WHEREAS, the City of Fort Warth {"City"} and Freese & Nichols, Tnc. ("Consultant")
made and entered into Cfty of Fort Worth City Secretaty Contract �`�10. 28438, ("Contract"); and
WHER.EAS, the Contra.ct involves pz`afessional services far the following project:
French Lake Dam Rehabilitation; an�.
WHEREAS, it has become �necessary tc� amend the Confisact to includ� �.n increased scop�
af wark andlor revised maximum fee.
NOW, THEREFORE, City and Co�sultant, acting herein by and through their
duly authorized representatives, enter into th.e following agr�ement which amends the contract:
1.
Article I, Section A of the Contract is amended to include the additional engineering
services specified in a letter dated April 3, 2003, a copy o#' which is attached hereto az�.d
incorparated herein.
2.
Article II af the Cantraet is amended to provide for an increase in the rnaximum fee in
th� amaunt o� $ 7,SSQ, which is to be paid to Consultant �or all work and services under ihe
Coniract, as a�nended, so that the total fee to be paid by City for all work and services shall not
exceed the sum ai' $ I20,55Q,
3.
All ather provisions of the Contract that are not e�pressly amended harein shall remain in
full force and effect. ���. �

Dear Mike:
Per our telephone conversation regarding additional engineering services related to the
above referenced proj�ct, I ha�e included the foilowing ad�iitional_scope items for your
review. The tota.l cost to perform Tasks 1— 3�e7vi11 be $7,550.
Task 1- Meeting with the City. The objective of t�tis
meeting is ta identify permitting requirements, develop the permitting
approach {if required} and discuss the detaails far the St�rrn Water
Palluiion Preventior� Plan (SW.PPP).
Task 2- Prepare a Notice of Intent Form and S WPPP. We wi11 assist �he City and
its contractor with preparation of a Notice of Lntent form to obtain coverage under
�he NPDES/TPDES general permit for storm water disckarges from constructian
activiiies. In addition, we will prepaxe an SWPPP that the cantractor is required
io maintain at t�e constructian site. It is �.ssumed that the site ptan for the �WPPP
will be adapt�d from the �xisting construction drawings. Preparatzon of a ne�w
site plan will require tha City's authorization of addition.al services.
Task 3- Prep�z'e e�raft "Guide�ines far City Acquisition of Property
Containing Surface Water Impoundnaents": This effort zs tc� summari�e
pertinent State of Texas regulationshe�uirements relating to
dam safety and vvater rights Yssues. The puzpose of #his 2-3 page guideline
is to assist the City in considering the issues arid poss�ble�
financial liabilities related to �ssuming ownership af development lands
cantainin� farm ponds and dams. We will submit three draft
capies of the guideline to the City for review and comment within 30 days
after receiving the nptice to proceed. Af}er receiving City comtrtents, we
will prepare and submit one camera-ready copy and one electranic
copy of the final "Guidelines" to the City within ten days.

SUB.JECT qppROPRIATION ORDINANCES AhJD AWARD DF ENGINEERlNG CONTRACT TO
F'REESE & NICHOLS, INC. FOR REPAIR OF FRENCH LAKE DAM
RECQMMEN�ATION:
It is recommended that �he City Council:
1. Adopt the attached appropriation or�inance increasing estimated receipts and apprapriations by
$366,'[46 in the General Fund firom availabie funds; and
� 2. Approve #he transfer of $366,�46 from the General �'und fo the Park improvements Fund; and
3. Adopt the attached apprapriation ordinance increasing estimated receipts and appropriations by
$366,146 in the Park Impro�ements Fund from available funds; and
4. Authorize the City Manager to execute an engineering agreement with Freese & Nichols, Inc. in the
amount of $113,OOQ for the damage assessmenf, engineering and preparation of plans and
specificati�ans for repairs to French LaEce Dam.
D15CU5SION:
On December 2, 2D02, the ear�hen dam at French Lake was discovered ta be ]eaking. Initial
assessments by Transportation and Public Works Depa�tment (TIPW) engineers indicated that dam
integrity was fhreatened and actian was taken to lower fhe lake le�el in order to r�lieve pressure on t}�e
dam.
Due to the urgency of this situation, City staff praceeded to obtam technical assistance from a local
engineering firm, F'reese & NEchols, Inc. (FNI), to determine the probable cause af dam seepage. As a
short-term plan to protect the dam from further deterioratian, FNI recommended canstruction of a
diversion channel, which was completed by TIPW personnel on December 17, 2042. In cansultation
�vith the City Attorney's Office, staff concluded that the emergency situatior� at Frenc� Lake was exempt
from the Texas Local Government Code request far praposal requirem�nts and compefi�ive bid
requirements.
FNI's scope af work €ncluded geotechnical soil borings, hydraulic and hydrology analyses, local
revi�ions to th� ffoodplain map, engineering design, and the preparation af p[ans, specifica�ions and
cast estimates. Recommend�d dam repairs include:
� Excavation and removal of the existing intake structure and drainage outfe#; and
� Construction of a new intake stTucture and outlet, which wiil allow for n�cessary flow capability
during storm ev�nts; and
� Rewor�C of the existing stone wall at the pedestrian ��idge; and
� Raising khe surFace elevation of the s�illway area.

Construction doc�aments were com�leted by FN1 in late January 2003. Staff intends to negotiate a
contract and will proceed to o�tain quot�s and select a contractor in February 20fl3. Upon approval
from the City Cauncil, staff will proceed with an award of contract and commenc� consfruction in March
2003, with cpmpletion in June 2D�3, contingent on weather and canfirmed site conditions.
Thfs plan of actior� was pre�iousfy outlined in Informal Report No. 8461, dated January 28, 2003, which �
indicat�d that the tatal proj�ct cost would be $416,fi�fi, af this amount, $5�,520 will be funded from
COUNCIL DISTRfCT 6, Undesignated Funds and $366,146 will be funded from the General Fund.
MIWBE requirements are ►nrai�ed due to the emergency nature of solicitation of design services.
French Lake is Iocated in COUNCIL DISTRICT 6.
FISCAL INFORMATIONICERTiFICATION:
The Finance Dir�ctor certifies that upon approva[ of t�e a�ave r�commendations and adaption of fhe
attached appropriation ordinances, funds will be available in the current capital budget, as appropriated,
of tF�e Park Impro�ements Fund.
