HomeMy WebLinkAboutOrdinance 16266-01-2005Ordinance No. ! ~~~~(~~`5~--~~ AN ORDINANCE WCREASING APPROPRIATIONS IN THE ENVIRONMENTAL MANAGEMENT FUND IN THE AMOUNT OF $426,618.59 AND DECREASING THE UNRESERVEb FUND BALANCE BY THE SAME AMOUNT, FOR THE PURPOSE OF TRANSFERRING SAID FUNDS TO THE COWTOWN INN PROJECT IN THE ENVIRONMENTAL PROJECT FUND; MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE iT ORDAINED 13Y TH1= CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That in addition to those amounts allocated to the various City departments for Fiscal Year 2004- 2005 in the Budget of the City Manager, there shall also be increased appropriations in the Environmental Management Fund in the amount of $426,618.59 and decreasing the unreserved Band balance by the same amount, for the purpose of transferring said funds to the Cowtown Inn Project in the Environmental Project Fund. SECTION 2. That should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void for any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in no way impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining provisions shall be and remain in full force and effect. SECTION 3. That this ordinance shall be cumulative of Ordinance No. 1606'1 and all other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed. SECTION 4. This ordinance shall take effect upon adoption. Adopt the attached appropriation ordinance increasing appropriations in the Environmental Management Fund by $ 426,618.58 and decreasing unreserved retained earnings by the same amount; 2. Adopt the attached appropriation ordinance increasing appropriations in the General Fund by $170,084.70 and decreasing unreserved retained earnings lay the same amount 3. Approve the transfer of $ 426,818.59 from undesignated funds in the Environmental Management Fund (R103) to the Cowtown Inn Project in the Environmental Project Fund (R101); 4. Approve the transfer of $170,084.70 from the General Fund to the Cowtown Inn Project in the Environmental Project Fund (R101); 5. Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the~r Environmental Project Fund by $596,703.29; and 6. Authorize the City Manager to execute a contract with Eagle Construction and Environmental Services, LLP in the amount of $596,703.29 for asbestos abatement and demolition of the Cowtown Inn structures at 6855 East Lancaster Avenue. DfSCiJSSIDN: The Cowtown Inn property has been abandoned for more than 15 years and has suffered extreme degradation through weather, neglect and vandalism. The City of Fort Worth acquired the subject site on January 2, 2001 through property tax foreclosure proceedings and holds the property in trust for two additional taxing entities: Tarrant County and the Fart Wnrth Independent School District. Prior to demolition of the nine structures that make up the Cowtown Inn complex, same 181,783 square feet of regulated asbestos-containing materials located in the various buildings must be removed in order for the City of Fort Worth to be in compliance with state and federal regulations for demolition. A Request far Proposals for the removal of the asbestos and demolition of the nine structures was issued by the Department of Environmental Management nn October 21, 2004. Responses were received on November 24, 2004 from the following firms: Atlas Equipment Company Lo~name: S2COWTOWNABATE nanP i „~^~ Basic Industries Certified/LVI Environmental, Inc. Eagle Construction and Environmental Services, LLP Entact Sisk-Rabb, Inc. The praposals were evaluated based on apre-determined combination of qualitative and quantitative (bid point) measures. These measures included but were not limited to the evaluation of such factoes as previous work experience, quafifcatians of personnel, contractor capabilities, cast and subcontractors. Based nn the total point distribution of the measures, City staff is recommending the contract be awarded to Eagle Construction and Environmental Services, LLP. Eagle Construction and Environmental Services, LLP is in compliance with the City's MNVBE Ordinance by committing to 62.5% MNVBE participation. The City`s goal far this project is 30%. The Cowtawn Inn is located in COUNCIL DISTRICT 5. F15CAL INFORMATIONICERTII=1CATlON: The Finance Director certifies that upon adoption of the attached appropriation ordinances and approval of the above recommendations, funds will be available in the current capital budget, as appropriated, in the Environmental Management Project Fund.
