With a quorum of the City Council Members present, Mayor Parker called the City
Council Regular Session of the Fort Worth City Council to order 6:04 p.m. on Tuesday,
September 12, 2023, in the City Council Chamber of the Fort Worth City Hall, 200 Texas
Street, Fort Worth, Texas.

(a) Bars or taverns 2,000 square feet or less are allowed by right in the MU-
2 District.
(b) A conditional use permit shall be required if the bar or tavern is larger
than 2,000 square feet where alcohol is served or consumed.
(c) A bar or tavern that was lawfully in existence on the effective date of
this section shall be granted nonconforming status. The Building Official
shall maintain a register of all Certificates of Occupancy for bars and
taverns made nonconforming after the effective date of this section. The

Building Official shall determine maximum occupancy allowed where

ii. the sale or transfer of the business/premise requires a new TABC permit
or license is required; or
iii. maintaining, repairing or making alterations that do not exceed the
occupancy allowed in the registry maintained by the Building Official.
(e) Nonconforming status shall terminate when:
i. the TABC permit or license is terminated and a bona fide application for
a new license or permit is not filed with TABC within two years of the prior
permit or license expiration; or
ii. the use has been changed to a conforming use in the MU-2 District; or
iii. the use is altered or expanded such that the occupancy exceeds the
maximum allowed in the registry maintained by the Building Official; or
iv. restoration of a building destroyed by fire, explosion or other casualty, or
act of God exceeds 75% of the building's reasonable value.

Motion: Council Member Blaylock made a motion, seconded by Council
Member Lauersdorf, that M&C 23-0765 be approved and Resolution
No. 5803-09-2023 authorizing use of the power of eminent domain to
acquire 0.001 acres in right-of-way easement from real property owned
by Ron E. Brown and Kelly V. Brown. The land rights in the subject
property are needed for the Avondale Haslet Road project, a public use
that will reconstruct and widen Avondale Haslet Road from Willow
Creels Drive to the eastern city limits of the City of Haslet at John Day
Road. The property will be used for widening and reconstructing the
existing two-lane asphalt roadway to a four -lane, divided, concrete urban
arterial. The property is located at located at 1849 Willow Springs Court,
Willow Springs West Subdivision, Block A, Lot 18, City of Haslet,
Tarrant County, Texas. The property interest to be acquired is described
by metes and bounds and depicted by survey exhibits attached to this
Mayor and Council Communication. Motion passed 11-0.

for the Fort Worth Block 9 Platting Project, a public use that will
provide sufficient vehicular access for the public and emergency
responders for the properties located in Block 9 of the Lake Worth
Lease Survey in the City of Fort Worth. The land rights in the subject
properties are needed for the construction, operation, maintenance,
replacement, upgrade, and repair of a public access easement. The
property is located at 4221 Lakewood Drive, Lake Worth, Tarrant
County, Texas, being a part of Lot 22B in Hodgkins Highlands, an
addition to the City of Lake Worth, Tarrant County, Texas. The
property interests to be acquired are described by metes and bounds and
depicted by survey exhibits attached to this Mayor and Council

following changes: Remove the request to reallocate $1.5 million in ARPA
funding for the purpose of funding new construction of the affordable
housing, not the permanent supportive housing project referred to as "The
Nest", and continue to the September 26, 2023, Council meeting; and to
make all conforming changes to the M&C, as needed, to allow the time for
Council members who have questions. Motion passed 6-3, Mayor Pro tem
