HomeMy WebLinkAboutOrdinance 18684-06-2009Ordinance No. 28684-06-2409 AN flRDINANGE INCREASING ESTIMATED RECEIPTS AND APPROPRIATIONS !N THE GRANTS FUND IN THE AMOUNT OF $124.16, FROM AVAILABLE FUNDS, FOR THE PURPOSE OF FUNDING A "MOW DOWN AIR POLLUTION" MOWER EXCHANGE PROGRAM: PROVIDING FOR A SEVERABILITY CLAUSE; MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES; REPEALING ALL ORDINANCES IN GONFLIGT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE (T ORDAINED BY THE CfTY COUNCIL OF THE CITY flF FORT WORTH, TEXAS: SECTION 1. That in addition to those amounts allocated to the various City departments for Fiscal Year 2408-2409, there shall also be increased estimated receipts and appropriations in the Grants Fund in the amount of $124.16, from available funds, for the purpose of funding a "Mow Down Air Pollution" mower exchange program. SECTION 2. That should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void for any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in no way impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining provisions shall be and remain in full force and effect. SECTION 3. That this ordinance shall be cumulative of Ordinance No. 18283 and all other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed. SECTION 4. This ordinance shall take effect upon adoption. Authorize the City Manager to accept up to $5Q000.40 in Fiscal Year 2009 from various parties based on the agreement with Texas Commission on Enviranmental Quality to receive voluntary Supplemental Environmental Project contributions fora "Maw Dawn Rir Pollution" Mower Exchange Event; 2. Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the Grants Fund in an amount not to exceed $50;000.00, upon receipt of Supplemental Environmental Project funds; 3. Adapt the attached appropriation ordinance increasing estimated receipts and appropriations in the Grants Fund in the amount of $124.16 from available funds: 4. Autharize a transfer of interest earned from Supplemental Environmental Project Fiscal Year 2008 grant to Fiscal Year 2009 grant in the amount of $1,114.09; and 5. Adapt the attached appropriation ordinance increasing estimated receipts and appropriations in the Grants Fund in the amount of $2,000.00 from interest earned. A total of $42,387.04 in SEP funds were received by the City in Fiscal Year 2448. The Fiscal Year 2408 SEP grant earned interest in the amount of $1,238.25; TCEQ has authorized the expenditures of $124.16 during the Fiscal Year 2008 and the transfer of $1,114.49 to the Fiscal Year 2449 grant year. Any future interest earned wii3 be authorized to spend an the SEP grant. As of May 2049 three separate parties have been identified to provide $24,108.00 in contributions to the City of Fort Worth in settlement of an enforcement action brought by the TCEQ. The City plans to use these and any additional funds identified by the TCEQ to host a "Maw Down Air Pollution" Mower Exchange Event this summer. Funds identified to date wil! remove approximately 100 gasoline-powered walk-behind mowers from service and result in an estimated reduction of three and one half tons of volatile organic compound {VQC}emissions and removal of seven and one half tans of carbon monoxide emissions per year. The event will also assist in educating citizens on ways they can reduce azone- forming emissions.
