HomeMy WebLinkAboutContract 27885^!TY S�CRET'�RY - r� �;����i'�A�T NO. � I��� INTERLOCAL AGREElVIENT FOR PTJBLIC MASS TRANSPORTATION IMPROVEMENT MODIFICATIONS AND ALTERATIONS BETWEEN THE CITY OF FORT WORTH A1�ID THE FORT WORTH TRAl�TSPORTATION AiTTHORITY This Interlocal Agreement is made by and between tha CTTY OF FORT WORTH, Texas hereznafter referred to as "CITY", and tha FORT WORTH TRANSPORTATION Ai3THORITY, d/b/a the T, hereinafter ref�rred tn as "the T". Ii is made between two ga�ernmental subdivisions of the State of Texas pursuant to the Interlocal Cooperation Act, Article 791 ADI, et se�c ., of the Te�as Government Code, 1.. The purpase of this Tnterlocal Agreement is ta enhance the quality of transportation services and certain public thoroughfares witkzin the boundaries of CITY fox the bene�t of the citizens af the CTTY and the riders oF the transportation system operated by the T, and to do so in an efficient and economical manner. 2. The CITY and the T bath recognize tha.t each, individually, has the legal authority to modify and alter public streets a.n.d tharoughfares withiu the boundaries of CITY in car�ying out their respective purposes, and that suc� actions are a governmental £uz►ction. Fuz�her, each party, individually, has ihe legal authority to carty aut the street modifications and alteratians within the boundaries of CITY which are of tlie iype described in secLion 3 of this Contract. 3. Effective May 1, 20Q2, and for the iwelve month period fram khat date ttirough Apri130, 2003 (hereinafter referred to as the "Year"), CITY and the T agree ta implement a street modifcation on Public Mass Transportation Improvements and Modifications consi5tent with and limited by the powexs af the T to grovide public transporta�ian and g�neral transportation s�rvic�s as set out in Chapter 452 Texas Transportation Code (hereinafter referred to as the "Program"). The T hereby agrees to provide funds fbr the specified Public Mass Transportation Iinprovement Modif cations and Altera�ians ta eompensate CITY for partial costs oFcarrying out the Program as se# out in seciion 4 of this Contract. CITY and the T further agree that the proj ect included in the Program will be related to, and necessary or useful in carrying aut th� purposes fnr �vhich the T was created nr within the powers of fihe T under state law. CITY will develop the Frogram and prnvide a copy of it ta the T priar ta b�ginning its implementation. A. The Program will include installation a traff c control and pedestrian signal system at fihe i�tersections agreed to �y the T and City staffs to ha�dle increased traffic in the immediate proxi�a�.i.ty af the Trinity Railway Express including buf not limited to the Intermodal Transportation Center, ancl/or certain bus transfer centers and routes. As subsequently identi�ied and mutualiy agreed to in writing by the T and the City, the Ciiy wil] remave those parking meters in ihe vicinity of the Int�rmodal Transpartation Center ("ITC") to pravide far safe traf�ic patterns, and will establish and enforce such area as a no parkzng. C. The Program will provide for other such pu�lie street and thoxou�hfaze improvements including safe f�affic improvements as may be determined in accordance with applicable statutes, xules, and regulations. 4, The T shall pay CITY $400,000 from its curreni revenues during the Year for activities which are of the nafure descrihed in Section 3 nf this Agreemeni. The T's poriian will be paid vvithin 30 days of the CiTY'S sub�ssion oftlae Prograru detailing the work accamplished and to be accomplished and paid �or by the CITY. 5. CTTY agrees that the projects in the Frograrn shajl be constructed in such manner as to acconnmodate, withstand a�d hold up under reg�lar use by the T's buses and/ or Trinity Railway Express cornmuter rail trains, as applicable. The T agrees to advise CITY, and Tnalce available to CITY the knowledge and experience of its e�m.ployees an.d of any cansultants it has retained relating to bus loads, braking forces and other faetors relevant to the construct�ion of the projects in the Frogram to accammodaie the T's bus use or related to operation of its carnmuter trains. 6. CITY agrees that aIl work on the proj ects in the Program will be carried out in accordance with all lagal requirem.ents, i�ncluding Texas competitive hidding requueznents. 7. Both parties agree and acknowledge that tl�e ainouzits to be paid by the T will be such as tn fairly compensaie the CITY for the s�rvices perfarmed, as those services relate to and k�enefit the traz�sportation system of the T, By its signature to this contract, each party represent� to the other that it5 gover�ing body has approved a�ad au�horized it to enter into this agreement. Lancaster Ave Fart Worth, Tx 76102 Dear Mr. BartosiEwicz: Pursuant to the Interlocal Agreement (TLA) between the City and the T dated Maq 1, 2002, the City of Fort Worth has initiated the Public Mass Txansportation Tinprovements az�d Mociif'ications Program ("Program") defined i� the agreement as follows: 1. A traff c contral signal systern has been installed at the interseciion of Ni�th and Jones Street. The City will maintain this system. 2. Three (3) parlcing meters will be removed from the north side ofNinth St. immediately west o�ihe Jones St. intersection. 3. The City will establish a.t�d enforce a no parl{ing zane on tkae east side of Jones St. from the corner of Eight St. south to the taxi cab turnaut immediately nortb of the front doar of the ITC. The ILA now requires the T ta remit paym�ent for �he Program. Accept and increase es#imated receipts in ihe Contracf Street Maintenance Fund by $400,000 from funds recei�ed firam the T for pub�ic and generaf transportatian-related street improv�m�nts; and 3. Authorize tne transf�r of $40p,000 in pre�iausly appropriated City stre�t maintenance funds fram the General Fund ta the Special Assessments District Fund for impravements to tt�e �'ort Worth Rail Mar4�et. DISCUS510N: Under City 5ecretary Cantract {C5C} No. 19689, the T annually gi�es the City � 5% of the amount ofi ihe T's sales tax re�enues attributed ta covered sales within the City for the previous ealendar year. Thes� funds are used hy the Gity solely for making public and gen�ral transportation-related street repairs. The T was recently notified that an additianal $4QQ,000 in €e�e�af funding has becorne available for the same purposes. The proposeci Interlocal Agreement with the T will allow the City to accept this an�- time fund�ng and v�+ill provide that the City will use the funds for the 'same Eimi#ed purposes as provi�ed under CSC Na. 19689. Because of the unexpecfed $400,OOa in #edeFa-I funds that the City wifl receive from the T for public and general transpo�tation-related street improvemenfs, City staff recommends that City funds preuiously apprapriated for the same purpose be used instead for the public purpase ofi making final improvements to the Fart Warth Rail Marke# (the Mark�t}. The Market, a prajeci of the Down#own Tax Incr�ment Financing District, will be located in the Sanfa Fe Northern Warehause on �ones Street and wi{I provide over 40,000 square feet of space for merchants selli�g faod, flowers and a� assortment of specialty it�ms. ln addition, a weekend farmers' market will showcase Eocally grawn produce, crafts and entertainment.
