In c�nsidexativn of the mutual promises contained in this Agreement, the parties
agree as follows:
RECITA�S
'�he City of Fort Warth is a home rule rr�uniaipal co�poration a�' the State af
Texas, located within Tar�rant an,d.Denton Counties, Texas.
The City desires ta retain a Plumbing Xnspector to provide the Services as set aut
in Ez�hibit, "A'° whach is attached hereta and made a part hereof for alI pwrposes, bezug
hereina.fter referr�d to as the "Sarvices". �
The Plumbinn Ins�aector agrees to perfozm the services as set o�zt in E�hibi.t "A".
AGREEMENT
The City and �hunbin� �nspecto:r, fiar and in � consideratian of tbe mut�al
covenants herein, set £orth agree as follows: .
Tt is agreed that the Ci.ty retains the P�umbing Inspecior ta pravide the Serviaes as
set out in Exhibit "A", subject to the terms, conditions, arad s#ipuiations under this
Agreern�nt.
� COMPENSA�'ION �
For and in consideratzon o� �he Services rendered by the Plumbing �ns�ector, the
City sha1l pay and the Piumbin� Inspector shall receive th� fees set farth in E�hibifi "A"
attached hereto and incarporated herein by reference. Plumbing Inspector shall no� accept
any compensation or anything af value from any contr�actar ox owner whose work is

PROFESSIQNAL RESPONSIB�LITIES
Plum�ing Inspector agrees ta perform said Services e�petlitious�y, on r�quest, in
accordance with sound and gezaerally accepted inspection p�incipals and standaxds, to
check �or compliance with the applicable City o�' Fort �Vorth Code or Codes.
When requested, the Plumbing Inspector sha11 conduct on-si�e plurnbing
inspections for compliance with regulatian established by the Cify or State for pluznbing
u�stailation.
All docutnents which come into t.he possession of Plumbing Zz�spector are and
shafl remain the praperty afthe City and shall b� maintai�ned as public records subject io
determination by the City otherwise.
CXTY REVIEW
P�umbing Inspector agrees and understands that City afficiais may, at thei�r
di�screfiion, make periodic site vis�ts to ��eview, inspect and duplxcate any inspectians
perfvzmed by the Plumbing �nspector in order to insu�e a quality cantrol o� �erf'ormance.
The city �fficial shall rr�aintain full i�terpre#ation authority of a�� af�ected cades as we11 as
the a�thority to requize corrections, incle�ding, but nat limzted to, no�ices anc�/or stop s,vork
orders. Plumbing Tnspector wnderstands that, upon comple�on o�a�l buikling pxojects, the
City official wi11 �erfozm a finaI inspection prior ta the issuance o� a cex#ificate of
occupancy.
TERMII+TATION
This Agreement may be tezminated �ay eiiher pa.rty for any reasan by giv�.�.g two
{2) days writt�n � notiae. The Ci#y reserves the xigktt to suspend or stop services
immediateiy. �

Any amendment to this Agre�ment must be in writing and signed by the
Plurrzbing Inspector and th,a City Manager of the City.

A�STSTANTS
Th� Plumbing Sr�spectox d�es not have t.�ie right to employ assistants or sub
plumbing Znspectors to pexforrn the S�rvices without t�e advaz�aed written consent of the
Ci�y D�velopment Direct�r. Al� assistanta c�r sub-p�umbing inspeciors empioyed by the
Plumbing.Inspector shall be �icensed plumbing inspectors. ,
INDEMNIFICAT�ON
Plumbing Inspeetor assumes the entire respan,szbzlity and �iabi]xty for any claim oz
action based on or arising out of injux��s, ineluding death, ta persons ar damages to ox
destruction af p:roperty, sustained or alleged tv have bee� stzstained in connection with or
to �ave ar�sen aut af ar inciden�tat to the pexformance fl� this contract by Plumbing
Inspector, regardless of w�ether suc� claims or actions are �oun�ed in who�e or in
paxt apon aixe�ed negligence of the Cifiy of Fort Worth, its off�cers, agents or
empl,oye�s, ar the employees, �.gents, invi�tees, or licensees �hereo£ In respect ta anv
�uch mat�e�rs as set out above, Piumbzng Zns�ector further ag,rees to indemini�y aud hald
harmless �tlz� City af Fart Worth, its officers, agents azxd ernpioyees and agrees to defend

A�SIGNM�PiT
This Agreem�nt shall not be assigned in whole or in part by the Plumbing
Ins�aectar.
LEGAL COl�i�TRUCTIOI�I
In ease of any on� ar more of the provisiQns cr�ntained in this Agreement shall �or
any reason be held to be invaIid, illagal, or unenforceable in arny respe�t, such invalidity,
i1��gality, or unenfarceability shall nat affect any other �roviszon and this Agxeem�nt
sh�It be construed as if such inva.Iid, illegal, ar unenforceable provision had never been
cantained in it.

by the City's Codes and the State af Texas;

sha�l be currentIy Iicensed plumbing inspeators;

The City is interested only in the results to be achzeved, and ths contrnl of th�

hours of work and the number of hours that he or she shail work ta accamplish the
pwrpases of this Agreement. -
P�2IOR AGRE�MENTS SUPERSEDED
This Agreem�nt constitutes the sole and ori�� agreement of the parties to it, arid
supersedes any prior unders#andings or written ar aral agreements between the parties
r�specting this subject mat#er.
T�XAS LAW TO APPLY
'S'his Agreement shall be consirued under and in accordance with th� �aws af th�

RECOMMENDATION:
It is recommended that the City CounciL
Authorize the City Manager fio enter into agreements with independent contractars far third party
plumbing inspectors ta pertorm plumbing inspections within the City of �ort Worth; and
2. Adopt the attached nrdinances which establish 10% as th� amoun# retained far new construction
build'[ng permits to cover the maximum amount payable for third party plumbing inspection services;
and
3. Adapt the attached ordinances which estabfish 9D% as the amaunt retained for ali plumbing work
permits, other than new construction, to caver the maximum amount payable for third parLy
plumbing i�spectian se�vices, and
4. Adopt the attached appropriation ordinance increasEng estimated receipts and appropriations in the
G�neral F'und by $115,aoa.
D15CUSSION:
On Marcn 2, 1999 (M&C G-12492), the City Council adopted ordinance amendments and directed staff
to impl�ment a program allowing third party plan reuiew and inspection services for the Building,
Efectrical, Plumbing and Mechanica{ Codes. Th�s program was necessary to address h�a�y demands
in building construction inspections, problems with recruiting and r�taining quali�ed City staff, and to
better meet the speciaf expertise or expedited schedules for �ariaus projects. At the time of
implementation, the City was experiencing 3D% of all inspection requests not being performed within 24
hours of the request, resulting in a decrease of productivity, cansfruction delays and increased cos�s.
The third party program a�lowed contractors andlor owners of prajects to cantract directly wit� plan
r��i�w or inspection firms to pro�ide services normally deli�ered by the De�elopm�ent Department. On
May 25, 1999 (M&C G-12568), fihe City Council au#horized a wai�er of 9Q% of the calculated building,
electrical, plumbing or mec�anical fees for projects managed ��r a third party firm. The callection of
1 a% by the City was det�rmin�d as the amount necessary� to cover staff casts in quality control and
record generation or management.
On Augusf 16, 2�00, the T�xas Stat� Board of Plumbing Examiners (Board) in�uired into Fort Worth's
third party program to determine if the program was uphoiding the State Plumbing License Law and
Board's rules. In partic�lar, the E3�ard had questions regarding the employment relationship between
the City and the third parky pfumbing inspector and the method of payment for those services.
5ubsequent replies and communications with the Board resulted in the Board Administra�or ruling that
the Fort Worth third party plumbing insp�ction process was not meeting the requiremen#s of the
Plumbing License Law or the Board's rules. The matter was fiorwarded to ihe Board's Enforcement

Committee for consideration on September 28, 20�0.
City staff attended the Enforcement Committee m�eting in 5eptember 2000, and it was determined #hat
a contrae#ual agreemeni similar to those with other jurisdictions might address the Board's concerns of
employment and compensation. A draft agreement between th� City and individual plumbing
inspectors was submitted to the Board an November 8, 2000, and discussed at t�eir Nov�mber 93,
2000 meeiing. Following the hearing, the Board's attorney relayed to #he City that minar changes to the
agreement would make the contract acceptable to the Board. A revised agreement was submitted to
the Baard on December 8, 2000.
The proposed agreement makes each third party plumbing inspector an independent contractor of the
City and restruc�ures the method of payment for those inspection services. The City will collect, ai the
time of permitting issuance, a percentage of the fotal building permit for the plumbing portion of a
pro�ect. Upon completion af plumbing inspectians by the thir� party inspector and invoicing of t�tose
services, the City will issue payment for the services rendered.
On December 22, �oaa, the Board Administrator communicated that the Board's Enforcement
Committee, Board staff and the Board's attorney ha� reviewed fh� Plumbing Inspectivn Agreement
submitted on December 8, 200D. The Board's attorney advised the Board that under the revised
agreement, fhe relationship between �he Licensed Plumbing Inspectors and the City o# Fort Worth,
alang with fhe method for com�ensating the Lieensed Plumbing Inspectors, does not violate the
Plumbing License Law or Board rules.
Cn order to begin im�lementation of the restructured third party plumbir�g inspection program, it is
necessary to authorize �he City Manager to enter into agreements with each third party p[umbing
inspector as independent contractars. A copy of the proposed Plumbing Inspection Agreeme�t is
attached.
Additio�ally, it is proposed to wifhho�d 10% of al[ building permit fees for related plumbi�g irtspection
services for each new construction project. In tf�e case of remodeling projects or jobs with only
plum�ing work, the City wi�l collecf the en#ire �lumbing permifi fee of whieh 90% will be returned as
payment for inspection services. These collections will equal the maximum amount payable to the third
party plumbing inspector for services rendered. li is es#imated that f�or the remainder of the fisca� year,
collection far the new canstruction projects would be $1Q5,OQa, and collections far the plumbing permit
only pro�ects wauld be $1Q,OaQ. Attached are the necessary prdinance amendments to facilitate this
col[ection.
In prder to manage the callections, invoicing and issuance of payments for the third parfy plumbing
inspection program, it is estimated that one additional authorized position and associated office
supplies and equipment will be ne�ded. The annual impact on the General Fund budget is estimated to
be $43,00a. The present implementation of this pragram will be handled as an overage and more

Favorable consideratior� by the City Cauncil far the third party plumbing inspection program and
strucfure wi11 authorize staff to implement the program on February 5, 2001.
It shauld be noted that staff has been workir�g with the 5afety and Community ��velopment Cammittee
to change the structure and amounts of building permits. Changes of fees and the percent wai�er for
t�ird party inspection sen+ices will be recommended in the near fut�re. At �hat time, tF�e attached
ordinances will need to be amended apprapriateiy.
�ISCAL INF�RMATIONICERTIFICATION:
The Finance Dir�c#ar certifi�s that upon a�proval of the above recommendations, funds will be
available, as appropria#ed, in the General Fund.
