hereinafter called "Deweloper", desires to make c�rtain improvements to
Settlement Piaza Addit9or�, Phase 11, an addition to t�e City of Fort 1�'Vorth, Texas;
and
WHEREAS, the said Developer has requesfed the City of Fo�k Worth, a
municipa! corporation of Tarra�t and Denton Counties, Texas, hereinafter cailed
"City", to do certain work in connec#ion with said improveme�#s;
f�OW, THEREFORE, KNOW ALL BY THESE PRESENTS:

SECTION ONE
COMMUNITY �ACILITIES AGREEMENT

A. The City agrees fo permit the Devefoper to let a contract for, �n accordance
with its accepted pract�ces, ordinar�ces, regufaiions, anci fihe pravisions of
the Cjty Charter, and subjecfi to the rec�uirements ofi the City's Charter, and
su�jecfi to the requir�ments af the Cify's Palicies and Regulations for
Installation of Community Faci{ifiies, a�i as cu�re�tt at tha time of installation:

and �I��dIi��Y ��L�ild��t �A�IL.IT'l�S �o serve the lots as shown on the
attached Exhibit �e� a{I in accordance with pfans and specificatioris to
be prepared by private eng�neers ern�loyed by the Developer and
appro�ed by the Water Departmer��.
B. The City agr�es to allow the Deveiaper to install, at his expense, at the
time all o�her water mains in this additian are instalied, a service 1in� for
each lot as shown on the aftached Exi�ibit A. The es�imated cost nf
these service lir�es is $ 46,05D. The Cify agrees to recard the tocation nfi
�ach said servic� line in respect �o the corner of the lot served, and to
retain said records in its pa��ession.
C. The construction cos# of the water facilities herein concerned, excfusive of
service lin�s ar�d er�gineering i� estimated io be One Hundred Sixty-
Three `Thousanai, �igh� F�ur�dr�d �orty�F'our D�Ilars i$�163,844) ,
D. The Cifiy agrees to allow the D�veloper to install, at his expense, at t1�e
time all other sanitary sewer ma�ns in this addifion are installed, a s�rvice
line for each lot as shown on the attached Exhibit �1�'! . The estimated
cosrt of th�se service lines is $�'1,7�0. Th� Gity agrees to record the
location of each �aici ser�ice line in respect fio th� corner of the iot served,
and to retain said records in its possessior�.
E. i"he car���rucfiic�ri r.osf of th� s�nitary sewer faciliti�s fio be instalfec�
hereu��er, exclusive of service lines ar�d engineering, is esfimated to be

F. Prior to allowance of the cor�struction contract by D�vefop�r, the Develo�er
agrees to provi�e acceptable financia! guarantee to th� city for 140 p�rcent
of the car+struc�ion of the construction costs alo�g with payment of any
Ordinanc� costs and fee� fihai are applicabfe. Prinr ta the award of the
cons#ruction contract by the Gity or the commencing of any work by th�
City or its contractors, the Devefoper agrees to pay to the Gity:
{1} (a) Qne Hundred �erc�nt ("lOD%} of the D�veloper's cosi� of all water
and sar�itary sewer facilitEes withi� the develflpment, ex�ius�ve of
engineering and service costs, �ized to provic�e water and sanitary sewer
ser�ice withrn the deveiopment. .
(b)One hundred p�rcent (100°/fl} o� the D�►�elaper's cost of all
appraach v�vater and sani�ary sewer fiacilities autside the iimits of the
devefopmen# si�ed to provide water and sanitary sewer service ta ti�e
de�efopment.
(c) One hundred percent {10D°lo} of the Developer's cost of any
approach water main facility pr wat�r faciliiy within tY�e development th�t is
8-inches in size for non-indus�riaf development and ��-inches in size far
indus#rial developm�nt.
�d}�ne hundr�d percen� {1Q0%} of t�e Developer's cost ofi ar�y
ap�roach sanitary sewer main faciji�y ar sanitary s�wer fiacilify within fhe
developm�nt tha�t is 8-inches in size.
(2} An additiona] ten percent ('k0%} ofi the totaf of the Developers cost
of these vvater and sanitary sewer facilities, exclusi�e of cost of service
�ines, is required for design engineering if such engineering is performed
by t��e City at tne Developer's r�qusst.
(3} �lne hundred perc�r�t (100°Jo) of the De�elop�r's cost of ail service
}ines, estimat�� ttnder 1-8 a�d '1-Q af�ove, in accordance with �h�
pro�isians afi the curre�f �orE Wor�h City Code.
(4) /� consfruction Inspecfiion Fee equal to �rnra �2%) af the Devebper's
actual co�fi share ofi fhe cnnstruction cost (incl�ding ail servic�s) af fhe
water andlor sanitary sew�r faciiities.

facilities to be constructed !�y contract awarded by the Developer,
provided afi conditions for City participation .have been met, the City
agrees to p�y the DevEloper the °Estimated City Cost° set ou# in 1-G
abo��; pro�ided, I�owever, that said payme�� shall be calcufated using the
actual cor�strUciion costs and actual service costs und�r the provisions of
fhe curre�tt Fort Worth City Cade, (said payment to be calculated as in 1-
G a�o�e), base� on acfual q�antities as refiCected in the �na! estimate paid
to the Contractor by the Developer and on #he actua{ recor�s af cost kept
by the City as a par� of its cusfomary �rocedures. in fih� evenf �he

K. Work hereunder sh�1i be compieted within two (2} years from date hereof,
and it is understood that any obligation on the part af the City to make any
refunds with respec# to water a�dlor sanitary sewer facilit�es shal{ eease
upon ihe expiration of twa (2) years firom c�afe her�of, excepi #or refunds
due from "frortt foot cl�arges" on water and sanitary se►rver mains, ,�n��n
refunds may continue to be made far a period of ten (10) years
commencing on the dat� that a�proach mains are accepted by the
pirecfio�. if less tnan 7Q% of the efigibl� collec#ions due ta th� develaper
has been collected, the D�veloper may requesfi in writing an �xfension of
up to an additianai 'I U years for collection of froni charges. in the event

year period, City may, at its efection, complete such work at de�eloper's

A. The Developer�sj agree to ir�staf( or to cause to have instalfed, the street,

B. The Developer agrees �o comply wifh a[I city accepfied pr�ctices, �ordinances,
regulat�ons, as well as provisions ofi fihe Gity Charter, the City Subdivision
Or�inan�ce, City Design S#andards and the current. Poiicy for installation of
Cammunity Facilities in the design, contracting and instailation o� r�q�aired
"current improvements".
C. The De�eloper agrees to comply wi�h the G�neral Reguirements contained
herein
(Attachment A).
D, As shown on the attached "Summary of Cost", the Developer agrees to fund
his share ofi "current improvements" an� to pay the Ci#y for his share of the
cost of str�et, storm drainage, stree# lighting, street name signs as showr� on
the attached Exh9bits �, �� and �.
E. Payment is due at the time this agreement is executed by the City and the
Developer.
F. The estimated total G05fi of current improvements and rela#ed suppart
services specified in this agreement, including design, construction and
inspec�ion 'is estimated to ��2�,Ofi5.00.
In accordance with the City's current Policy far Installation of Community
Facilities as shown in #h� Cast Summary on page 3.
The Developer shali contribute �ollars $i�7,��0.�D. of the total amount.

G. De�eloper agrees to prvvi�e, air �is expense, all necessary rights of way and
easements req�ired to canstruct current and future improvements provided
for ir� this agreement.

H. Developer agrees to relie�e fhe City of any responsibilit�es for any
inadequacies in the prefiminary pians, specifeations and cast estimates
supplied for the purpose of this contract.
I. Developer also agrees to install or adjust a11 of the required utilities to serve
the de�elopment or #o construct the improvements req�ired herein.

to City Co�nc�l approval of t�is Community Facilities agreement. (Article

l.. Developer agrees to complete the improvements covered by this agreement
within 90 calendar days after ha�ing been insiructed to do so, in writing, b�
the Director o�f Transportation and Public works. If is unders�ood that the
d�veloper wifl initiate �he consfiruction of all impro�ements to conform with his
own sched�ale, except for those impro�ements which �he Transporiation and
Publ�c Vllorks Director deems necessary for the praper and orderly
de�elopment of the area. !n the event Developer faiis to carry out any such
instructions within the 90-day period, the Develo�er gives the City �he right to
design and award a contract, and inspec� the im�rovements in question, and
ag�ees to pay to the City prior to the award of the confract, the amount of the
low bid.
M. City partic�pat�on in "curre�t impro�emer�ts" shall not exceed 125% o� cos#
shown in Summary of Gost.
N. Nothwithstanding anything contained herein #o the contrary, Deve�oper shall
be relea�ed of any obt9gation De�eloper has under the ferms of the
Gommunity Facilities agreement to install sidewalks as part of the
impro�ements covered by this agreem�nt so long as Developer obtains from
the applicable homebuilder a De�elopment Bond issued #o the City, as
Ob�igee ihereunder, guranteeing performance and payment by such
homebuilder of the sidewal�s installa#ian obligation hereunder. The aforesaid

Deve�opmenf Bond sha11 be in the farm thereof � a�tached hereto as
Attachment "D" and made a part hereof for all p�rposes, and shall caver such
hamebuilder's obligat�on to install and pay fior on a timely basis the sidewalks
required by this Community Facilities Agreement. Furthermore, upon the
issuance of such Development Bond to the City, the City shall not withhald its
acceptance of any ot�er improvements cover�d by this Community Facilities
Agreement upon completion thereof by De�eloper solely as a result of the
non-installa�ion of the required s�dewalks, it being understood that the
instapation of the sidewalks will occur subsequent to City acceptar�ce of such
other impro�ements and will be performed by s�ch homebuilder on a!ot by lot
basis in connectian with the building of a residenee on each such lot within
the subdi�ision. In that regard, tt�e homebuifder will be entitled to a
certificated of occupancy on a Io� by lo# basis upon safisfactory comQletion of
al{ other re.quirements of the Ci�y perkaining #o the issuance of such certifieate
of occupancy.

1. The Developer sha�l p�ovide for the installa�ion a� streetlights at
the approximate lo�a�ions shown in Exhib�� "C'�, imm�diately after
fina� acceptance o� the street construction, in accordanc� wi�h
engineering plans and specificat�ons approved by �he Transportation
and Pub1iC Work� Departmen�.
2. S�reetlights on res�dential and /or collector s�reets can be
installed usin� averhead ar undergxound conduc�ors with the approval
o� the Director o� Transpor�ation and Publac Works.
3. Streetilight� an arterzal s�reets sha�1 b� �nstalled w�th underground
canduit and conductors.
4. The Deve�oper shall pro�id� �or the znstallation of � 2-�nch
schedule 40 FVC Conduit at a depth not les� than 30 inches and at

G�NERAL REQUIREMENT�
A. it is agre�d and und�rstaod by the parties hereto that the de�elaper sha11
employ a civil enc�ineer, licensed to practice in the State af Texas, for the
desi�n ar�d pre�aration of plans and specifications fior the construcfiion of a4f
ct�rre�t improvements cover�d by t�is cantract, subject to Paragraph 8.
B. For any project estimated to cast less than $10,000 or fior any praj�ct
d�sign�c� to serve a single lat or t�act, the d�veloper may at his option request
the City to provide the design e�gineering, and if such request is granted, the
de�efoper shall pay to the City an amount equal ta 10 percent of the final
constructio� cost of such proj�ct fior such �ngineering ser�ices.
C. In the event ti�e cieve4oper employs his awn engineer to }�repare plans a�d
specifieatiions far any or all current im�ro�an�ents, t�r� plans and s�ecifications
so pr�pared shall be subject to a�praval by the deQartment having jurisdiction.
One (1? reproducit�le set of plans witn 15 prints and 35 specifications far each
facility snalf k�e furnished the department ha�ing jurisdiction. It is agreed and
understood that in the even� af �ny disagreement on the p4ans and

the pramises and the cavenants herein made by the City, the developer
cov�;nants and agr�es as foliows:

harmless and defend t�e City, its officers, agents and employees from

pe�sons ar p�op�rty, including d�ath, resulting from any failure to

3. STREET LiGHTING

COMPLETION AGREEMENT
This Completion Agreement (hereinafter called the "Agreement"1 is made and entered into by and
among the City of Fort Worth (hereinafter called the "C�"), Wes�ILanp 820 Partners, a Texas general
partnership (hereinafter called the "Develaner"l, and The Frost I�ational Bank (�-iereinafter called the
"Lender"), eff�ctive as ofthe Sth day nfMarch, 20D2. The City, the Developer and the Lender axe �aereinafter
collectively called the "Parties".
WITNESSETH:
WHEREAS, the Developer owns tliat certain tract af real property that con.tains appraximately 23. S
acres af land located in the City, #11e legal description of which tract ofreal property is marked Exhibit "A" -
Leeal Descriutian, attach�d hereto and incorporated hexein far all purposes (which tract of real property
is k�ereinafter calIed "Settlem,ent Plaza, Phase II"); and
WHEREAS, the Daveloper intends to develop Settlement Plaza, Phase II, a� an addition to the City;
and
WHEREAS, the Developer and the City have entered into a�Cammunity Facilities Agreement
relating to the development of SettIement Plaza, Phase II (hereinafter called the "CFA"); and
WHEREA5, the City has xequired certain. assurances of the a�ailability of funds to complete the
streets, street signs and lights, and the water and sewer utilities for the developmen,t af Settlemezat Plaza,
Phase II(herein collectively called th.e "Communitv Facilities"}, and
WHEREAS, in order to provide such assurances as have been raquired by the City, the Lender has
agreed to advance certain funds to the City far Hard Cosis (which term is hereinafter defned) subj ect to, and
in accordance with, the terms, provisions and conditions of this Agreement; and
WHEREAS, the Developer has grant�d ta the Lender as additianal security far the Loan (which term
is hereinafter defined) a security interest i� all plans and specifications far the developrnent of
Settlement Plaza, Phase II (hereinafter collectively called the "Plans"); and
WHEREAS, the Parties desire to set forth the terms and canditions of such accomrnodations as are
described above.
NOW, THEREFQRE, for and in consideration of the benefits to be derived from the mutual
o�servance by the parties of the terms and conditions hereof, and for and in consideration of Ten Dollars
{$10.00} and ather good and valuable consideration, tk�e receipt, adequacy and sufficiency of which are
hereby acknovvledged, the Parties agree as follaws:
1. Recztals. The foregoing recitals are true, correct and complete and constitute the basis for this
Agreement and they are incorporated into this Agreexxi.ent for all purposes.
2. The Comnletion A�nount. The City and the Developer agree that the Hard Costs requrred
to complete the Cammunity Fac�lities in the aggregate shouId not exceed the sum of Qne Mi.11ion One
Hur�dred Fifiy-Three Thousand Three Hundred Eighty-Three and 28/100 DoIlars ($1,153,383.28)
(hereinaf�er called the °`Camnlet�an Azaxount"). Notwithstanding the foregoing, it is acknowledged thai tlae
actual costs of compietion of the Community Facilities may vary as a result of char�ge orders agreed ta by
the Pa�rties, but such variances for the purposes oithis Agr�ement shall not affect the Com�letion Amouni
as used herein.

3. Adius#ments ta the Completion Amount. The Lender wi11 from time to time make advances to
the Developer far �he development of Settlement Plaza, Phase II, wnder the developxnent loan that has been
made by the Lender to the Developer for the purpose, among other things, of financing the costs of
consiructing ihe Comrnunity Facilities of Settlement Plaza, P�ase II (hez-einafter called the "Loan") sub�ect
ta, and in accordance with, the terms, conditions and provisions of the Loan Dacuments {which term is
hereinafter defined) evidencing and securing the Loan. Some of those advances shall be for Hard Costs as
speci�ed in the "Approved Budget" relating t4 the Laan, a copy of which Approved Budget is marked
Exhibif "B", attached hereto and incorparated herein for a11 purposes, with the Hard Costs (which term is
hereinafter defined) line itezns haghl ighted. The term "Hard Costs" shall mean the actual costs of construction
and installatian of the Comrriunity �aciIities. To the extent that advances under the Loan are for tl�e payment
ofHard Costs, the Cornpletion Amount shall be deemed reduced, dollar for dollar. The Lender may withhold
statutory retainage from any advances under the Laan or pursuant to ihis Agreement. All such retainage
withheld, to the extent it is attributable to Hard Costs, shall also xeduce the Completiaza Amount dollax for
dollar. Ail retainage withheld by the Lender for Hard Costs that are advanced to the City pursuant to this
Agreement shall b� released ta the City as provided in the Texas Property Code upon expiration of the
stafi.itoryretainage period. To keep the City advised of the Hard Costs, the Developer shalI proinptly deliver
to the City those portzons of a11 draw requests delivered to the Lender t�vhich contain requests for the pa�rnent
of Hard Costs and such draw requests shall itemize Hard Cos�s in such form and detail'as shall be reasonably
accepfi.a�ble to the Lender and the City. Upon approval af Lender of any dravv request containing requests for
Hard Costs to be advanced to the Developer, the Len.der shaIl give nafice tn the Ciiy setting forth the amount
of any Hard Costs to be advanced (the "Fundin� No�ce"). The City will be deez�z�ed to have approved the
praposed advance of Hard Costs by the Lender, unless it so notifies in writing �,ender that it obj ects ta such
advancement af Hard Costs within three (3} business days af the receipt by the City of the Funding Notice.
If the Ciiy objects to such advancernents of Hard Costs by the Lender, the City will have its own inspector
examine and evaluate the construction; then the Lender and ihe City shall cause their respec#ive inspectars
or consultants to cooperaie and shall us� iheir best reasonabie efforts to settle any dispute over the
apprapriateness of any advan.ce of Hard Costs. The Developer acknowledges that the Lender's obli�atian
io fund advances under the Loan within a speci.£'ied tirne fran:�e shall be deemed waived hy the Developer
if the. City and the Lender are in dispute with respect ta any requested advance. If arry such dispute is not
resolved prornptly, the two consultants shall agree within iive (5) business days on a qualifed third party
to resalve the dispute whose decision shall be final and binding on a11 Parties and shall be rendered within
five (5) business days of such consultant's selection. Any delay oceasioned by any such dispute shall extend
the Cozaapletion Date by such period of time.
4. Cornuletion bv the Develoner. Th� I7�veloper agrees to complete the Community �aciiiiies on
or before the date for completion that is established in the Loan Documents plus thirty (30) days {hereinafter
called the "Corriuletion Date"}, in accordance with the CFA, tlie Plans that are approved by the Lender and
tk�.e City and all documents evidencing ar securing the Loan (which documents are hereinafter collectively
called the "Loa� Documents"), For the puzposes of t�is Agreement, the developrnent of Settlement Plaza,
Phase II, snall be deemed complete upon acceptance by the City of the Community Facilities. The Ciiy shall
pxonn.ptIy notify the Lender and the Developer upon such acceptance.
5. Comuletian bv the Citv. In the �vent that either: (A) the development of Settiement Plaza,
Phase II, is not completed by the Cornpletion Date far any rreasan whatsoever, or (B) the Developer is in
default under the Loan and fhe Lender natifies the City ihat the Developer is in default and, at the Lender's
sale option, requests the City to complete developn:aent, whichever shaIl �rst occur, then, the City may, at
the cast and expense of the Developer, commence, pursue and complete the installation of the Cornmunity
Facilities in a reasonably timely, diligent and workrnanlike manner in accordance with the Plans, subject to
the terms of this Agreement, The Lender and the Deveioper agree that the City znay use the Plans as
necessary to complete the Community Facilities. Prior to the commencement of any work by the City, the
City shall provid� evidence of ir�surance reasonabIy required by ihe Lender narning the Lender and the
Developer as additional insureds.

6. Advance of Comnletion Co�ts to #he Citv and Delivery of Hard Costs Collateral to the Citv.
Upan the occurrence of either event d�scribed in paragraph 5 above, if the City elects �vithin ten (lq)
business days of the Cvm.pletio�a Date or notice From the Lender, as the case may be, to complete the
construciion of the Community Facilities, the Lezader shall thereafter advanca to the City any remaining
undisbursed Hard Costs specified in the Approved Budget relating ta tkie Loan that are incurred by t�e City
in coanpleting the Community Facilities in an aggregate sum not ta exceed the Completion Amount, as
adjusted, by funding monthly draws to the Ciiy as described herezn. The Developer hereby aut�orizes and
instruats the Lender to make periodic advances of any remaining undisbursed Hard Costs speci�`ied in the
Approved Budgetnot to exceed the cam.pletion A�a�ount in incrernents pard to the City within the same time
period speciFied in the Loan�Documents after receipt of advance requests meeting the requirements o£the
Loan Docuznents from the City of the Hard Costs remaining to be drawn under the Laan as specitied in the
Approved Budget incurred by it and approved by the Lender, subject to retainage. The advance requests fram
the City shall be made r�ot more frequeiztly than monthly {sa�re and except for final payment) and shall be
accompanied by reasonably acceptable evidence of tlae Haz�d Casts specified in the Appraved Budget that
have been incUrred by the City. The City shall use the funds advance for the payrnent of such Hard Casts as
are described in fhe advance request, and iith� City fails to do sa, the Lender's obligation to fund additianal
advances shall thereafter by terminated and of no continuing force and/nr effect. The City sha�l provide
mechanic's and materialmen's lien releases as may be reasonably requested by the Lender. Upon request of
the City, the Lender may pay such advances directly to the suppliers and contractors described in the advance
request. If the City. does not timely elect to complete the constructzon of the Comnnunity Facilities, th.en the
Lender may at its election terminate this Agreernent, and at zts option, proceed to complete the CommUnity
Facilities, foreclase on any of its coIlateral, or take any azld all such action as may be provided under th�
L�an Dncuments.
7 Comnletion bv the Lender. The Lender xaaay, at its discre#ion, but sha11 not be obligated to,
undertake to corriplete the Community �'acilities if ihere is any default under any Loan Documents in lieu
of requesting the City to r.ornplete the Community Facilities. In such event, however, the Lender must
complete the Community Facilities by the Completion Date ox t�e Ciiy shal� complete the same as provided
above. Lf the Lender elects to camplete the Community �acilities, any Hard Cosis it expends shall, dollar
far dollaar, areduce the Coznpletian Amaunt.
8. Easements. In the event the City or the Lender undertak�s the completion of the Community
Facilities, tY�e Developer (and to the extent necessary the Lender) grants to the City and the Lender open
access to Settlement Plaza, Phase II, and shall execuie and deliver such temporary easements over and across
the ent�ire Settlement P1aza, Plaase II, �or the purpose of acaess and use for the completion of the construction
of the Coznmunity �acilities in accordance �ith th.is Agreemen.#. To the extent requested by the City and #he
Lender, written temporary construction easements in form acceptable to the City and the Lender shall b�
executed by the Devaloper and iiled of recnrd. Nothing in this paragraph shall r�duce any rights of the
Lender ar ol�ligatians of the DeveIoper under the Laan documents.
9. Lender's Ri�Iats. Nothing iza �his Agreement sha11 affect any portion of the Lender's collateral
for the Loan or limit or im}�air the Lender's right to foreclose the same or deal wzth the collateral as it elects
in aceordanee witk� t�ae Loan Docurnents.
' 10. Satisfaction of the Cihr Reauirements. Tlze City agrees that the assurances and covenants
contained zn this Agreement satisfy all requirennents of the Cify with respect to payment and performance
bands or other requirements for security in connection with fihe development of Settlement Plaza, Phase II,
and the comple�ion of the Community Facilities that are contained in the CFA or in any other agreement
reIating thereto, and the Ciiy hereby accepts the assurances and covenant� contained I�erein in lieu thereof.
To the extent the C�'A irreconcilably conflicts with this Agreement, the provisions of this Agreement shall
control.

11. , Termination. Tlus Agreement shall termznate upon the earlier to occur of the foIlowing;
(A) acceptance by the City of the Community Facilities; (B) mutusl wrztten agreezn.ent of a11 of the Parties;
or (C) the reduction of the Cornpletion Amount tn zero.
12. Final Plat. The Parties aclrnowledge and a�ree t�aai the City shall �iold the fmal plat of
Settlement Plaza until the Comznunity Faci�ities are subs#antially completed and all Hard Costs contractors
have been paid, less retainage, and t�e Developer has deliver�d to the City the Development Bond
guaranteeing the instalIatian af the sidewalks as provided for in paragraph 14 below. Upon receipt and
accepiance by the City of evidence of substantzal completion and the payment by the Developer of all Hard
Costs con.tractors and Yhe Deveiopment Bond, the City shall immediately fi�e the final plat of Sattlement
Plaza in #he Tarrant County Flat Records. The purpose of the City retaining the final plat of Settlement Plaza
as prescribed her�in is to guarantee the Developer's obligations under the CFA.
13. Constructzvn Contracts. Developer agrees to include in each constz-uct�on contract t�at it
enters into for the completion of the Comrr�unity Facilities the following;
(a) A statement that khe City is not holding any securily to guaranty any payment foz wark
performed on the Community �acilities;
(b} A statement that the property is private property and that sam�e znay be subj ect to mechanic's
and materialmen's liens;

(c) A requirement that �ach contractor contracting with the Developer releases ihe City
from az�y clain:� that is related �o the Property; and �
(d) A requirement that each contractar . coniracting with. the DeveIoper include in each
subcontract the statements contained in (a), (b} and (c} above.
14. Subsiitution of Hard Cos�s Gollateral Related to Sidewalk InstaIlatzon.. Notwithstanding anything
contained herein to the contrary, DevelQper and Lender shall be reIeased of any obligation Developer
has under the terms of �he CFA and this Completion Agreement to instaIl sidewalks as part af the
improvements covered by t1�e CFA and this Agreement so Iong as Developer obtains fram the
applicahle homehuilder a Development Bond issued to the Ciiy, as ObligEe thereunder, guaranteeing
� performance and payment by such homebuilder af the sidewalk znstallation obligation of Dev�Iaper
under the CFA and this Agreement. The aiaresaid D�velopment Bond shall be in the f�rn� thereof
attached hereto as Exhibit "C" and made a part hereof far all purposes, and shalI cover such
hornebuilder's obligation to install and pay for on a timely hasi s the sidewalks required by Y1�e CFA
arid this Agreement. Rurthern�are, upon the issuanc� of such Development Band to the City, {a) ihe
Compleiian Amount under this Agreement will be reduced by $67,980, and (b) the City shalI not
withhald its acceptance af any ather irnprovements covered by the CFA and this Agreement upon
completion thereaf by Developer solely as a result of the nan-izastallatian of the required sidewalks,
it being understood that the installatian of th�; sidewaIks will occur subsequent to City acceptance
af such ather improvements and wilI be performed by such homebuilder on a lot by loi basis in
connection with the building of a residence an each such lot witk�in the subdivision. In that regard,
the hornehuilder wiIl be entitled to a certificate of occupancy on a lot by lot basis upan satisfactory
completion of the installation. of t�ae sidewalk on such lot and upon saiisfactory completion of all
oiher requirements of the City pertaining to the issuance of such certi�cate of occupancp.
15. Misaellaneous.

DISCUSSlON:
West/l.00p 82Q Parkners, the develaper of Settlement Plaza Addifion, Phase il, has executed a
j proposed contract for c�mmunity facifities to serve a singie-family de�e�opment (108 kots) located in
southwest Fort Warth, south of W�ite 5et�lement Raad and west of Jim Wright Freeway South (Loop
820) (see the attached map).
The proposed cornmunity �aciEities agreement is in campliance with. City palicy. The de�elQpment has

DISCUSSION:
WestlLoop 820 Partners, fhe developer of Settlement Plaza Addition, Pf�ase I!, has executed a
proposed contract for comm�nity facilities ta serve a single-fam'rly develapment (1fl8 Iats) loca#ed in
southwesf Fort Workh, sout� of White Settlement Road and west of Jim Wri�ht Freeway South (�oop
82�) (see the attached map).
The propase� community facilities agreem�nt is in compliance with City Poficy. The develo�ment has
six (6} interior streets. The developer's share %r street improvemet�ts is $497,624, �lus $9,952 for
