This AGREEMENT is betweEn the City of F'ort Worth (the "CITY"), and Chiang, Patel &

Scape of Servi�es
The Scope of 5ervices is set forth in Attachment A.

1. The ENGINEER's compensation is set for�f� in Attachment B.

ierms of Payment
Pay�nents to the ENGINEER will be made as fallows:
Invoice and Payment
(1) The ENGINEER shali provide the CITY sufficient dvcumentation to
reasonab�y s�t�stantiate the invoic�s.
(2} Month�y in�oices will be issued by the ENGINEER for all work performed
under this AGREEMENT. Invaices are due and payable within 30 days of
receipt.
, (3j Upon completion of serv�ces enumerated in Artic[e I, the final paymenf.of any
balance will be due withir� 3Q days of receipt of the fina{ invoice.
(4) In the event of a disputed or contested billing, only that portian so contested
will be withheld from payment, and the t�ndisputed portion will be paid. The
CITY w�l! exercise reasonableness in contesting any bill or portion thereof.
No interest will accrue on any contested portian of the billing until mutually
resalved. -
(5) If ths CITY fails to make payment in #uil to ENGINEER fior billings contested
in goad faith within 60 days of the amount du�, the ENGINEER may, after
givir�g seven {7) days' written notice to CITY, suspend services under this
AGREEMENT untif paid in full, including int�rest. In the event af suspension
af services, the ENGINEER shall ha�e no liabiliry to CITY far delays or

RECOMMENDATION:
It is recommended that the City Council authorize the City Manager to execute an engineering
agreement with Chiang, Patel & Yerby, Inc. in the amount of $520,717 for w�ter transmission main
improvements from the Holly Wafer Treatment Plants to the Como Water Pump Statian.
DISCUSSNON.
This projecf is a part of the Water and Wastewater Master Plan prepared in 1989. Under ihis
recommendation, a 36-inc� �ater line will be designed next to an existing 48-inch water fine. The purpose
of this projeci is to pro�ide increased flow capacity from the Holly Wafer Teeatment plants pressure planes
into the Westside pressure planes.
Chiang, Patef & Yerby, lnc. was selected ta provid� the engineeri�g services necessary to produce
plans and specifications for this project, including a route study, hydraulic investigation and
geotechnical invesfigation. The �r�gineer wiq pr�pare plans, specifications, easements and permit
documents for approximately 1,8�0 linear feet of 36-inch water line.
MIWBE - Chiang, Patel & Yerby, Inc. is in compliance with fhe City`s MNVBE Ordinance by committing
to 22°/4 MIVIlBE participation. The City's goal on this project is 15%.
In addifion to the contract amount, $10,�00 is required for project managemenfi by the Engineering
Departmer�t.
This project is located in COUNCIL DISTRICT 9, Mapsco 75R, Q, T, S, and 76G, K, P and N.

impacted by the praject.

The City ofi Fort Worth water lacator map base sheets and consartium photograprs will
be used fior study mapping purposes. ENGINEER has digitai co�ies of the sew�r locator
maps. The CITY wi11 furnish digital copies of the consortium mapping. In addition to
mapping furnished by the CITY, the ENGINEER shall research and make efforts to
obtain pertinent information ta aid in the coordination of the proposed improv�ments with
an�r planned future impro�ements thai may influence the projeet. This information wip
include curren# and proposed Capital Improvement Projects, s#reet recons#ruc#ion
projects, sanitary sewer rehabifitation projects and other CITY projects that, may affeet
the route. Franchised utility plans that affect the route will be added also. These include
power, gas, electric, and cable television.
G. Co�ard�natian witf� O#F�er �g�ncies
During the concep#ual design the ENGINEER shal! coordinate with all uiilities, including
utilities ow�ed by the CITY, Texas Depar�ment af Transportation (TxDOT) and rail�oads.

These entities shall be contacted if applicable to determine plans for any proposed
�acilities or adjustments to existEng facilities within the route carridor. The infarmation
obtairted shal! be considered in analyzing the route. The ENGINEER shall also
determine permitting requirements and time frames requir�d for permitting.

The ENGINEER s�all walk the route corridor to nate pavement type ar�d con�ition of the
streets wit� in the route carridar and to nate the presence of any improvements that will
affect route selec#ion. The ENGiNEER will take photographs of critical features.

B. Hydraulic Analysis lnvestigation
The ENGINEER will re�iew existing Water Distribution Reports (Freese & NichaEs, inc.
and Camp, Dresser & McKee, Inc.) to de�elop background information for sizing the
transmission line. ENGINEER will pr�pare manuai hydraulic calculatians to verify that
the projected maximum day demands can be delivered to the Como �'ump Station
thraugh the proposed water transmissian main. The findi�gs anc� conclusions of the
study will be summarized 9n a Technical Memorandum.
a. 5ubmittal �ate
Technical Memorandum shall be suhmitt�d to CiTY with�n one hundred and seven
(107} calendar days after Notice to Praceed L.etter is issued. A total of fo�r (4)
capies of the draft memarandum shalf be prepared and submitted for review.

Th� ENGiNEER shall meet with the CITY to discuss review comments for Hydraulic
Analysis submittal. The CITY shall direct ihe ENGINEER in writ�ng to proc�ed with
preparation of the final memorand�am. A total of eight (8) copies of the fina�
m�morandum will be submitted.
C. Geo#echnicallnvestigation

The ENGINEER will prepare a subsurface �xplar�tion and lafaoratory testing program for
the project ta e�aluat� subsurface and groundwater conditions along the route and to
assist in the design of any associated structur�s. A field reconnaissance of the route wil�
be made to identify the barEng locations, �rimarily at key locatians such as railroad
crossings, rir�er crassings, and roadways where cnnstruction by trenchless technology
may be used anti at suspected locations where rock excavation is anticipated.
Approximately sixteen (16) borings are required to adequatefy define ihe subsurface
conditians. Exact lacation of the borings wilf be coordir�ated with the project staf�, Dig
Tess, and locators to clear the site for unde�rgrou�d utilities and drilf rig accessibil9ty.
Su�surface data from other nearby projects will be used to supplement the information
obtained fram the drilling and testing. SuiacQntracting with a quafifiied drilling and
geotechnical firm, borings will be driiled to depths u�arying from a minimum of 15-feet
alnng the route where apen cut burial is anticipated to a maximum of 45=feet where
trenchless technology or aerial crossings of rivers and railroads will be considered.
Samples #rom the borings will be taken every f9ve feet or change in material, whiche�er
aocurs first, by using either a split-spoon sampler with standard penetration tests or
Shelby tub� samples, depending on the soil character. Rack will be cored using a
double-tube NX core barrel. Testing of the soil samp[es will include Atterberg Limits,
r�atural mo9sture contents, unit dry weights, grain size analysis, and �nconfined
campression #est. Rock cores will be tested f�r unconfined corrzpressive strer�gth. TwQ
sampfes from each boring within the depth of the pipe zone will be provid�d to the
labaratory for appropriate testing for corrosion pratection considerations. A
Geotechnical Design Summary Report will he prepared to describe substirface and
groundwater conditions at the boring Iocations and their effect on design and
construciian. A plan of boring locations will be pra�ided along with boring lags and
faboratory tes# resul#s. Recommendations for pi�e emb�dment a�d trench construction,
ir�cluding trenchfess construction or aerial requiremer�ts will be Pravided. Selected plans
and specifications will be r��iewed to �erify that recommendations have been properly
ir�tarpret�d and follawed.

Geotechnical repor� shalk be submitt�d to CITY withir� one hundred and sixty-six
(168) calendar days after Natice io Praceed Letter is issued. A total af four (4)

The ENGINE�R and Geotechnical sub-consultant shall meet with the CITY to
discuss review comments for Geotechnical report submittal. The CITY shall direct
the ENGINEER in writing to proceed with preparation of the final report. A totaf of

i7, Carrosion Testing
ENGINEER will prepare corrosion protection r�cammendations tor the proposed
waterline for up to iwo pipe materials. Field surveys will �e pertormed along the
proposed pipeline route to determine parameters important to the corrasion
protection design. Approxima#eky 15 field resisti�ity tests will be performed along the
proposed alignment io characterize th� soil and rock as to carrosivity patential.

resistivity, pH, chloride anc� sulfide cantent. Existing �tility lines in the area will be
investigat�d with respect tv existing cathadic protection systems and their potential
impacts on tk�e proposed waterline. The engineer will survey the pipefine route fvr
stray DG earth current activity and identify appropriate locations far stray current
cantrol devi�es. Possible induced AC interfer�nce and the nee� for protection under
fault conditions will be investigated. Recomm�ndations fiar design of pipe materials,
joint honding, flange isolatton, electricai isola#ion at borings, test statior�s, stray
current int�rference mitigativn, AC interference mitigation, and cathodic protection
will be furnished,

compatible wit� the electronic data collectian and computer aided design and drafting
software currentiy in use by the Department of Engineering. All text data such as plan
and profile, legal descriptians, aoordinate files, cut sheets, etc., shalf be provided in the
American Standard Cade for Infiormation Interchange (ASCII} format, and all drawing
files shall �e pro�ided in MicroStationlJ (DGN} format (currently V7.1), or as o#herwise
appro�ed in writir�g by the CITY, and all data callected and generated during the co�rse
ofi the projec# shall become the property of the CITY.

Upon approvai af Part A, Section 2, ENGINEER will prepare preliminary construction plans
as fallows:
A. Overal! water and/or sanitary sewer layaut sheets and an Q�erall easement layout
sheet(s).
�. Pr.eliminary proj�ct plans and profile sne�ts wnich show the following: Proposed water
and/ar sanitary sewer planlprofile and recommended pipe size, fire hydrants, water
service lines and meter boxes, gate val�es, isalation valves and afl p�rtiner�t information
needed to construct the project. Legal descrEptian (Lot Nos., Block Nos., and Addition
Names} along with pro�erty owners�ip shall be pra�ided o� the plan view.
C. �or sewer lines, pipelines scheduled for point repairs, rehabilitatio� and replac�ment will
be located on the base sheets prepared from surv�y information gather�d under Part B,
Section 1. Conflicts sha11 be resolved where pipelines are to �e rehabifitated on the
same line segment. Base sheets sha{I reference affiected or adjacent st�eets. Where
open-cut canstruction is anticipated, belaw an� above ground utilities will be located and
shown Qn the base s�eets.
�. Existing utilities and utility easements will be shown an the plan and profile 5F1EEtS.
ENGINEER will coordinate with utility companies and the CITY to determine if any future
improvements are planned that may impact the project.
E. The ENGINEER shall conduct prelimir�ary research for a�aifability of existing easements
where oPen-cut construction or �elocation of existing aligr�ments is probable. Temporary
and permanent easements will be approximated bas�d on a�ailable infiormation.
Legai descriptions and plat maps will be prepared on 8.5"x1 �" standard sh�ets for all
necessary temparary and permanent easements required tor water main construction.
Descriptions shall be prepared in standard format as directed by Department of
Eng�neering {DOE}. Temporary and permanent eas�ments shall be delin�ated on plan
sheets. Ex�ibits shall be prepared. Legal descriptions shall also be pr�pared if needed.
A total afi one (1) pe�manent easement across Tarrant County Water District No. 1, two
(2) LotlBlack Tracts, two (2) Metes & Baunds Tracts, and ten (i0) temporary
construction eas�ments are included. The C1TY will secure easements and rights�of-
entry agreements as nec�ssary. _ �
I�. TF�e ENGINEER shall make pro�isians for r�connecting all water and/or wastewater
service lines which connect directly to any main being replace�, including rep[acement of
existing service lines within CITY right-of-way or utility easement. When the existing
alignment of a water and sanitary sewer main or lateral is changed, provisians will be
made in th� final plans andlor specifications by the ENGWEER to relocate all service

lines wf�9ch are connected ta the existing main and connect said service lines to the
relacated main.
G. The ENGINEER wilE prepare standard and, special detail sheets for water Ir`ne
installat9on and sewer rehabilitation or replacement that are nat already included in the
D-Sectian of the CITY's specifications. These may include connection details between
�arious par�s of the proj�ct, tu�nefing details, boring and jacking details, waterlir�e
relooations, details unique to the construction of the project, trenchless d�ta9ls, and
special service lateral reconnections.
Fi. The ENGINEER wilf pr�pare iraffic control pfans for alig�ments along roads and/or
streets. Texas Department af TransportationlManual on Uniform Traffic Control Devices
(TxDOT/MUTC[3} Standards shafl be us�c� to pre�are traffic cantro[ pEans. Plan scafe for
the drawings shall be 1"=20'. The plans will be based on the following criteria: The
contracior shalf excavate, install #he p9pe, and then backfill �he trench as he proceeds.
The contractor shall repEace roadway pa�ement after they have 2�00-�OOD iinear feet
r�ady. In ar�as where rvadway surface has no# been replaced, temporary paving shall
be installed within limits of exaavations. Dri�es and streets to remain open at al{ times.

be stamped, dated, sealecf and signed by the ENGINEER} and submit two (2) sets of
plans and constructi�n con#ract documents within 15 days of CITY's final approvaL Pian

I. Cvmpensation
A. The ENGINEER shall be compensated a lump sum fee of $520,7i7 for 6asic and
Special Services as� summarized ir� Exhibits "B-3". Payment of the lump sum fee _
shall be cnnsidered fufl compensation for the services described in Exhibit "A-i" for
all labar, materiai supplies, and equipment necessary to complete the project.
Partial payment shall b� made monthly as stipulated in Exhibit "B-1" upan receipt of
an it��oice from #he ENGiNEER, prepar�d from the books and records of the
ENGINEER. Each in�oice is to be verified as to its accuracy and com�liance with
the t�rms of this contract by an ofificer of the ENGIN�ER. Payment according to
statements wiN be subject to certification by the D9rector of Engineering Department
or his authorized repr�sentative that such work has been perfiormed.

d. �art A— Preliminary Engineering Report and Concept Engineer�ng Plans will be
submit#ed one hundred and si�y-six (166} days after the "Notice to Proceed".
�. Part B— Preliminary plans, specifications and contracfi doc�rments will be campleted
ninety-six (96) days aftar CITY appro�al af Cance�t Plans. Final Plans,
specificatians, contract documents and cast estimate wiA be completed seventy (70 )
days aft�r CITY approval af Preliminary Plans,
C. Part C— Bidding and Award will be campleted an estimated seventy (70) days after
C1TY's appro�al of Final Design plans, speci#ications and contract documents.

specifications that the opinion of probable cost (as estimat�d in Exhibit "B-4") will be
exceeded, whether by change in the scape af tF�e project, increased cost ar other
canditions, the ENGINEER shall immediately r�part such fact ta tE�e CITY's Director
of the Depart�nent of Engineering and, if so instructed by the Directar af the

RECOMMENDATI�N:
It is r�commended that the City Council authorize the City Mar�ager ta execute an engineering
agreement with Chiang, Patel & Yerby, fnc. in the amaunt of $520,717 for water transmission main
�mpro�ements from the Ho!{y Wa�er Treatment Plants to the Comd Water Pump Station.
DISCUS514N:
This praject is a part of the Water and Wastewater Master Plan prepared ir� 1989. Under this
recommendatian, a 36-inch water line will be d�signed next to an existing 48-inch water line. The purpose
of this project is ta provide increased f[ow capacity from the HaRy Water Treatment plants pressure planes
into the Westside pressure planes.
Chiang, Patei & Yerby, Inc. was selected to provide the engineering services necessary to produce
pla�s and specifications far this project, inclu�ing a route study, hydraulic investigation and
geotechnical investigation. The engineer will prepare plans, specificatians, easements and permit
documents for approximately 1,8a0 linear feet of 36-inch water line.
MIWBE - Chiang, Patel & Yerby, Inc. is in compliance with ihe City's MIWBE Ordinance by committing
to 22°/a MIVIIBE participation. The City's goal an this project is 15%.
In addition ta the contract amouni, $10,500 is required for project management by the Er�gin�ering
Departm�nt,
This project is located in COUNCIL DISTRICT 9, Mapsco 75R, Q, T, 5, and 76G, K, P and N.
