HomeMy WebLinkAboutContract 28528GIiY ��C��i��Y - SECOND AMENDMENT TO �'�N���G`� � ^ 3 • c, � ' � + -�._� CTTY SECRETARY CONTRACT NO. 172Q1 CITY OF BURLESQN WHOLESALE WATER CONTRACT WHEREAS, on the 27th day of June, 1989, the City of Fort Worth and the City of Burleson entered into City oi Fo�k Worth City Secretary Con�ract No. 17201, providing far the sale of treated water by the City of Fort Worth to the City of Burleson; and V�7HEREAS, on the 2"a day of July, 1991, the City of Fort Worth and the City of Burleson entered into City of Fort Worth City Secretary Contract No. 1858�, amending City of Fort Worth City Secretary Contxact No. 172Q1; and WHEREAS, the City of Burleson desires ta obtain an addi�ional point of conneciion to the Fort Worth Sy�tem, as well as contribute ta ihe cost of a water main that Fort Worth is constn�cting that will enable the City of Burleson to obtain addinonal water frorn the Fort Warth System, such main being known as the 36" Squthside III Waier Main; and WHEREA�, Gity of Fort Worth Ciiy Secretary Coniract No. 17201 pro�ides that for the cost of each additional cannection to the Fort Wortb Sysfiem, the City of Burlesan will pay an amnunt nofi less than that which would be paid by a deveIoper to Fort Worth under Fort Worth's then e�isEi�ug connection and line extension policy, ox ax� amount agreed upon mutually by Fort Wo�th, Burlesan, and the Water System Advisor�r Cammittee; and NOW, THEREFORE, KNOW ALL BY THESE PRESENTS: i. City of Fort Wart�i City Secretary Contract No. 17201 is amended by adding a new paragraph 24, which shall be and read as #'ollaws: 24. Additional Point of Connection 24. ]. In consideratian of Customer's agreement to make the �ayments described in paragraph 24.4 below, Customer is granted a third point of conn�ction to the Fort Worth System at the approximate locat�on as shown on Exhibit "A" attached hereto and made a part hareof for a11 purposes. The meter to be instaIled at such cannection shall be a sixteen� inch {16"} metez. Customer's failure to maka the payme�ts described in paragraph 24.4 below shall enti�le Fort Worth to suspend waiez� service through this �hird point af co�ection until payments are �rought currez�t. . . �' � 24.2 Custorner, at its sole cost and expense, shall be responsible for the design and construci'ron of th� meter vault and the installaiion of a11 metering equipment, which shall be subject to the review and approval of Fort Worth. The metering equiprnent shall be in compliance with paragraph 31 of City of Fort Worth City Secretary Contract No. 17201. All construction shall be inspected by and acceptabl� to F�rt Worth. Upon completion and acceptance of ihe metar vault and metering �quipment, the operation and maintenance of same sha11 he the responsibility of Fort Worth, the cost thereof being a Systern Cost. 24.3 Customer, at its sole cost and ex�ense, shall design, construct and install a backflow prevention device, together with any necessary housing therefare, which shall be suhject to the review and approval of Fort Worth. Custamer, at its sole cost and e�pen�e, shall be responsible f�r the operation and maintenance of such backflow prevention device and hausing. In lieu of th� installation of a backflow pr�ventian de�ice, Customer may install an air gap, such air gap to be appraved in vvriting hy Fort Worth prior to installaiion, on Customez''s ground storage tank immeaiately after the m�ter; provided, havwever, that no servi.ce lir�e or main �ine connections will be installed befween the meter and the graund storage tank. 2�.4 Fort Worth and Gustomer further agree that Custamer's cost associated with fihe canshuction of the 36" Soutl�side III Water Main is $2,482,94D, such cost being based upon C�stomer's estimated capacity/demand in 2p2Q, and estimated cost for the consinzction, engineering and acquisition of rights-of-way. Upon completian af construction, Customer's costs shall be recalculatec� using the actual costs incutxed for engineering, canstruction, and acquisition af rights-of-way. �uch recalculated amount shall b� payable over a period o� sixty (60) months and shall accrue interest at the rate of s� percent {6%) par annum from the date af completion and final acceptance hy the City. The Customer shall be natified in writ�ng of the date of final acceptance. Notwithstat�ding, Custom�r may make additional andlor early payments without penalty of any type. The monthly payment shall be billed by Fort Worth vc�ith the montl�ly bill issued for wbolesala water ser�ice. Late payments shall accrue intearest at the rate of 1% }aer month or at the highest ra�e permit�ea by law. 24.5 In the event Customer desizes to have a lar�er meter installed at a time when the sixteen-ia�ch (16") meter is not otherwise in need of replacement, Customer shall make written requesi to Fort Worth for its considerafiion. If Fort Worth, in its sole discre�ion, approves the ins�allation of the larger meter, Customer, at its sole cost and expense, will be responsible for the design of the improvements, such design being subjecf to Fort Worth's written approval. The installafiian of the larger mefier will be at Customer's sole cost and expense. In addition, the Custam�r's cosi as stated in paragraph 24.4 above will be reea�culated to include the additional capacity/demand allowed by the meter. 24.6 Fart Worth agrees to charge any wholesa�e cusiomer who in the future connects directly to the 3b" Southside III Water Main based upon the methodology contained in paragraph 24.4. ,� � � , ��, ' . ., : , R 2. Authorize the City Manager to execute amendmen#s to wholesale water contracts with the City of Burleson, City of Crowley, and Bethesda Water Supply Carporation providing for cost participation by these entities in the proposed water transmission main extension to meet each customer's estimated capacity/demand in 2020; and 2. Authorize the City Manager to execute a contract with S.J. Louis Construction af Texas, Ltd., LLP, in the amount of $2,781,800 for the Soufhside III, 36-[nch Water Transmission Main Extension from Cfeburne Crow[ey Road to the City of Burleson at Shannon Creek. DISCUS510N: Dn A�gust $, 2001 (M&C C-18713), the Ciky Council authorize� the City Manager fo execute an engineering cor�tract with Freese & Nic�als, Inc. to prepare plans and specifications for fhe Southside ll[ water transmission main from Cleburne Crowley Road to the City af Burleson afi Shannon Cr�ek. This project will accommodate new growth in the Fart Wort� extraterritoria[ jurisdiction, as wefl as areas currently s�nr�d by wY�olesa[e water customers (Bethesda Water Supply Corporation and the Cities of Burleson and Crowley). [n order to share in the costs of the overall �roject, wholesale water contracts must be amended.
