V�THEREAS, the said DeveXoper has requested the City of Fort �orth, a municipal
corpa�atioa� of Tarran�t and Denton Counties, Texas, hercinafter ca.11ed 44City", to do
certai.n work in conneciion with said improvezne�ts.

That said Developex, ac�ing hereixz by and through Ray Baoihe, zts dnly
authorized Fresident, and the City, acting herein. by and through Marc Ott, �ts duly
authorizeci As�istant City Manager, for and in cansideration of the covenaxzts and
co�.ditions contai�n�d herein, do hereby agree as follows: -

hereby iz�corporated into this Coxxunux�ty Faczlities Cantrac� as if copy
herein verb�atim. Deve�oper agxees io eoxn�aly with aI1 provisions o� sai,d
Palicy is� the pezforma�zce of its duties and obligatinns hereunder.
The req�irements of the Policy sha11 govern this Cominuni.ty Facilities
Agreement, pro�ded, however, ihat any conflict betweer� �h� texYns of this
CQmznunity Faezlities Agxeement and ihe Policy sha.11 be resaJ�ved in favax
af thi.s Agreemez�t.
Developer shall provide financiai security in confoz�.ance with paragraph
6, Section a, of �he Policy.
The Develaper sha11 a�vard all contracis far the eo�struction of community
facilit�es in accordance w-ith Section II, paragraph 7 of the Policy.
The conirac�s for the constz-uction a�' the public infrast�uctur� shall be

G. Developez shall install ar adjust a�l o£ the r�quixed utilihea to sezve the
developmeni or ia construcfi the improvements required hexein.
H. Tn the e�eni that City partica.pation exceads $25,400, Developer agxees that
no street consin�ction ar storm drainage will begin p�'iox to City Councii
approval of �as Community Facilities Agreement. (Article 1,04.Z00,
Ordzna�ce 7234). . -
I. Deve�oper agrees that zao lot shall be occupied under a cexti.ficate of
occupax�cy uniil the impxovament� required�herein have bean canstzucied
{A.rticle 1Q4.1Q0, Ordinance 7234).
J. Developer here�y releases and agxees to indemni�y and �old fih.e City
harmless �or �a.y inadequacies in the prelimix�axy plans, specificatians and �
co�t estimates supplied by the De�veloper for thi5 contract.

RECOMMENDATION:
It is recommended that fihe City� Council authorize the City Manager to execute a Community Fac9liti�s
Agre�ment with Historic Landmark, Inc. dlbfa Ar�Spac� Texas, fnc. �or the installa#ion of parkway
improvements along West Shaw Street fram Hemphill Street to Lipscomb 5treet that are raquir�d �o
meef curr�nt City standards, far a fotal Ci�y participation cost of $52,000:

DISCUSSION:
On May 'f4, 1996 (M&C C-�54�9}, the Gity Council approved a loan in the amount of $287,40a with
His#oric Landmark, lnc. dlbla ArtSpace Texas, Inc. to assist in fhe develapment ofi a mixed-use project
in the Victory Arfs Cenfier (formerly Our Lady of Victory Con�ent) lacated at 3300 Hempi�ill St�eet.
Funding for th� loan came �rom tF�� City's federal Hame lnvestment Partnerships (HOME) program fo
be paid in five years.
The s�ace is being marketed as an artist community, but not exclusi��ly_ Rents are anticipafied to
range fram $530 to $1,800 a month. As a condition for C�fiy fundir�g, eight of the apartments will be set
aside for law to moderate-income residents, and will r�nt for about 55 cents a square foot.
�n February 15, 200a (M&C C-1786a), the Ci�y Counci[ approved an amendm�nf of th� contract to
e�end the foan ierm from 5 years to 15 years.
� On December 19, 2pD0, t�e Cify Council adopfed a reso{utior� authoriz9ng the issuance af $45 million in
Gertifiicates of Qbligation fo address critical projects which inc[udec[ $2,5 million in de�elopmen# funds to
supplement t�e 1998 Capifa� Improvement Program new de�elopment funds.
T�is project will include reconstruction of curb and gufter and sidewalks to City standard�. It will
impro�e pedestrian and vehicular safety.
This development is located. in COUNCIL DISTRICT 9.
