WHEREAS, Weiz�.garten Realty In�estors, hereinafter called "Developer", desires
to make certain Offsite Water and Sewer Improveinenfis to Block l. af the Golden Beach
Marketiplace, an addition to the City of Fort Worth, Texas; and
WfiEREAS, the said Developer has requested the City of Fart Worth, a municipal
corparation of Tarranfi and Denton Counties, Texas, hereina.fter called "Ciiy", to do
certain work in connec�ion with said improvements.
NOW, THEREFORE, KNOW ALL BY THESE PRESENTS :
Thai said Developer, acting herein by and ihrough A1an Kofoed, its duly
authorized Vice President, and the City, acting herein by and through Marc Ott, its duly
aut�orized Assistant City Manager, for and in consideraiion of the covenants and
conditions contained herein, do hereby agree as follows:
T. General Rec�uirements .
A. The Policy for the Installation of Commurn.ity Facilztaes ("Polic}�') dat�d

March 2001, approved by the City Council of the City af Fort Wort1�, is
hereby incorporate� into this Community Facilities Contract as if copy
herein verbatim. Developer a�ees to comply with. all provisions of said
Policy in the performance of its duties and obligations hereunder.
Th� requirements of the Policy s�all gav�rn this Community Facilities
Ag�reement, provided, hawever, that any conflict between the terms pf this
Ca�nmuruty Facilities Agreemenf and the Policy shal� be resolved in favor
vf this Agreement.
Developer shall provide fnancial security in confozma�ce with paragraph
6, �ection II, o�the Polzcy.
The De�eloper shall a�vard all coniracts for the construction of community
facilities in accordance wiih Section II, paragraph '1 of ihe Policy.
E, The cantrraets for the construction of the public infrastrr�cture shall be
adrninisiered in conforinance with paragra�Yx � a�E�-.,i,���?����'�h� Policy.

WHEREAS, the said Deve�oper has requested the City of Fort Worth, a muniaipal
corporation of Tarran� and Denton Counties, Texas, hereinafter called "Ci�y", to do
certain work in connecfaon with said improvements.
NOW, THEREFORE, KNOW ALL BY THESE PRESENTS:
That said Develo�aer, acti.ng herein by and thrQugh Alan Kofoed, its duly
authorized Vice Pre�ident, and the City, acting herein by and through Marc Ott, its duly
authorized Assis�ant City Manager, for and in consider�.tion of the covenants and
condztivns contained herein, do hereby agree as follows:

The requirements of t�.e Policy shall govern this Commwuty Facilitzes
Agreem�nt, provided, however, that any canflict betwe�n th� tsnns �f this
Commur�iiy Faeilities Agreement axzd the �olzcy shall be resolved in �avor
o�' this Ag�reement.
Developer shall provide financial security in conformance wi�h paragraph
6, Section II, pf the Po�icy.
The Developer shall award alI contraets �or the constrnction of community
facilities in accordance with Section II, paragraph 7 of the Policy.
E. The cvntracts for the construction of ihe public infrastructure sha11 be
adznu�istered in conformance with paragra�h �,���;�p�;�;;;�j��h� Policy.

II. Water and Sewer Facilities
A. Develaper shall install the prflposed water line(s), fire line(s) ancllor
me#ers as shown on Ea�hibit A, the estimated cost of which is $2d'�,9��.00.
The DeveIoperr and the Ciiy sha11 share the cosl of this facility. The City
agrees to record the location of each said service line in respect to the
corner of the lot sezved, and ta retazn said records in its poss�ssion.
B. Developer shall install sanitary main as shown on Exhibit A-1, the
estimated cost o� which �$394,�46.0Q The Develaper and ihe City sha11
share the cost of th�is facility. The City agrees to reaord the Iocatian of
each said service line in respect to the corner of the iot served, and ta
retain said records in its possession.
C. The distribution of estimated constYuction cost between the City and the
Developer as stated herein for all water and sanitary sewer faci�ities to be
canstructed hereunder is es�imated as follows:

IMPROVEMENTS TO BLOCK 1 OF THE GOLDEN BEACH MARKETPLACE
RECOMMENDATION:
It is recommended that th� City Council authorize the Ci#y Manager to execute a Community Facilities
Agreement (CFA) with Weingarten Realty Investors for the installation of the offsite water and sewer
services to serve Block 1 of the Golden Beach Marketplace, a fufure retail developm�nt (incl�di�g an
Albertson's Store), east of North Beach Street in #ar north Fort Worth.
DISCUSSION:
Weingarten Reafty Investors, the develo�er of the Golden Beach Marketplace, has executed a
propose� contract #ar cammunity facilities to serve a large refail development locat�d �as� of North
Beach Street in #ar nor�h For� Warih {see a#tached map).
The cost far water and sewer improvements for this development, including inspection fee, is $fi14,2fi8.
There wil! be City par�i�ipation in wat�r pipe oversizing 16-incF�B-inch, sewer pipe oversizing 24-inc�/
8-inch, and 29-inchl8-inch to increase pi�e capacity in Golden Triangle Boulevard. This oversizing
will help the area develapments. The de�eloper and Cify estimated costs for water and sewer
improvements are subject to construction inspection fees.
The de�eloper is res�onsible for paying for a 28-foot width of pa�ement, and the City will pay far an
add�t�onal 9 feet of par�ement, making Golden Triangle Boule�ard 37 feet wide.

On Dec�mber 19, 2Q00, the City Council adopted a resolution authorizing the issuance of $45 million in
Certificates of Obligation to address critical projects that include $� million in de�elapment funds ($2.5
milfion for CFA new develapment funds artd $1.5 million for dev�lopment f�nds related to new school
sites} to supp[ement the 1998 Ca�ital Improvement Program new development funds. The project
incfuded funds for fihe constructi�n ofi Golden Triangle Boulevard_
This de�efopment is locate� in COUNCIL. DISTRICT 4.
