Ar�icle [[I ierms o� �ayment Payments to the ENGINEER wil{ be made as follows: Invoice and Payment {1) ihe ENGINEER snall pravid� the CITY sufficient docum�ntation to reasonably substantiate the invoices. (2) Monthfy in�aices wilf be issued by the ENGINEER for all work pertormed under this AGREEMENT. Invoices are due and payabie within 30 days of receipt. (3) Upor� campletion af services en�merated in Article I, the �nal payment of a�y balance will be due within 3� days of receipt of the final in�oice. (4) In the event of a disputed or car�tested billing, onfy that poriian so contested will be withheld fram payment, and the undisputed partion will be paid. The CITY wili exetcise reasanableness in cantesting any bili or portion tF�ereaf. No interest will accrue on any contested portion of the billing until mutuaEly resolved. (5) If the CITY fails to make payment in fu11 to ENGINEER for billings contested in go�d faith wiihin 60 days af the amaunt due, the ENGINEER may, after gi�ing seven (7) days' wr�tten notice to CITY, suspend s�rvices under this AGREEMENT until paEd fn full, including intarest. The West Sic4e IV Pump Station will replace the existing Chapei Creek Pump Station, expanding the West Side IV water service area and the water service delivery capability in far west Fart Worth. T�e new pump station is designed for future expansion to support development and the required storage in the West Side IV pressure plane. The transmission main and storage tank will be constructed under separate construction cantracts. On August 21, 2001 (M&C C�18718), the City Councii authorized the execution of an amendment of an engineering agreement with Camp Dresser and McKee, Inc. for the preparation of plans and specifications for the North Side Ili High Service Pump Statlon improvements and raw water pump station improvements. The improvements at the North Side I{I High 5ervice Pump station and the raw water pump station ar�e necessary to meet the increasing demand for water in the North Sid� I!I pr�ssure plane. Chiang, Patel & Yerby, Inc. proposes to provide construction management services for the consfruction of the West Side �V Pump Staiion and the improvements to the Norti� Side Ill high service pum� station. The setvices include review of submittals, shop drawings, pay requests, change orders and part-time construction inspection. Also included is materials testing and construction administration.
