed a�roposed
contracf for community facili�i�s io s�rv� a 168 lot, singl�-family de�elopment located in �arthwest Fort
Worth, north af Cramwefl Marine Creek Road and west of Old Decatur Road (see atiached map).
This der►elopmen# has four {4) interior streets. The developer is respansib�e for all pa�ing impro�e-
ments. The City will be responsible for over-sized s#orm drai�age impravements.
There will be twenty (20} street lights installed. The de�eloper is responsible for the installat�on of
underground condui� and pole bases, The City's participation is for insta[lation �f all wiring and street
light fExtures.
Th�re are ei�hi (8) intersections where street signs will be insta�led at ihe City's cost. Sidewalks will be
installed along the entire development. This CFA is in compfiance with standard City policy.
The es#imated cosi of the community facilities is as follows, and subject ta the actual bid price:
