HomeMy WebLinkAboutContract 28530i � ' ���`'� ��{:������ ������1 � SECOND AMENDMENT TO CCJNTRAC� i� ..� -"_._ .— .._...._ CITY SECRETARY CQNT`RACT NO. 19352 BETHESDA WATER SUPPLY CORPOR.ATION WHOLESALE WATER CONTRACT WHEREAS, on the 22"d day of September, 1992, the City of Fort Worth and the Bethesda Water Supply Corporation entered into City of Fart Worth City Secretary Contracfi No. 19352, providing for the sale of treated water by the City of Fort Worth to the Bethesda Water Supply Corporation; and WHEREAS, on the 30th day of March, 20Q1, the City of Fort Worth and the Bethesda Water �upply Cotporation entered into City of Fort Worth Ci�y Secretary Contract No. 26644, amen.ding City of Fort Worth City Secratary Cantract No. 19352; and WHEREAS, the Bethe�da Water Supply Carporation desires to abtain an additional point of connection fo the Fort Warth System, as well as contribute to the cost of a water main that Fort Worth is canstructing that will enable the Bethesda Water Suppiy Corporation to obtain additiona� water �rom the Fort Worth Syste�n, such main being known as the 36" Southside Water Main; and WHEREAS, City of Fart Worth City �ecretary Contract No. 19352 provides that for the cost of each additional eonn�ctian to the Fort V�orth System, Bethesda Water �upp�y Cozporation will pay an amount not Iess than that which would be paid by a developex to Fort Worth under Fart VVorth's tben exisking connection and line extension policy, ar an amow�t agxeed upon mutually by Fort Worth, Bethesda Water �upply Corporation, and the Water �ystem Advisory Committee; and WHEREAS, on the 20�' day of February, 2�01, ihe City of Fort Worth and Bet�esda Water �upply Corporation entered into an amendna,ent to City of Fort Warth City Secretary Contract 19352, such amendment bcing City of Fort Worth City Secretary Con�ract Na. 26644, wherein Bethesda Water Supply Corporataon agreed to cons1;ruct certain improvements to f,he Faxt Warth System. Ciiy of Fart Worth City Secre�ary Contract No. 19352 is amended by addang a new paragrapb 24, which shall be and read as follows: 24. Additional Point of Connection 24.1 The meter to be installed at such connection shall be a su�teen-inch (16"} meter. In consideration of Custornar's agreement Yo make the payments described in paragraph 24,4 below, Customer is granted a third point of connection to the Fart Wa:ril� System at the appraximate location as shown on Exhibit "A" attached hereta and made a parE hereof for a11 purposes. The meter to be installed at such cormecnon shall be a sixteen-inch (16") meter. Customer's failure to make the payments described in paragrapb 24.4 belaw shall entitle Fort Worth to suspend water service through this fihird point of connection until paytMents are brougt�.t curreni. 24.2 Custamer, at its sole cost and expense, shall be responsible far the design and construction of the meter vault and the installat�on of all metering equipment, which shall be subj ect to the review and approval of Fort Worth. The metering equipmenC sb.all be in compliance with paragraph 3.1 of City of Fort Worth Gity Secretary Contract No. 19352. Ail construction shall be inspected by and acceptable to Fort Worth. Upon comp�etion and acceptance of the meter vault and metering equipment, th� operation and maintenance of same shall be the r�sponsibility of Fort Worth, the cost thereofbeing a System Cost. 24.3 Customer, at its sole cost and expense, sha11 design and construct install a hac�flow prevention device, tog�ther with any necessary housing ther�fore, which shall be subj ect to the review and approval of Fort Worth. Customer, ai its sole cost and expensc:, shall be responsible for the operation and maintenance of such backflow prevention det+ice and housing. In lieu of the installation of a backflow prevention device, Customer may in5tall an air gap, such air gap to be approved in writing by Fort WartS� prior to installation, on Custamer's ground storage tank immediately ai�er the rneter; provided, however, that no sez-vice Iine or main line connec�ions w�ill be installed between the rneter and the ground storage tank. 24.4 Fort Worth and C�xstomer further ag�ree that Cusiomer's cost associated with the construction of the 36" Southside III Water Main is $2,482,940, such cost being based upon Customer's estimated capacity/demand demand in 2Q20, and es�unated cost for the construction, engiineering and acquisition af rights-of-way, and after the credit far Custnmer's cos� incurred under City of Fort Warth Ciiy Secretary Contract No. 26644. Upon completion af construcfion, G�istamer's costs shall be xecalculated using the actua.l costs incurred for engineering, construction, and acquisition of rights-of-way, Such recalculated amount shall be payable over a period of sixty (60) months and shall accrue interest at the rate of six percent (6%) per annum from the date of campietion and final acceptance by the City. The Customer sha11 be notified in writing of the date of final acceptance. Notwithstanding, C�istomer may rnake add.rtianal and/or ea,rly payments without penalty. Late payments shall accrcte interest at the rate of 1% per month or at ihe highest rate perrnitted by law. 2�L.5 In ihe event Customer desires to have a Iarger meter installed at a time vvhen the sixteen-inch (16'� meter is not otherwise in need of replacement, Customer shall make written request to Fort Worth for its consideraiion. If Fort Worth, in its sale discreiion, approves th� installatian of the larger meter, Customer, at its sole cost and expense, will be responsihle %r the design of the im�rovements, such design being subject io Fort Worth's written approval. The instaliation of tli,e larger meter will be at Customer's sole cost au.d expense. In addition, the Custom�r's cost as stated in pa�ragxaph 24.4 abave will be recalculated to include the additional capacityldemand allowed by the meter. 24.6 Fort Worth agrees to charge any wholesale custom�r who in the fixture connects directly io t;ie 36" �outhside III Water Main based upon the methodology contained in paragraph 24.4.
