HomeMy WebLinkAboutOrdinance 16267-01-2005Ordinance No. [ ~P„~, I~ ~`o AN ORDINANCE INCREASING APPROPRIATIONS IN THE GENERAL FUND IN THE AMOUNT OF $170,084.7D AND DECREASING THE UNRESERVED FUND BALANCE BY THE SAME AMOUNT, FOR THE PURPOSE OF TRANSFERRING SAID FUNDS TO THE COWTOWN INN PROJECT iN THE ENVIRONMENTAL PROJECT FUND; MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That in addition to those amounts allocated to the various City departments far Fiscal Year 2004- 200v in the Budget of the City Manager, there shall also be increased appropriations in the General Fund in the amount of $170,084.70 and decreasing the unreserved fund balance by the same amount, for the purpose of transferring said funds to the Cowtnwn Inn Project in the Environmental Project Fund. SECTION 2. That should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void far any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in no way impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining provisions shall be and remain in full force and effect. SECTION 3. That this ordinance shall be cumulative of Ordinance No. 16061 and all other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed. Assistant Cit Attorney ~~ ADOPTED AND EFFECTIVE: ~~ tL.t~~~ ~.~s..y Ci~,~ of Foef ~i/vr~h, l'exa~ sus,~ECT: Authorize Execution of Contract with Eagle Construction and Environmental Services, I_LP for Asbestos Abatement and Demolition of the Cowtawn Inn and Adopt Appropriation Ordinances RECOMMENDATION: It is recommended that the City Council: 1. Adopt the attached appropriation ordinance increasing appropriations in the Environmental Management Fund by $ 426,618.59 and decreasing unreserved retained earnings by the same amount; 2. Adopt the attached appropriation ordinance increasing appropriations in the General Fund by $170,084.70 and decreasing unreserved retained earnings by the same amount 3. Approve the transfer of $ 426,618.59 from undesignated funds in the Environmental Management Fund (R103} to the Cowtown Inn Project in the Environmental Project Fund {R101); 4. Approve the transfer of $170,084.70 from the Genera[ Fund to the Cowtown Inn Project in the Environmental Project Fund (R101); 5. Adapt the attached appropriation ordinance increasing estimated receipts and appropriations in the~~ Environmental Project Fund by $596,703.29; and 6. Authorize the City Manager to execute a contract with Eagle Construction and Environmental Services, LLP in the amount of $556,703.29 for asbestos abatement and demolition of the Cawtown Inn structures at 6855 East Lancaster Avenue. ©ISCUSSI©N: The Cowtown Inn property has been abandoned for mare than 15 years and has suffered extreme degradation through weather, neglect and vandalism. The City of Fort Worth acquired the subject si#e on January 2, 2001 through property tax foreclosure proceedings and holds the property in trust for two additional taxing entities: Tarrant County and the Fort Worth Independent School ©istrict. Prior to demolition of the nine structures that make up the Cowtown Inn complex, same i 81,783 square feet of regulated asbestos-containing materials located in the various buildings must be removed in order for the City of Fort Worth to be in compliance with state and federal regulations for demolition. A Request far Proposals for the removal of the asbestos and demolition of the nine structures was issued by the ©epartment of Environmental Management on October 21, 2004. Responses were received an November 24, 2004 from the following firms: Atlas Equipment Company Lo~riame: 52COWTOWNABATE Pnrrn i „~~ C~asic industries Certified/1_VI Enviranmentaf, Inc. Eagle Construction and Environments! Services, LLP Entact Sisk~Robb, Inc. The proposals were evaluated based on apre-determined combination of qualitative and quantitative tbid point) measures. These measures included but were not limited to the' evaluation of such factors as previous work experience, qualifications of personnel, contractor capabilities, cost and subcontractors. Based an the total point distribution of the measures, City staff is recommending the contract be awarded to Eagle Construction and Environmental Services, LLP. Eagle Construction and Inviranmentai Services, LLP is in compliance with the City`s MIWBE Ordinance by committing to 62.5% MNVBE participation. The City's gas! far this project is 3(~%. The Gowtown Inn is located in COUNCIL DISTRICT 5. FISCAL INFORM~TIONICERTIFICATION: The Finance Director certifies that upon adoption of the attached appropriation ordinances and approval of the above recommendations; funds will be available in the current capital budget, as appropriated, in the Environmental Management Project Fund.
