The 1'lumbing Z:nspector agress ta perform the services as s�t out i.n Exhibit "A". All documents which come into fihe possession of Plumb�ng Inspector are and shall remain the property of the City and shall be maintained as public records subj ect to determination by the City otherwise. C�TX REVIE'W � Plumbing Inspector ag�rees and understan�s that City D�10E�i5 rnay, at their disc�'�tion, make periodic siie visits to review, inspect and duplicafe any inspect�ons perfarmed by the Piumbing 7ns}�ector i.n order to insura a quality control af per�ormance. The city of�'icial shall maintaitt fu11 interpretation au#hority o�all a�'ected codes as we1Z as the authoriiy io require correatzons, including, but not limited ia, no4'ices az�dlor stap work arders. P1Umbing Ins�ector understands that, upot� comple�ian o� ail building grvjects, the City afficiat wili �erfozxz� a final inspec�ion prior to the issuance of a certificate a� occupancy. TERMINATION This Agreement may be t�m�.inated by either pariy for an� reason bq givin.g two �2} days written notice. The City reserves the right to s�spez�d or stop services imrriediately. z� AMEI�TDMENTS TO AGREEII�ENT ' Any amen,dment to #,�is Agreement � mus# be in writing and sign�d by the Plumbing Inspectar and tha City Manager of the City. N�1V-��XCLUSXVE AGREE�ViENT It is understood and agreed that retention of the Plumbin� Inspector by the Cify to perfozrn the Services, and for the purposes stated in this Agreem�nt, is nat exclusive. ASSISTA�7TS The Pl�un�aing Inspectax does not ha�e the right ta emplay assistants or sub plumbing Iraspectnrs to perfo�rn the Services withaut the advanced written consent of the City Develapment Director. A11 assistants or sub-plt�mbin� inspec#vrs emplayed by th� Plumhing Inspector shall be licensed plumbing inspectars. , XNDEMNiFICATION Plumbing �lnspector assurnes the entire responsibzlity and liabzlity �or any claim or action based on or arising out a£ injuries, including death, to persans or darnages to or destructian af properiy, sustained ar alleged ta have been sustained in connectian with or to ha�ve arisen out of or incidental to the perfarmance o£ this eantract by Plumbing Inspector, regardless of whefher such elaims or ac�ions are �ounded in whole n� in part npon alleged n�gli�ence � af the City of Fort Woz�th, its afficers, agents or employees, or tk�e e�nployees, agents, invitees, or licensees there�f. In res�ect to any such rnatters as se# aut a�io�e, Plumbing Inspector fi�rther agrees to indernnify anc� hold harrriless the City o£ Fart Worth, its officers, agents and employees ��d agxees to defend any claim ar suit or action at Plumbing Xnspectar's own expense when suit is braught against the City af Fort Worth, its officers, agents or employees, and employee�, agents, invitees, and licensees thereof. 0 I1�TSURAriCE It is agreed between P1Lunbing Inspec#or and City of Fort Worth that Plumbing Zn,spector ;�ill ,secure �d �arnish City ��v�lh ��ez�ificate af general Iiability and 3 r� 0 automobile insurance coverage iri az� amoun# specified by standard policies and pza�edures of �the Risk Management Departzxient o� the Ciiy during the term of this contract. The City of Fort Worth shall be shawn as an additzonal insured on said palicies of �nsurance. FORC� N�AJETJ�2E The �'lumbing Inspectpr sha11 not be responsible or Ziable for any lass, damage, or d.elay caused hy force maj eure wk�ich is beyond the contral of the parties, which shall incXude riat, insurrection, exnbargo, fire or explosion, the elezz�ents, act o� God, epidemic, war, earthquake, flood, or the oificial act of any gav�rnment. ASSIGNME�T This Agreem�nt shalZ not be assigned in whale or in gart by ,t�ie Plumbing Tnspector. LEGAL CONSTRUCTI41`� In case of any one or more of the provisions cor�tained in this Agreerri�nt shall for atzy reason be held io �e xnvAlid, iiTegal, or uneri.forceable in at�y respect, such invalidity, illegality, or unenf�rceabili#y shall not affect�any vther provision and this Agreement shall be canstrued as if such iz�val�.d, illegal, ar un�nforceable�prvviszon had nevex been cantained in it. WARRANTIES Piumbing Ir�spector hereby wanan�s t.h.at: a. Plumbing Ins�ector has, currently iri effect, all necessary Iiaenses to perfarm the wnrk, and Plum�ing Tnspectox is qualified to perfarm the wark as required by the City's Cod�s and the State of Texas; b. All assis#ants or sub plumb:ing inspec#ors emp�oyed by Plumbing Inspector shal� be currer�t2y licensed plumbixig inspectars; � c. DISCUSSION: On March 2, 1999 {M&C G-12492), fhe City Council adapted ardinar�ce amendments and directed staff to implement a program allowing third party plan review and ir�spection services for the Build`rng, Electrical, Plumb�ng and Mechar�ical Codes. This program was necessary to address heavy demands in building cor�strucfion inspectians, problems with recrui#ing and r�taining qualified City staff, and to better meet the special expertise or expedited schedules for various projects. At th� time of implementatian, fhe City was experiencing 30% of all Enspection reques#s not being pertormed within 24 hours af the request, resulting in a decrease of productivity, construction delays and increased costs. The third party program allowed cor�tractors andlor own�rs of projects to coniract directly with plan review or inspection firms ta pravide services normal{y delivered by the Development D�partment. On May 25, 1999 (M&C G-12568), the City Council aut�orized a wai�er of 90% of the calculated buiEding, electrical, plumbing or mechanical fees for projects managed by a third party firm. The collection of 10°/4 by the City was determined as the amounf necessary to cover staff casfs in quafity control and record generation or manag�ment. On August '[6, 200Q, the Texas State Board of PEumbing Examiners {Board} inquired into Fort Worth's third party program to d�termine if the program was upholding the S�ate Plumbing License Law and Board's rules. In particular, the Board had questions regarding the emplayment relationship between the Cify and the third party plumbing inspec#or and the method of payment for those services. 5ubseq�ent replies and communications with the Board resulted in the Board Adrninistrator ruling that the Fort Worth ihird pariy plumbing inspection process was not meeting the requirements of the Plumbing License Law or the Board's rules. A draft agreement between the City and indi�idual plumbing inspectors was submitted to the Bosrd an November 8, 2Q00, and discussed at their November 9 3, 2D00 meet�ng, Following the hearing, the Board's attorney relayed to the C9ty that minor changes to the agreement would make the contract acceptable ta the Board. A revised agreement was submitted #o the Board on December 8, 20Q0. Upon completion of plumbing inspections by #he third party inspector and in�oicing of those services, the Ciiy will issue payment for the services rendered. On Deeember 22, 2000, the Board Adminis#rator communicated that the Board's Enforcement Committee, Board staff and the Board's attorney had reviewed the Plumb�ng fnspection Agreement submitted on December 8, 2000. The Board's attorney ad�ised the Board #hat under fhe revised agreement, the relationship between the Licensed Plumbing Inspectors and the City of Fort Worth, alang uvith the methad for compensatin� tl�e Licensed Plumbing Inspectors, does not violate the Plumbing Lice�se Law or Board rules. In order to begin implementation of the restructured third party plumbing inspection program, it �s necessary to autharize the City Manager to enter into agreements with each third party plumbing inspector as independen# cantractars. A copy af the pro{�osed Plumbing Inspection Agreement is attached, Addifianapy, it is proposed to wiihh�ld 10% of all building permit fees for related plumbing inspection S�NIC85 for each new cons#ruction project. In the case of remodeling projects or jabs with only plumbir�g work, th� City will coflect the entire plumbing permit fee of which 90% will be returned as payment for inspection services. These collections will equal the maximum amount payable to the third party plumbing inspector for services rendered. It is estimated that for the remainder of the fiscal year, collectian for the new construction projects wo�ld be $105,oaa, and eallections for the plumbir�g permit onfy projects would be $1 p,a(}0. Attachad are the necessary ordinance amendments to facilitate this collection. In order fo manag� the colfections, invoicing and issuance of payments for #he third party plumbing inspection program, it is estimated tha# one additional authorized position and associated office supplies and equipment will be needed.
